{"id":10680,"date":"2025-02-21T14:59:33","date_gmt":"2025-02-21T19:59:33","guid":{"rendered":"https:\/\/journals.law.harvard.edu\/ilj\/?p=10680"},"modified":"2025-02-21T16:01:28","modified_gmt":"2025-02-21T21:01:28","slug":"takings-private-property-world-cultural-heritage","status":"publish","type":"post","link":"https:\/\/journals.law.harvard.edu\/ilj\/2025\/02\/takings-private-property-world-cultural-heritage\/","title":{"rendered":"Takings, Private Property &amp; World Cultural Heritage"},"content":{"rendered":"<p><em>Editor\u2019s Note: This article is part of a collaboration between the Harvard Art Law Organization and the Harvard International Law Journal<\/em>.<\/p>\n<p><strong>*Anne-Marie Carstens<\/strong><\/p>\n<p><span style=\"font-weight: 400\">In early 2025, the <\/span><a href=\"https:\/\/hopewellearthworks.org\/site\/octagon-earthworks\/\"><span style=\"font-weight: 400\">Octagon Earthworks<\/span><\/a><span style=\"font-weight: 400\">, a 2,000-year-old indigenous ceremonial and burial site comprised of earthen geometric structures, opened to the public. The opening came after two parties\u2014the government agency taking possession through eminent domain and the leaseholder that occupied the site\u2014<\/span><a href=\"https:\/\/www.nytimes.com\/2024\/08\/01\/arts\/design\/octagon-earthworks-ohio-golf-course.html\"><span style=\"font-weight: 400\">settled<\/span><\/a><span style=\"font-weight: 400\"> the last issue in their drawn-out legal dispute by agreeing on the just compensation owed for the taking. The site forms a crucial part of a collection comprising the <\/span><a href=\"https:\/\/whc.unesco.org\/en\/list\/1689\/\"><span style=\"font-weight: 400\">Hopewell Ceremonial Earthworks<\/span><\/a><span style=\"font-weight: 400\">, which was nominated by the United States in 2022 and <\/span><a href=\"https:\/\/whc.unesco.org\/en\/decisions\/8428\"><span style=\"font-weight: 400\">selected<\/span><\/a><span style=\"font-weight: 400\"> by the World Heritage Committee for inscription on the international World Heritage List. The list is the core feature of one of the world\u2019s most popular treaties (by participation), the Convention Concerning the Protection of the World Cultural and Natural Heritage (<\/span><a href=\"https:\/\/whc.unesco.org\/en\/conventiontext\/\"><span style=\"font-weight: 400\">World Heritage Convention<\/span><\/a><span style=\"font-weight: 400\">). The treaty celebrates and provides a protective framework for listed sites of \u201coutstanding universal value,\u201d and the <\/span><a href=\"https:\/\/whc.unesco.org\/en\/list\/\"><span style=\"font-weight: 400\">World Heritage List<\/span><\/a><span style=\"font-weight: 400\"> today includes 1223 heritage sites in 168 countries. The Hopewell Ceremonial Earthworks became only the fourteenth cultural or mixed cultural-natural heritage site <\/span><a href=\"https:\/\/whc.unesco.org\/en\/statesparties\/us\"><span style=\"font-weight: 400\">in the United States<\/span><\/a><span style=\"font-weight: 400\"> to make the list.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The litigation\u2019s friction points nonetheless highlight lingering questions at the intersection of the Takings doctrine and international cultural heritage law. First, the case brought into question when holders of private property rights ostensibly must be ousted to satisfy the treaty\u2019s requirements of \u201c<\/span><a href=\"https:\/\/whc.unesco.org\/en\/glossary\/187\"><span style=\"font-weight: 400\">authenticity<\/span><\/a><span style=\"font-weight: 400\">\u201d and \u201c<\/span><a href=\"https:\/\/whc.unesco.org\/en\/glossary\/280\"><span style=\"font-weight: 400\">integrity<\/span><\/a><span style=\"font-weight: 400\">.