{"id":1136,"date":"2011-01-19T20:41:47","date_gmt":"2011-01-20T01:41:47","guid":{"rendered":"http:\/\/journals.law.harvard.edu\/crcl\/?p=1136"},"modified":"2016-11-17T08:24:28","modified_gmt":"2016-11-17T13:24:28","slug":"iowa-house-tries-to-invalidate-iowa-same-sex-marriages","status":"publish","type":"post","link":"https:\/\/journals.law.harvard.edu\/crcl\/iowa-house-tries-to-invalidate-iowa-same-sex-marriages\/","title":{"rendered":"Iowa House Tries to Invalidate Iowa Same-Sex Marriages"},"content":{"rendered":"<p>After three Iowa State Supreme Court justices were removed from office last November (which was due in large part to a <a href=\"http:\/\/www.nytimes.com\/2010\/11\/04\/us\/politics\/04judges.html?_r=2&amp;hpw\" target=\"_blank\">statewide ouster campaign run by the National Organization for Marriage<\/a>) Iowa Republicans are taking yet another step to repeal same-sex marriage rights.<\/p>\n<p>Fifty-six of the GOP&#8217;s 60-member majority have signed on as co-sponsors to a bill that would not only ban same-sex marriage, but would also ban civil unions, domestic partnerships and any other legal recognition of same-sex couples.<\/p>\n<p>Fifty-six of the GOP\u2019s 60-member majority signed on as co-sponsors to House Joint Resolution 6. Four Republican lawmakers \u2014 Peter Cownie, Steven Lukan, Scott Raecker and David Tjepkes \u2014 and all 40 Democrats refused to sign on as co-sponsors. The legislation goes beyond just banning same-sex marriage. It would also ban civil unions, domestic partnerships and any other legal recognition of same-sex couples.<\/p>\n<p><a href=\"https:\/\/journals.law.harvard.edu\/crcl\/wp-content\/uploads\/sites\/80\/2011\/01\/Iowa-Equality.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-full wp-image-1137\" src=\"https:\/\/journals.law.harvard.edu\/crcl\/wp-content\/uploads\/sites\/80\/2011\/01\/Iowa-Equality.jpg\" alt=\"\" width=\"300\" height=\"219\" \/><\/a><\/p>\n<p>There have been numerous previous attempts by the Iowa legislature to invalidate the 2009 Varnum v. Brien decision &#8212; gay marriage opponents came closest to repeal in 2004 when a bill cleared\u00a0the Iowa House but fell one vote shy of passage in the Senate, with four Republicans joining all 21 Democrats to kill the measure .<\/p>\n<p>Democrats hold a 26-24 advantage in the Iowa Senate and Majority Leader Mike Gronstal\u00a0<a href=\"http:\/\/www.desmoinesregister.com\/article\/20101104\/NEWS09\/11040352\/1007\/NEWS05\/Democratic-leader-in-Iowa-Senate-vows-he-ll-block-vote-on-gay-marriage\" target=\"_self\">has vowed to block any vote on an amendment to the state&#8217;s constitution that would ban same-sex marriage<\/a>.<\/p>\n<p>You can read the full story <a
