{"id":10703,"date":"2017-11-10T17:28:36","date_gmt":"2017-11-10T22:28:36","guid":{"rendered":"http:\/\/journals.law.harvard.edu\/crcl\/?p=10703"},"modified":"2017-11-10T17:28:36","modified_gmt":"2017-11-10T22:28:36","slug":"moving-forward-one-year-later","status":"publish","type":"post","link":"https:\/\/journals.law.harvard.edu\/crcl\/moving-forward-one-year-later\/","title":{"rendered":"Moving Forward: One Year Later"},"content":{"rendered":"<p>This week marks one year since Donald Trump won the presidential election. The next day, I wrote a <a href=\"https:\/\/journals.law.harvard.edu\/crcl\/moving-forward\/\" target=\"_blank\" rel=\"noopener\">reflection piece<\/a> for this blog, outlining the fears many of us shared and voicing hope and determination we held onto. Now, a year later, I write about where we are today and how we can continue to move forward towards a stronger and more united country.<\/p>\n<p>Following the inauguration, the new administration quickly began enacting policies to match the <a href=\"http:\/\/www.telegraph.co.uk\/news\/2016\/12\/02\/donald-trump-calls-unity-takes-divisive-rhetoric-campaign-first\/\" target=\"_blank\" rel=\"noopener\">divisive rhetoric<\/a> of their campaign. One of Trump\u2019s first moves was to enact so-called <a href=\"http:\/\/www.slate.com\/blogs\/the_slatest\/2017\/10\/17\/federal_judge_temporarily_blocks_trump_s_latest_travel_ban.html\" target=\"_blank\" rel=\"noopener\">\u201ctravel bans,\u201d<\/a> prohibiting or severely limiting travel to the United States from several majority-Muslim countries. The administration has attempted three separate bans \u2013 in January, March, and September \u2013 but all three have been <a href=\"https:\/\/www.washingtonpost.com\/world\/national-security\/federal-judge-blocks-trumps-third-travel-ban\/2017\/10\/17\/e73293fc-ae90-11e7-9e58-e6288544af98_story.html?utm_term=.9b309bce166f\" target=\"_blank\" rel=\"noopener\">blocked<\/a>, at least in part, by the courts.<\/p>\n<p>Racial tensions have also escalated over recent months. In August, white supremacists marched in Charlottesville, Virginia, resulting in the death of <a href=\"http:\/\/www.cnn.com\/2017\/08\/13\/us\/charlottesville-heather-heyer-profile\/index.html\" target=\"_blank\" rel=\"noopener\">counterprotester Heather Heyer<\/a>. Rather than immediately denouncing the neo-Nazis and white supremacists responsible for the violence, Trump repeatedly stated there was <a href=\"https:\/\/www.politico.com\/story\/2017\/08\/15\/full-text-trump-comments-white-supremacists-alt-left-transcript-241662\" target=\"_blank\" rel=\"noopener\">\u201cblame on both sides.\u201d<\/a> Last week, Chief of Staff John Kelly stated that \u201cthe lack of an ability to compromise\u201d led to the Civil War \u2013 a comment that was quickly criticized by <a href=\"https:\/\/www.nytimes.com\/2017\/10\/31\/arts\/a-refusal-to-compromise-civil-war-historians-beg-to-differ.html\" target=\"_blank\" rel=\"noopener\">historians<\/a> and <a href=\"https:\/\/globalnews.ca\/news\/3834102\/john-kelly-lack-of-compromise-civil-war\/\" target=\"_blank\" rel=\"noopener\">twitter-users<\/a> alike.<\/p>\n<p>As expected, LGBT rights have also come under attack. In August, the administration <a href=\"http:\/\/time.com\/4916871\/donald-trump-transgender-military-ban\/\" target=\"_blank\" rel=\"noopener\">put out a memo<\/a> banning transgender Americans from serving openly in the military. This followed a <a href=\"http:\/\/time.com\/4916871\/donald-trump-transgender-military-ban\/\" target=\"_blank\" rel=\"noopener\">less formal series of tweets<\/a> by Trump in late July, which introduced the ban and cited \u201cthe tremendous medical costs and disruption\u201d that transgender service members would entail (experts say it would actually be <a href=\"https:\/\/www.nbcnews.com\/feature\/nbc-out\/banning-transgender-troops-could-cost-us-960-million-report-says-n792466\" target=\"_blank\" rel=\"noopener\">much