In addition, international human rights bodies have reasoned that States\u2019 can be held responsible for failing to undertake adequate measures to fulfill or ensure peoples\u2019 human rights in the face of the foreseeable adverse impacts of climate change. In a recent decision the UN Human Rights Committee determined that Australia had violated the rights of indigenous Torres Strait Islanders under the International Covenant on Civil and Political Rights (\u201cICCPR\u201d) by failing to undertake timely and adequate adaptive measures to protect the islands they inhabit and surrounding marine resources from climate changed-linked degradation and hazards.<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"6\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-6\">6<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-6\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"6\">See generally Daniel Billy and others v. This essay focuses on the American Convention because most Latin American States have ratified the treaty, and, in contrast to the ICCPR regime, there is a judicial body\u2014the Inter-American Court of Human Rights (\u201cInter-American Court\u201d)\u2014competent to issue legally binding judgments regarding the interpretation and application of the treaty. Organization of American States, American Declaration on the Rights of Indigenous Peoples, AG\/RES.2888 (XLVI-O\/16) (Jun. 15, 2016).<\/span><\/span><span data-contrast=\"auto\">\u00a0Although ADRIP is not a legally binding instrument, its provisions reflect emerging norms on indigenous peoples\u2019 rights in the Americas and may inform the content of rights prescribed in the American Convention.<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"13\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-13\">13<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-13\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"13\">Mayagna (Sumo) Awas Tingni Community v. The Inter-American Court is charged with applying and interpreting the American Convention and may adjudicate both contentious cases and advisory cases.\u00a0 <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:720,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The Inter-American Commission on Human Rights is another principal organ of the IAHR System. Indigenous Peoples \u00a0<\/strong><\/p>\n<p><span data-contrast=\"auto\">Some OAS member States have adopted formal definitions of \u201cindigenous peoples\u201d in national legislation pertaining to indigenous peoples\u2019 rights.<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"15\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-15\">15<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-15\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"15\">See Inter-American Comm\u2019n on Hum. Indigenous Peoples\u2019 Lands and Territories \u00a0<\/strong><\/p>\n<p><span data-contrast=\"auto\">Among indigenous peoples in Latin America there is a communitarian tradition regarding property interests in land and natural resources.<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"18\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-18\">18<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-18\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"18\">Mayagna, supra note 13, \u00b6 149 (\u201cownership of the land is not centered on an individual but rather on the group and its community\u201d).<\/span><\/span><span data-contrast=\"auto\">\u00a0Ownership of natural resources and land is centered on the community or peoples rather than individuals. The Established Scope of Indigenous Peoples\u2019 Property Rights under the American Convention<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Under Article 21 of the American Convention, indigenous peoples have a communal (or collective) right to property. C) No. 309, \u00b6 139 (Nov. 25, 2015) (\u201c[T]here may be other complementary or additional traditional areas to which [indigenous peoples] have had access for their traditional or subsistence activities (which may have other purposes), regarding which they should be ensured, at least, the necessary access and use.\u201d).<\/span><\/span><span data-contrast=\"auto\">\u00a0In <\/span><i><span data-contrast=\"auto\">Saramaka People v. Suriname<\/span><\/i><span data-contrast=\"auto\"> (\u201c<\/span><i><span data-contrast=\"auto\">Saramaka<\/span><\/i><span data-contrast=\"auto\">\u201d), the Court explained that \u201cmembers of . . . indigenous communities have the right to own the natural resources they have traditionally used within the[ir] territory . . . [because] [w]ithout them, the very physical and cultural survival of such peoples is at stake,\u201d and . . . This provision \u201cobliges States Parties to adopt, in accordance with their constitutional processes and the provisions of [the American Convention], such legislative or other measures as may be necessary to give effect to the rights or freedoms protected therein.\u201d<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"34\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-34\">34<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-34\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"34\">American Convention, 1144 U.N.T.S. 123 , art. 2; see also Advisory Opinion OC-23\/17, supra note 32, \u00b6\u00b6 146\u201347 (\u201cGiven the relationship between protection of the environment and human rights . . . , all States must regulate this matter and take other similar measures to prevent significant damage to the environment.\u201d). <\/span><\/span><span data-contrast=\"auto\">\u00a0This obligation \u201cis not limited to the constitutional or legislative text, but must extend to all legal provisions of a regulatory nature and result in effective practical implementation.