Stallworth<\/em><\/p>\n<p align=\"LEFT\">This article examines what impact, if any, a grievant\u2019s offer of apology has on the decision-making process of labor arbitrations in discipline and discharge cases.<\/p>\n<p>&nbsp;<\/p>\n<p><a title=\"Nolan-Haley\" href=\"https:\/\/journals.law.harvard.edu\/hnlr\/wp-content\/uploads\/sites\/91\/2012\/09\/61-96.pdf\"><strong>Mediation: The \u201cNew Arbitration\u201d<\/strong><\/a><\/p>\n<p><em>Jacqueline Nolan-Haley<\/em><\/p>\n<p>This article explores how and why the process of\u00a0legal mediation has begun to reflect arbitration proceedings, and the implications of this phenomenon.<\/p>\n<p>&nbsp;<\/p>\n<p><a title=\"Robinson\" href=\"https:\/\/journals.law.harvard.edu\/hnlr\/wp-content\/uploads\/sites\/91\/2012\/09\/97-150.pdf\"><strong>An Empirical Study of Settlement Conference Nuts and Bolts: Settlement Judges Facilitating Communication, Compromise and Fear<\/strong><\/a><\/p>\n<p><em>Peter Robinson<\/em><\/p>\n<p>This article examines the emphasis the settlement judge places on costs and risks, the techniques employed by the judge to encourage compromise, the techniques utilized to facilitate communication between all those involved, and finally the effect of the judge\u2019s persona on the settlement conference.<\/p>\n<p>&nbsp;<\/p>\n<p><a title=\"Rabinovich-Einy and Katsh\" href=\"https:\/\/journals.law.harvard.edu\/hnlr\/wp-content\/uploads\/sites\/91\/2012\/09\/151-200.pdf\"><strong>Technology and the Future of Dispute Systems Design<\/strong><\/a><\/p>\n<p><em>Orna Rabinovich-Einy and Ethan Katsh<\/em><\/p>\n<p>This article discusses the separation in the development of Dispute Systems Design (DSD) and the World Wide Web, and argues that the division is holding back the growth of the field of DSD.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><a title=\"Strong\" href=\"https:\/\/journals.law.harvard.edu\/hnlr\/wp-content\/uploads\/sites\/91\/2012\/09\/201-272.pdf\">Does Class Arbitration \u201cChange the Nature\u201d of Arbitration? Stolt-Nielsen, AT&amp;T, and a Return to First Principles<\/a><\/strong><\/p>\n<p><em>S.I. Strong<\/em><\/p>\n<p>The article analyzes the ways in which class arbitration differs from other forms of multiparty arbitration and investigates whether a form of \u201cquasi-arbitration\u201d is in the process of developing as a means of responding to the demands of class proceedings.<\/p>\n<p>&nbsp;<\/p>\n<p><strong><a title=\"Kinon\" href=\"https:\/\/journals.law.harvard.edu\/hnlr\/wp-content\/uploads\/sites\/91\/2012\/09\/273-288.pdf\">Power Before Interests in Dispute System Design<\/a><\/strong><\/p>\n<p><em>Adam B. Kinon<\/em><\/p>\n<p>This paper demonstrates why a designer must begin the Dispute Systems Design process with an analysis of power and how that power dynamic may be shaped to allow an interests-based approach to be implemented.
