Hobby Lobby Stores, Inc.<\/i>, we are excited to release an early online-only version of <a href=\"https:\/\/journals.law.harvard.edu\/crcl\/wp-content\/uploads\/sites\/80\/2011\/09\/Gedicks-FINAL-website-edits-3-25-2014.pdf\"><i>RFRA Exemptions from the Contraception Mandate: An Unconstitutional Accommodation of Religion<\/i><\/a>, by Frederick Mark Gedicks and Rebecca G. Van Tassell.\u00a0 In <i><a href=\"http:\/\/www.scotusblog.com\/case-files\/cases\/sebelius-v-hobby-lobby-stores-inc\/?wpmp_switcher=desktop\">Hobby Lobby<\/a><\/i>, the Court will be entertaining arguments about whether the Religious Freedom Restoration Act allows a for-profit corporation with religious objections to deny its employees health coverage for contraceptives that they would otherwise be entitled to through the Affordable Care Act.\u00a0 Here, Gedicks and Van Tassell introduce the Establishment Clause as a limitation on RFRA, as the clause <a href=\"http:\/\/www.washingtonpost.com\/opinions\/exemptions-from-the-contraception-mandate-threaten-religious-liberty\/2014\/01\/15\/f5cb9bd0-7d79-11e3-93c1-0e888170b723_story.html\">prohibits shifting the cost of religious observance to third parties<\/a>.\u00a0 Even though the government has <a href=\"http:\/\/balkin.blogspot.com\/2013\/12\/hobby-lobby-and-establishment-clause.html\">not raised this issue in briefs<\/a>, this <a href=\"http:\/\/balkin.blogspot.com\/2013\/11\/the-establishment-clause-and.html\">important article<\/a> highlights the key role that the Establishment Clause should play in resolving Hobby Lobby\u2019s claims.<\/p>\n<p>Read the article <a href=\"https:\/\/journals.law.harvard.edu\/crcl\/wp-content\/uploads\/sites\/80\/2011\/09\/Gedicks-FINAL-website-edits-3-25-2014.pdf\">here<\/a>!<\/p>\n","protected":false},"excerpt":{"rendered":"<p>In light of the Supreme Court hearing oral argument today in Sebelius v.
