{"id":8984,"date":"2015-11-02T11:30:28","date_gmt":"2015-11-02T16:30:28","guid":{"rendered":"http:\/\/journals.law.harvard.edu\/crcl\/?p=8984"},"modified":"2015-11-02T17:43:02","modified_gmt":"2015-11-02T22:43:02","slug":"weekly-news-roundup-112","status":"publish","type":"post","link":"https:\/\/journals.law.harvard.edu\/crcl\/weekly-news-roundup-112\/","title":{"rendered":"Weekly News Roundup: 11\/2"},"content":{"rendered":"<p><img loading=\"lazy\" decoding=\"async\" class=\"alignnone\" src=\"http:\/\/www.slate.com\/content\/dam\/slate\/articles\/news_and_politics\/politics\/2015\/10\/151027_POL_Spring-Valley-Arrest.jpg.CROP.promo-xlarge2.jpg\" alt=\"\" width=\"445\" height=\"318\" \/><\/p>\n<p><strong>Developments at Spring Valley High School<\/strong><\/p>\n<p>A federal civil rights <a href=\"http:\/\/www.cbsnews.com\/news\/department-of-justice-civil-rights-probe-violent-south-carolina-classroom-arrest\/\" target=\"_blank\">investigation<\/a> has been <a href=\"http:\/\/www.wltx.com\/story\/news\/local\/2015\/10\/26\/spring-valley-high-school-incident\/74645568\/\" target=\"_blank\">opened<\/a> by the Department of Justice following <a href=\"http:\/\/www.wltx.com\/videos\/news\/local\/2015\/10\/26\/new-video-of-incident-at-spring-valley\/74663780\/\" target=\"_blank\">the violent arrest of a student<\/a>\u00a0caught on video at Spring Valley High School in Columbia, South Carolina.<\/p>\n<p>Deputy Ben Fields, the officer seen violently pulling the student from her desk in the video, <a href=\"http:\/\/www.nbcnews.com\/news\/us-news\/sheriff-announce-south-carolina-deputy-ben-fields-be-fired-sources-n452881\" target=\"_blank\">has been fired<\/a>. A Spring Valley High School administrator <a href=\"http:\/\/www.thestate.com\/news\/local\/article42069354.html\" target=\"_blank\">has been placed on paid administrative leave<\/a>. Up to 100 students staged a protest <a href=\"http:\/\/www.msnbc.com\/msnbc\/south-carolina-students-protest-support-officer-ben-fields\" target=\"_blank\">in support of the officer<\/a>.<\/p>\n<p>The incident has <a href=\"http:\/\/www.usatoday.com\/story\/news\/2015\/10\/28\/school-resource-officer-civil-rights\/74751574\/\" target=\"_blank\">reopened<\/a>\u00a0the <a href=\"http:\/\/www.npr.org\/2015\/10\/27\/452316254\/s-c-high-school-arrest-tape-reignites-debate-over-police-brutality\" target=\"_blank\">debate<\/a> about police in <a href=\"http:\/\/www.postandcourier.com\/article\/20151031\/PC16\/151039941\" target=\"_blank\">schools<\/a>. <a href=\"http:\/\/www.vox.com\/2015\/10\/31\/9646504\/discipline-race-charts\" target=\"_blank\">Here<\/a> is a series of visuals about race disparity in school discipline, and <a href=\"http:\/\/www.newyorker.com\/news\/amy-davidson\/what-niya-kenny-saw\" target=\"_blank\">here<\/a> is some commentary. Also check out\u00a0<a href=\"http:\/\/www.nytimes.com\/2015\/10\/25\/us\/racial-disparity-traffic-stops-driving-black.html?_r=0\" target=\"_blank\">this<\/a>\u00a0and\u00a0<a href=\"http:\/\/www.citylab.com\/work\/2015\/10\/these-jim-crow-era-guides-for-black-travelers-are-sadly-still-relevant\/413311\/\" target=\"_blank\">this<\/a>.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>CISA Clears the Senate<\/strong><\/p>\n<p>A <a href=\"http:\/\/www.theguardian.com\/world\/2015\/oct\/27\/cisa-cybersecurity-bill-senate-vote\" target=\"_blank\">controversial cyber security bill<\/a> passed the senate last week, <a href=\"http:\/\/www.nytimes.com\/2015\/10\/28\/us\/politics\/senate-approves-cybersecurity-bill-despite-flaws.html\" target=\"_blank\">despite criticism<\/a>\u00a0from <a href=\"https:\/\/www.elon.edu\/e-net\/Article\/122816?cmsapifragment=1283\" target=\"_blank\">academia<\/a> and <a href=\"http:\/\/www.pbs.org\/newshour\/bb\/tech-companies-oppose-senates-cybersecurity-bill\/\" target=\"_blank\">Silicon Valley<\/a>\u00a0alike.