\u201d<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"35\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-35\">35<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-35\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"35\">Advisory Opinion OC-23\/17, supra note 32, \u00b6 146. <\/span><\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:720,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Read in conjunction with Articles 1(1) and 2 of the American Convention, Article 21 obligates State Parties to affirmatively adopt measures to protect and ensure the right to property for all rights bearers. Grounding a Duty to Undertake Climate Adaptive Measures Under Article 21 <\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The American Convention does not include express language on climate change or the environment, and the Inter-American Court has yet to directly consider whether State Parties have a duty under Articles 1(1), 2 and 21, read together, to undertake adaptive measures to protect indigenous peoples\u2019 ancestral lands from the foreseeable adverse impacts of climate change.<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"40\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-40\">40<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-40\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"40\">However, the Inter-American Commission adopted a non-legally binding resolution in 2021 expressing that \u201cStates must adopt measures to ensure that the climate crisis does not affect or jeopardize the effective protection of the human rights of indigenous peoples . . . such as communal property . . . .\u201d Inter-Am. Comm\u2019n on Hum. Rts., Res. No. 3\/2021, Climate Emergency: Scope of Inter-American Human Rights Obligations, at C(IV.), \u00b6 23 (Dec. 31, 2021).<\/span><\/span><span data-contrast=\"auto\">\u00a0This Section asserts that these treaty provisions obligate States Parties to undertake adaptive measures. Interpreting the American Convention in this manner furthers the object and purpose of the treaty and best reflects recent international human rights law and international environmental law developments.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:360,&quot;335559740&quot;:480}\">\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:276}\">\u00a0<\/span><\/p>\n<p style=\"padding-left: 40px\"><strong>A. Climate Adaptive Measures and the Object and Purpose of the American Convention \u00a0<\/strong><\/p>\n<p><span data-contrast=\"auto\">The Inter-American Court has established that \u201cthe object and purpose of [the American Convention] is the protection of the fundamental rights of the human being\u201d,<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"41\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-41\">41<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-41\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"41\">Advisory Opinion OC-23\/17, supra note 32, \u00b6 41 (internal quotation marks omitted).<\/span><\/span><span data-contrast=\"auto\">\u00a0and that its \u201cprovisions must . . . be interpreted using a model based on the values that the inter-American system seeks to safeguard, from the \u2018best perspective\u2019 for the protection of the individual\u201d<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"42\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-42\">42<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-42\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"42\">Id.<\/span><\/span><span data-contrast=\"auto\">\u00a0and peoples. The court also considers that the American Convention is a \u201clive \u00a0instrument[] whose interpretation must adapt to the evolution of the times and, specifically, to current living conditions.\u201d<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"43\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-43\">43<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-43\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"43\">Mayagna, supra note 13, \u00b6 146.<\/span><\/span><span data-contrast=\"auto\">\u00a0Accordingly, the American Convention should not be interpreted to have no practical effect or application in the face of foreseeable climate change-driven degradation of indigenous peoples\u2019 lands and resources. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:720,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Because their relationship with their lands is \u201cthe fundamental basis of their culture, spiritual life, integrity, and economic survival,\u201d indigenous communities are disproportionately vulnerable to environmental changes.<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"44\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-44\">44<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-44\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"44\">See Moiwana, supra note 19, \u00b6 131; Yakye Axa, supra note 11, \u00b6 131. <\/span><\/span><span data-contrast=\"auto\">\u00a0The Inter-American Commission has explained that the degradation of indigenous communities\u2019 lands \u201cinvariably leads to serious loss of life and health and damage to the cultural integrity of indigenous peoples.\u201d<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"45\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-45\">45<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-45\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"45\">Report on the Situation of Human Rights in Ecuador, supra note 32, ch. IX.<\/span><\/span>\u00a0<span data-contrast=\"auto\">Moreover, in a recent advisory opinion on the environment and human rights, the Inter-American Court emphasized:<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"46\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-46\">46<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-46\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"46\">Advisory Opinion OC-23\/17, supra note 3, \u00b6 48 (referencing Kichwa Indigenous People of Sarayaku v. Increasing global average temperatures \u201cwill have major, and predominantly negative, effects on ecosystems across the globe [and] on the goods and services they provide. Already today, climate change is among the most important drivers of ecosystem change.