{"id":10155,"date":"2016-10-05T10:19:36","date_gmt":"2016-10-05T14:19:36","guid":{"rendered":"http:\/\/journals.law.harvard.edu\/crcl\/?p=10155"},"modified":"2016-10-05T10:19:36","modified_gmt":"2016-10-05T14:19:36","slug":"weekly-news-roundup-1052016","status":"publish","type":"post","link":"https:\/\/journals.law.harvard.edu\/crcl\/weekly-news-roundup-1052016\/","title":{"rendered":"Weekly News Roundup &#8211; 10\/5\/2016"},"content":{"rendered":"<p>We don&#8217;t endorse candidates, but we can stress what&#8217;s at stake this election cycle.<\/p>\n<p><strong>Extending and Ensuring Voting Rights <\/strong><\/p>\n<p>With flimsy excuses like <a href=\"http:\/\/www.nytimes.com\/2016\/10\/05\/opinion\/the-movement-to-end-racist-voting-laws.html?action=click&amp;pgtype=Homepage&amp;clickSource=story-heading&amp;module=opinion-c-col-left-region&amp;region=opinion-c-col-left-region&amp;WT.nav=opinion-c-col-left-region&amp;_r=0\">\u201cmoral turpitude\u201d<\/a> historically blocking \u201cfelon\u201d voting, states are moving to alleviate those restrictions. <a href=\"http:\/\/www.theatlantic.com\/politics\/archive\/2016\/10\/california-now-allows-voting-for-some-jails\/502448\/\">California<\/a> extended the vote to people incarcerated for felonies in county jails. The state joins others\u2014such as <a href=\"http:\/\/www.theatlantic.com\/politics\/archive\/2016\/02\/maryland-felon-voting\/462000\/\">Maryland<\/a>, <a href=\"http:\/\/www.npr.org\/sections\/thetwo-way\/2016\/08\/22\/491000431\/virginia-governor-restores-voting-rights-to-felons-again\">Virginia<\/a>, and <a href=\"http:\/\/www.miamiherald.com\/news\/politics-government\/state-politics\/article103551187.html\">Florida<\/a>\u2014in recent moves to reinstate the right to vote to incarcerated and formerly incarcerated persons.<\/p>\n<p>In Maine, disability rights advocates are hosting <a href=\"http:\/\/wgme.com\/news\/local\/disability-rights-maine-is-hosting-a-series-of-voter-education-events\">voting education events<\/a>.<\/p>\n<p>As early voting begins, ProPublica\u2019s <a href=\"https:\/\/www.propublica.org\/article\/voting-has-started-and-electionland-is-on-the-case\">Electionland<\/a> has committed to spotting problems as they begin.<\/p>\n<p><strong>Police Brutality <\/strong><\/p>\n<p>It\u2019s common knowledge\u00a0that recording\u00a0technology has changed how mainstream America views police violence. Videos have police killings,the\u00a0<a href=\"http:\/\/www.theatlantic.com\/news\/archive\/2016\/10\/sacramento-police-footage-joseph-mann\/502709\/\">intent behind those violent encounters<\/a>, and <a href=\"https:\/\/www.washingtonpost.com\/news\/the-watch\/wp\/2016\/09\/20\/aclu-audio-recording-captures-connecticut-state-police-conspiring-to-fabricate-criminal-charges\/?utm_term=.40aa8450338f\">police conspiracy to fabricate charges<\/a>.<\/p>\n<p>But they also are proving to be insufficient to curb police violence and misconduct. Studies show <a href=\"http:\/\/www.theatlantic.com\/technology\/archive\/2016\/09\/body-cameras-are-just-making-police-departments-more-powerful\/502421\/\">opportune use of the cameras<\/a>, such as police activating the cameras only<em> after<\/em> episodes of violence, and laws restricting public access to the footage.<\/p>\n<p><strong>Racial Violence and Intimidation<\/strong><\/p>\n<p>An East Tennessee State University student, Tristan Rettke, has been charged with a felony under Tennessee\u2019s Civil Rights Intimidation laws, after wearing a <a href=\"http:\/\/www.thedailybeast.com\/articles\/2016\/09\/30\/student-who-wore-gorilla-mask-to-black-lives-matter-rally-says-he-s-leaving-school.html\">gorilla mask and handing out bananas<\/a> at a Black Lives Matter protest in the campus&#8217;s free speech area. The <a href=\"http:\/\/www.aclu-tn.org\/aclu-tn-responds-racist-incident-etsu-march\/\">ACLU<\/a> pointed out that it is\u00a0a violation of the First Amendment to charge him. The student has\u00a0<a href=\"https:\/\/www.washingtonpost.com\/news\/volokh-conspiracy\/wp\/2016\/10\/04\/student-arrested-by-east-tennessee-state-university-police-for-civil-rights-intimidation\/?utm_term=.9743897e9287\">since withdrawn from the university.<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>We don&#8217;t endorse candidates, but we can stress what&#8217;s at stake this election cycle.