<\/p>\n<p>The bill has been many years in the making, and would encourage the sharing of data by private companies. CISA shields companies from liability after sharing some consumer data with the government. <a href=\"http:\/\/www.forbes.com\/sites\/abigailtracy\/2015\/10\/29\/the-problems-experts-and-privacy-advocates-have-with-the-senates-cybersecurity-bill\/\" target=\"_blank\">Critics<\/a>, however, note that data sharing would not have had any effect in preventing many of the most notorious recent hacks.<\/p>\n<p>The bill most be reconciled in the House of Representatives before being sent to the President.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Speech on Campus, UCLA and Beyond \u00a0<\/strong><\/p>\n<p>A <a href=\"http:\/\/www.latimes.com\/local\/education\/la-me-ln-uc-tolerance-20151026-story.html\" target=\"_blank\">proposed \u201canti bias\u201d policy at UCLA<\/a>, designed to quell anti-Semitic harassment experienced by those on campus supporting Israel, is a <a href=\"http:\/\/abcnews.go.com\/US\/wireStory\/uc-asks-public-input-rewrite-free-speech-policy-34727528\" target=\"_blank\">flashpoint<\/a> for debate about the state of the first amendment on campus.<\/p>\n<p>The controversy stems over the definition of anti-Semitism. Some have suggested the controversial definition used by the <a href=\"http:\/\/www.state.gov\/j\/drl\/rls\/fs\/2010\/122352.htm\" target=\"_blank\">U.S. State Department<\/a>, while others say the definition is <a href=\"https:\/\/www.washingtonpost.com\/news\/morning-mix\/wp\/2015\/10\/27\/speech-code-backers-at-uc-including-its-president-want-tough-criticism-of-israel-labeled-anti-semitism\/\" target=\"_blank\">overly broad<\/a>\u00a0and conflicts with <a href=\"http:\/\/www.latimes.com\/opinion\/opinion-la\/la-ol-colleges-hate-speech-1st-amendment-20151030-story.html\" target=\"_blank\">freedom of speech and expression<\/a>.<\/p>\n<p>For a bit of background on what is leading to the controversy, look <a href=\"http:\/\/www.cnn.com\/2015\/03\/10\/opinions\/kosmin-anti-semitism-campus\/\" target=\"_blank\">here<\/a> and <a href=\"http:\/\/www.theatlantic.com\/education\/archive\/2015\/03\/uclas-troubling-question-for-jewish-students-everywhere\/387091\/\" target=\"_blank\">here<\/a>. This isn\u2019t the first instance in which UCLA\u2019s campus policies have gotten <a href=\"http:\/\/www.theatlantic.com\/politics\/archive\/2015\/10\/the-anti-free-speech-movement-at-ucla\/410638\/\" target=\"_blank\">first-amendment scrutiny from the public.<\/a><\/p>\n<p>The controversy is the latest forum of\u00a0the <a href=\"http:\/\/www.latimes.com\/opinion\/editorials\/la-ed-campus-speech-20151028-story.html\" target=\"_blank\">debate<\/a>\u00a0about <a href=\"http:\/\/www.courant.com\/opinion\/op-ed\/hc-op-roth-wesleyan-argus-freedom-of-speech-1023-20151023-story.html\" target=\"_blank\">free speech\u00a0on campus<\/a>. Much of the criticism comes on the heels of\u00a0a <a href=\"https:\/\/www.dropbox.com\/s\/sfmpoeytvqc3cl2\/NATL%20College%2010-25-15%20Presentation.pdf?dl=0\" target=\"_blank\">recent study<\/a>\u00a0about <a href=\"http:\/\/www.theatlantic.com\/magazine\/archive\/2015\/09\/the-coddling-of-the-american-mind\/399356\/\" target=\"_blank\">students and speech<\/a> on <a href=\"http:\/\/www.newyorker.com\/news\/news-desk\/trouble-teaching-rape-law\" target=\"_blank\">campus<\/a>.