\u201d<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"49\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-49\">49<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-49\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"49\">Office of the United Nations High Commissioner for Human Rights, Report on the Relationship Between Climate Change and Human Rights, \u00b6 16, U.N. No. 3\/2021, supra note 40 at 9. <\/span><\/span><span data-contrast=\"auto\">\u00a0Therefore, interpreting the special measures prescribed under Articles 1(1), 2, and 21 of the American Convention, read together, to require climate adaptive measures to protect and ensure indigenous communities\u2019 use and enjoyment of their territories and resources best furthers the American Convention\u2019s object and purpose of protecting the fundamental rights of individuals and peoples. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:720,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p style=\"padding-left: 40px\"><strong>B. Climate Adaptive Measures and International Human Rights Law Developments\u00a0<\/strong><\/p>\n<p><span data-contrast=\"auto\">Consistent with Articles 31 and 32 of the Vienna Convention on the Law of Treaties, the Inter-American Court considers other international human rights treaties and broader developments in international human rights law when interpreting the American Convention.<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"54\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-54\">54<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-54\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"54\">See Yakye Axa, supra note 11, \u00b6 127. <\/span><\/span><span data-contrast=\"auto\">\u00a0In this instance, legal opinions and statements of human rights treaty bodies, the UN Declaration on the Rights of Indigenous Peoples (\u201cUNDRIP\u201d), ADRIP, and International Labour Organization (\u201cILO\u201d) Convention 169 support that States Parties must undertake adaptive measures to address the foreseeable adverse effects of climate change on indigenous peoples\u2019 lands and resources under Articles 1(1), 2, and 21 of the American Convention, read together.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:720,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p><i><span data-contrast=\"auto\">The UN Human Rights Committee\u2019s Torres Strait Islanders Decision<\/span><\/i><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">This year, as noted above, the <\/span><span data-contrast=\"none\">UN <\/span><span data-contrast=\"none\">Human Rights Committee determined that, under the ICCPR, Australia had violated the right to privacy, family and home and the right to culture of indigenous individuals inhabiting the Torres Strait Islands by failing to undertake timely and adequate adaptive measures to protect the islands and surrounding marine resources from climate changed-linked environmental degradation and hazards.<\/span><span data-contrast=\"none\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"55\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-55\">55<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-55\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"55\">Daniel Billy and others, supra note 6, \u00b6 10.<\/span><\/span><span data-contrast=\"none\">\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:720,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The committee recognized that ICCPR States Parties have an affirmative duty to implement climate adaptive measures to protect indigenous peoples\u2019 lands and resources that stems from Article 2(1) of the ICCPR,<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"56\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-56\">56<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-56\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"56\">Id. \u00b6\u00b6 7.7, 8.3.<\/span><\/span><span data-contrast=\"auto\">\u00a0which has very similar language to Article 1(1) of the American Convention. Article 2(1) of the ICCPR requires that ICCPR States parties \u201cundertake[] to . . . ensure . . . the rights recognized in the . . . Covenant,\u201d while Article1(1) of the American Convention requires American Convention States Parties to \u201cundertake . . . to ensure . . . the free and full exercise of [the] rights and freedoms [therein].\u201d <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:720,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">In addition, in finding that Australia violated the indigenous Torres Strait Islander\u2019s right to culture under the ICCPR, the committee recognized that: the right to culture \u201censhrines the inalienable right of indigenous peoples to enjoy the territories and natural resources that they have traditionally used for their subsistence and cultural identity\u201d<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"57\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-57\">57<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-57\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"57\">Id. \u00b6 8.13.<\/span><\/span><span data-contrast=\"auto\">;<\/span><span data-contrast=\"auto\"> and that the reduced viability of indigenous lands and resources for traditional cultural activities and ways of life owing to a State\u2019s failure to undertake adequate and timely adaptive measures to address foreseeable climate change impacts<\/span><span data-contrast=\"auto\"> may violate the right to culture.