more expensive<\/a> to ban transgender troops than to allow them to continue serving). In October, Trump also spoke at the <a href=\"https:\/\/www.huffingtonpost.com\/entry\/donald-trump-values-voter-summit_us_59e0b596e4b03a7be57fe666\" target=\"_blank\" rel=\"noopener\">anti-LGBT Values Voters Summit<\/a>, and he joked that Vice President Pence <a href=\"https:\/\/www.washingtonpost.com\/news\/the-fix\/wp\/2017\/10\/17\/trumps-joke-about-mike-pence-affirms-the-long-held-concerns-of-many-in-the-lgbt-community\/?utm_term=.7e3a8a96fe08\" target=\"_blank\" rel=\"noopener\">\u201cwants to hang\u201d<\/a> all gay people.<\/p>\n<p>Reproductive rights have been targeted by the Trump administration, as well. From <a href=\"https:\/\/www.nytimes.com\/2017\/07\/14\/opinion\/donald-trump-women-reproductive-rights.html\" target=\"_blank\" rel=\"noopener\">dramatically expanding<\/a> the global gag rule to backing <a href=\"http:\/\/abcnews.go.com\/Politics\/senate-health-care-bill-affect-women\/story?id=48246482\" target=\"_blank\" rel=\"noopener\">harmful health care reform<\/a> bills to <a href=\"https:\/\/www.plannedparenthoodaction.org\/blog\/trumps-signs-bill-to-strip-health-care-protections-for-4-million-title-x-family-planning-patients\" target=\"_blank\" rel=\"noopener\">undermining Title X<\/a> protections, the administration has earned <a href=\"http:\/\/www.dailymail.co.uk\/tvshowbiz\/article-4845898\/Elizabeth-Moss-compare-Handmaid-s-Tale-Donald-Trump.html\" target=\"_blank\" rel=\"noopener\">frequent comparisons<\/a> to the dystopian world of The Handmaid\u2019s Tale. During the month of October, the Department of Justice fought to prevent an undocumented, unaccompanied minor from <a href=\"https:\/\/www.vox.com\/policy-and-politics\/2017\/11\/3\/16602662\/jane-doe-trump-administration-jeff-sessions-abortion\" target=\"_blank\" rel=\"noopener\">obtaining an abortion<\/a>; when they ultimately failed, they asked the Supreme Court to discipline her lawyers.<\/p>\n<p>After \u201cjoking\u201d that climate change is a <a href=\"http:\/\/www.politifact.com\/truth-o-meter\/statements\/2016\/jun\/03\/hillary-clinton\/yes-donald-trump-did-call-climate-change-chinese-h\/\" target=\"_blank\" rel=\"noopener\">Chinese hoax<\/a>, it wasn\u2019t surprising to see Trump nominate <a href=\"http:\/\/www.cosmopolitan.com\/politics\/a8542472\/scott-pruitt-donald-trump-environmental-protection-agency\/\" target=\"_blank\" rel=\"noopener\">Scott Pruitt<\/a>, a climate change skeptic and self-described \u201cleading advocate against the EPA\u2019s activist agenda,\u201d to head the Environmental Protection Agency. A particularly destructive hurricane season was <a href=\"http:\/\/www.nola.com\/hurricane\/index.ssf\/2017\/09\/why_has_the_2017_hurricane_sea.html\" target=\"_blank\" rel=\"noopener\">likely worsened<\/a> in part by climate change, and Trump failed to respond appropriately \u2013 particularly in Puerto Rico, where he <a href=\"https:\/\/www.nytimes.com\/2017\/09\/30\/us\/politics\/trump-puerto-rico-mayor.html?_r=0\" target=\"_blank\" rel=\"noopener\">feuded with a local mayor<\/a> and <a href=\"https:\/\/www.nytimes.com\/2017\/10\/12\/us\/politics\/trump-warns-puerto-rico-weeks-after-storms-federal-help-cannot-stay-forever.html\" target=\"_blank\" rel=\"noopener\">impatiently told<\/a> Americans on the island that federal aid would not stay \u201cforever.\u201d On a more positive note, however, the administration released a <a href=\"https:\/\/science2017.globalchange.gov\/\" target=\"_blank\" rel=\"noopener\">report<\/a> last Friday affirming that climate change is an urgent problem caused almost entirely by human action; it is not yet clear whether this report will prompt tangible policy changes.