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Fighting &#8220;Pay or Stay&#8221; Bail Systems<\/strong><\/p>\n<p>\u201cPay or stay\u201d bail fine systems have come under closer scrutiny after the <a href=\"http:\/\/www.buzzfeed.com\/alexcampbell\/aclu-calls-for-investigation-into-pay-or-stay-jail-sentences#.qdj05lrzXb\" target=\"_blank\">death<\/a> of a man who served 30 days because he couldn\u2019t pay $772 in traffic fines. \u201cPay or stay\u201d systems in <a href=\"http:\/\/www.buzzfeed.com\/kendalltaggart\/in-texas-its-a-crime-to-be-poor#.bfzD3JEWyr\" target=\"_blank\">Texas<\/a>\u00a0have been criticized, and in Alabama, a judge gave minor offenders the choice of <a href=\"http:\/\/www.nytimes.com\/2015\/10\/20\/us\/for-offenders-who-cant-pay-its-a-pint-of-blood-or-jail-time.html?smid=tw-share\" target=\"_blank\">giving blood or jail time<\/a>.<\/p>\n<p>Civil rights groups are <a href=\"http:\/\/www.truth-out.org\/news\/item\/33378-how-civil-rights-groups-are-unraveling-illegal-bail-schemes-that-fill-jails-with-poor-people\" target=\"_blank\">fighting\u00a0to end<\/a> \u201cpay or stay\u201d schemes.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Civil Rights Abroad<\/strong><\/p>\n<p><a href=\"http:\/\/www.theguardian.com\/education\/2015\/oct\/26\/ucas-name-blind-university-applications-racial-bias\" target=\"_blank\">Name-blind applications<\/a>\u00a0are coming to England, led by conservative Prime Minister David Cameron. This comes at <a href=\"http:\/\/www.theguardian.com\/commentisfree\/2015\/oct\/26\/david-cameron-conservatives-party-of-equality\" target=\"_blank\">Cameron\u2019s urging<\/a>\u00a0that \u201cConservatives have become the party of equality\u201d. The name-blind move will also extend to <a href=\"http:\/\/www.apnewsarchive.com\/2015\/UK-says-big-firms-civil-service-will-adopt-anti-discrimination-name-blind-hiring-policies\/id-975aade7ec2a4ba1af1d2d451c53afe5\" target=\"_blank\">some employers<\/a>. <a href=\"http:\/\/www.huffingtonpost.com\/entry\/black-sounding-names-study_561697a5e4b0dbb8000d687f\" target=\"_blank\">Studies<\/a> have <a href=\"http:\/\/www.nber.org\/papers\/w9873\" target=\"_blank\">shown<\/a>\u00a0that \u201cblack-sounding\u201d names, among others are often unconsciously discriminated against in the hiring and admissions process. See also, <a href=\"http:\/\/www.economist.com\/news\/business\/21677214-anonymising-job-applications-eliminate-discrimination-not-easy-no-names-no-bias\" target=\"_blank\">the Economist&#8217;s take<\/a>.<\/p>\n<p>A racist murder in Sweden has brought the <a href=\"http:\/\/america.aljazeera.com\/opinions\/2015\/10\/racist-murder-generates-swedens-black-lives-matter.html\" target=\"_blank\">Black Lives Matter movement abroad<\/a>, argues Christian Christensen in Al Jazeera America.<\/p>\n<p>In Kiev, officials are considering <a href=\"http:\/\/www.telegraph.co.uk\/sport\/football\/european\/11957561\/Dynamo-Kiev-consider-segregating-black-fans-to-prevent-racism.html\" target=\"_blank\">outright segregation<\/a> in a soccer stadium \u201cto avoid the manifestation of racism.\u201d This follows a <a href=\"http:\/\/www.theguardian.com\/football\/2015\/oct\/27\/uefa-calls-investigation-in-attack-on-black-fans-at-dynamo-kyiv\" target=\"_blank\">racist attack<\/a> at a previous match. Racism in soccer <a href=\"http:\/\/www.nytimes.com\/2015\/11\/03\/sports\/soccer\/russian-soccer-denies-racism-problem-even-as-it-vows-to-solve-it.html\" target=\"_blank\">is pervasive<\/a>.<\/p>\n<p>A French court has <a href=\"http:\/\/www.ibtimes.com\/french-court-recognizes-third-gender-option-landmark-victory-intersex-rights-2144284.\" target=\"_blank\">\u201cofficially recognized a third gender option\u00a0in a\u00a0case that\u2019s being described in the country as a crucial victory for intersex rights.\u201d<\/a> The intersex individual who brought the case may now be legally recognized as \u201cneutral.\u201d This comes at a time when <a href=\"https:\/\/www.washingtonpost.com\/news\/federal-eye\/wp\/2015\/10\/27\/intersex-applicants-face-passport-discrimination-says-lawsuit-seeking-option-other-than-m-or-f\/\"
