Pitfalls of Wiretaps in White-Collar Crime Cases"},"content":{"rendered":"<p>As the government shifts its focus in the wake of the financial crisis from corporations to individuals, it brings with it a new investigatory tool previously reserved for organized crime and narcotics prosecutions: wiretaps.<\/p>\n<p>Though insider trading is not a specified offense authorized by Title III, the government argues it can \u201cincidentally happen upon\u201d insider trading while investigating another lawfully specified offense.\u00a0\u00a0So far, the only time the government has used wiretaps for insider trading is in the Galleon Group litigation, where the legality of the wiretaps is still pending.\u00a0\u00a0The government, however, has been very vocal that it will continue to employ wiretaps in this area.\u00a0\u00a0<a href=\"http:\/\/dealbook.nytimes.com\/2011\/03\/25\/the-pitfalls-of-wiretaps-in-white-collar-crime-cases\/\">This article<\/a> addresses some of the consequent privacy concerns that resulted from the government using wiretaps against individuals in insider trading.\u00a0\u00a0The severity of the government\u2019s missteps, and clear violation of defendants\u2019 privacy rights, will hopefully urge increased judicial oversight, and a Congressional response deciding whether the government\u2019s \u201cnew tool\u201d is appropriate in this context.\u00a0Until then, it seems ominous that while the judiciary was harsh in its verbal sanctioning, it has allowed the government to proceed despite clear \u201creckless disregard for the truth\u201d and flagrant violations of individual privacy rights.<\/p>\n<p>Read the full article <a