<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"58\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-58\">58<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-58\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"58\">Id. \u00b6 8.14.<\/span><\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:720,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">The Human Rights Committee\u2019s reasoning regarding States\u2019 duties to ensure the right to culture under the ICCPR is highly persuasive when interpreting States duties to ensure the right to property under Article 21 of the American Convention because the Inter-American Court has \u201cexplicitly linked cultural identity to Article 21.\u201d<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"59\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-59\">59<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-59\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"59\">Antkowiak, supra note 8, at 150.<\/span><\/span><span data-contrast=\"auto\">\u00a0In <\/span><i><span data-contrast=\"auto\">X\u00e1kmok K\u00e1sek Indigenous Community v. States shall establish and implement assistance programmes for indigenous peoples for such conservation and protection, without discrimination.\u201d); ILO Convention 169, art. 7(4) (\u201cGovernments shall take measures, in co-operation with the peoples concerned, to protect and preserve the environment of the territories they inhabit.\u201d); UNDRIP, art. 29. <\/span><\/span><span data-contrast=\"auto\">\u00a0Thus, these instruments reinforce the need for States to undertake measures to combat climate change-linked environmental degradation under international law.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559731&quot;:720,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p style=\"padding-left: 40px\"><strong>\u00a0C. Climate Adaptive Measures and International Environmental Law Developments\u00a0<\/strong><\/p>\n<p><span data-contrast=\"auto\">The Inter-American Court has reasoned that, as a \u201cconsequence of the interdependence and indivisibility of human rights and environmental protection . . . the Court may avail itself of the principles, rights and obligations of international environmental law\u201d when establishing the scope of the obligations under the American Convention.<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"72\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-72\">72<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-72\" role=\"tooltip\" data-contrast=\"auto\">The Paris Agreement characterizes climate change as an \u201curgent threat\u201d that requires an \u201ceffective\u201d response, and includes an objective of \u201c[i]ncreasing the ability to adapt to the adverse impacts of climate change and foster[ing] climate resilience.\u201d<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"73\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-73\">73<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-73\" role=\"tooltip\" component of and makes a contribution to the long-term global response to climate change to protect people, livelihoods and ecosystems . . . .<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"74\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\" It is implicit in these treaties recognition that climate change may threaten ecosystems and humankind that climate change may impact the enjoyment of human rights, particularly those closely linked to ecosystem health and the availability of natural resources. In addition, these two treaties underscore that States should effectively respond to climate change, and that any effective response should include climate adaptation, as it is critical for protecting humans and the natural environment upon which they depend for survival.<\/span><span data-contrast=\"auto\"><sup class=\"modern-footnotes-footnote modern-footnotes-footnote--expands-on-desktop \" data-mfn=\"78\" data-mfn-post-scope=\"00000000000006520000000000000000_3149\"><a href=\"javascript:void(0)\"  role=\"button\" aria-pressed=\"false\" aria-describedby=\"mfn-content-00000000000006520000000000000000_3149-78\">78<\/a><\/sup><span id=\"mfn-content-00000000000006520000000000000000_3149-78\" role=\"tooltip\" class=\"modern-footnotes-footnote__note\" tabindex=\"0\" data-mfn=\"78\">See Benoit Mayer, Climate Change Adaptation and the Law, 39 Va. Envt\u2019l L.J., 141, 143, 147\u201348 (2021).<\/span><\/span>\u00a0<span data-contrast=\"auto\">Therefore, when considering States\u2018 obligations under the American Convention in light of text of international treaties on climate change, it is reasonable to conclude that climate adaptative measures are important for ensuring human rights and that climate adaptive measures may be a necessary requirement under certain circumstances to ensure that adverse climate change impacts do not undermine the cultural and physical survival of indigenous communities.\u00a0\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335559740&quot;:480}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Conclusion<\/span><\/b><\/p>\n<p><span data-contrast=\"auto\">Under the American Convention, State Parties have an affirmative duty to undertake adaptive measures to protect indigenous peoples\u2019 ancestral lands and resources from the foreseeable adverse effects of climate change. As demonstrated by the wildfires that ravaged the Guat\u00f3 communities\u2019 territories, the threat of climate change for the indigenous peoples of Latin America is significant and States must respond accordingly. In developing climate adaptive measures in relation to indigenous peoples\u2019 land and resources, State should ensure indigenous peoples\u2019 meaningful participation in decision-making processes in accordance with applicable obligations under international law.\u00a0<\/span><span