<\/p>\n<p>In April, Justice Neil Gorsuch was confirmed to fill Antonin Scalia\u2019s seat on the Supreme Court \u2013 a seat that remained vacant for over a year. At only 50 years old, Gorsuch will likely shape the Court for decades to come, and \u2013 to the <a href=\"https:\/\/www.newyorker.com\/news\/daily-comment\/how-badly-is-neil-gorsuch-annoying-the-other-supreme-court-justices\" target=\"_blank\" rel=\"noopener\">possible annoyance<\/a> of his new colleagues \u2013 he wasted no time <a href=\"http:\/\/time.com\/4961416\/neil-gorsuch-supreme-court-term-controversy\/\" target=\"_blank\" rel=\"noopener\">voicing his thoughts<\/a> from the bench. He also received criticism for speeches with Mitch McConnel in Kentucky and at Trump International Hotel, <a href=\"https:\/\/www.washingtonpost.com\/politics\/courts_law\/gorsuchs-speeches-raise-questions-of-independence-critics-say\/2017\/09\/27\/5accdb3c-a230-11e7-b14f-f41773cd5a14_story.html?utm_term=.c5c78da3072c\" target=\"_blank\" rel=\"noopener\">seen as favors<\/a> done for those who played a major role in getting him the job.<\/p>\n<p>Meanwhile, the Democratic Party has yet to effectively regroup and rally behind a clear message or leader. Last week, Donna Brazile gave flames to the idea that the Democratic primary was somehow <a href=\"https:\/\/www.washingtonpost.com\/news\/monkey-cage\/wp\/2017\/11\/04\/no-the-dnc-didnt-rig-the-democratic-primary-for-hillary-clinton\/?utm_term=.6defa1a50653\" target=\"_blank\" rel=\"noopener\">\u201crigged,\u201d<\/a> and it was revealed that the DNC and the Clinton campaign helped fund the research that led to the <a href=\"https:\/\/www.washingtonpost.com\/world\/national-security\/clinton-campaign-dnc-paid-for-research-that-led-to-russia-dossier\/2017\/10\/24\/226fabf0-b8e4-11e7-a908-a3470754bbb9_story.html?utm_term=.dc22a3239f95\" target=\"_blank\" rel=\"noopener\">dossier<\/a> alleging connections and coordination between Russia and the Trump campaign. There are still stark divisions within the party, and it has a long way to go if Democrats want to take back Congress next year.<\/p>\n<p>This is only a small sampling of the past year\u2019s strife. However, there have been reasons to remain optimistic throughout. The Women\u2019s Marches, held across the country in the days following the inauguration, were attended by millions and sent a strong message of unity and empowerment. The <a href=\"http:\/\/www.cnn.com\/2017\/10\/27\/politics\/first-charges-mueller-investigation\/index.html\" target=\"_blank\" rel=\"noopener\">first charges<\/a> have been filed in special counsel Robert Mueller\u2019s investigation into Russian interference in the 2016 election. While the President himself has not been held accountable for his <a href=\"https:\/\/www.newyorker.com\/news\/news-desk\/listening-to-what-trumps-accusers-have-told-us\" target=\"_blank\" rel=\"noopener\">history of sexual assault and harassment<\/a>, other prominent figures \u2013 including Harvey Weinstein and Kevin Spacey \u2013 were forced to face consequences for their actions, showing that perhaps we are ready to believe victims of sexual violence.<\/p>\n<p>There is still a lot of work to do. However, as I said last year, I still believe we are stronger together. Forces of chaos \u2013 whether they come from Russia or the White House \u2013 seek to divide us. Over the course of the past year, it feels like they\u2019ve been winning more often than not. But it isn\u2019t too late for us to look back upon the common threads of humanity that unite us.<\/p>\n<p>As someone from the Midwest and the Deep South who has since moved to the East Coast to join the \u201ccoastal elites,\u201d I\u2019ve spent a lot of time around people on polar opposite ends of the political spectrum. They\u2019ve got a lot more in common than either would be willing to admit. Moving forward, it is vital for us to focus on those commonalities. Proceed with compassion and empathy, and ask your neighbors to do the same.