\u201d Second, the litigation embodied a resurgent, palpable resistance to recognizing public parks and other aesthetic objectives as a valid \u201cpublic use\u201d under the Fifth Amendment\u2019s <\/span><a href=\"https:\/\/constitutioncenter.org\/the-constitution\/amendments\/amendment-v\"><span style=\"font-weight: 400\">Takings Clause<\/span><\/a><span style=\"font-weight: 400\"> and its state corollaries. In doing so, it offered another data point on \u201cpublic use\u201d in the post-<\/span><i><span style=\"font-weight: 400\">Kelo<\/span><\/i><span style=\"font-weight: 400\"> environment.<\/span><\/p>\n<p><b>The Octagon Earthworks Site &amp; the Takings Controversy<\/b><\/p>\n<p><span style=\"font-weight: 400\">According to the <\/span><a href=\"https:\/\/whc.unesco.org\/en\/list\/1689\/documents\/\"><span style=\"font-weight: 400\">nomination file<\/span><\/a><span style=\"font-weight: 400\"> submitted by the United States, the Octagon Earthworks and the larger Hopewell Ceremonial Earthworks complex consist of massive, geometrically shaped mounds constructed by the Hopewell culture that flourished in the Ohio River Valley as a religious movement (rather than a distinct indigenous group) from approximately 1CE to 400CE. The United States observed that the Octagon Earthworks showcase the vanished culture\u2019s profound mathematical skill and astronomical understanding because corners of the octagonal shape \u201cencod[e] all eight lunar standstills over an 18.6-year [lunar] cycle.\u201d When the moon peaks at its northernmost point at the end of each lunar cycle, it \u201c<\/span><a href=\"https:\/\/www.nytimes.com\/2005\/11\/28\/us\/ohio-indian-mounds-hallowed-ground-and-a-nice-par-3.html\"><span style=\"font-weight: 400\">hovers<\/span><\/a><span style=\"font-weight: 400\"> within one-half of a degree of the octagon\u2019s exact center,\u201d making the site \u201ca <\/span><a href=\"https:\/\/www.bbc.com\/travel\/article\/20221204-the-us-2000-year-old-mystery-mounds\"><span style=\"font-weight: 400\">testament<\/span><\/a><span style=\"font-weight: 400\"> to indigenous sophistication.\u201d The mounds were long known to form part of an ancient ceremonial site, but <\/span><a href=\"https:\/\/www.newarkadvocate.com\/story\/opinion\/2020\/03\/20\/newark-earthworks-how-we-found-lunar-alignments-octagon\/5061340002\/\"><span style=\"font-weight: 400\">modern scholars<\/span><\/a><span style=\"font-weight: 400\"> only came to recognize them as a mathematical and cosmological marvel in the 1970s.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Ohio\u2019s state historical organization initiated a condemnation proceeding in 2018 to take full possessory rights through eminent domain. In a twist from the usual takings action, the organization already owned the property in fee simple since 1933. But it did not possess the full idiomatic \u201cbundle of sticks\u201d because it had continuously leased it to the challenging party, the Moundbuilders Country Club. The litigation <\/span><a href=\"https:\/\/www.supremecourt.ohio.gov\/rod\/docs\/pdf\/0\/2022\/2022-Ohio-4345.pdf\"><span style=\"font-weight: 400\">established<\/span><\/a><span style=\"font-weight: 400\"> that the club had operated a golf course on the mounds since 1910, initially pursuant to a lease with the city, the organization\u2019s predecessor-in-interest. In fact, the nomination file acknowledges that the private country club was established for the express purpose of operating a golf course on the site as a cultural preservation measure. The city at the time lacked funds to create a public park to curb encroaching development and considered a golf course a viable alternative. In 1997, the historical organization renewed the club\u2019s lease <\/span><a href=\"https:\/\/www.supremecourt.ohio.gov\/pdf_viewer\/pdf_viewer.aspx?pdf=957627.pdf&amp;subdirectory=2024-0198%5CDocketItems&amp;source=DL_Clerk\"><span style=\"font-weight: 400\">until 2078<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The club first challenged the basis for condemnation of its leasehold. Like most states in the wake of the U.S. Supreme Court decision in <\/span><a href=\"https:\/\/www.oyez.org\/cases\/2004\/04-108\"><i><span style=\"font-weight: 400\">Kelo v. City of New London<\/span><\/i><\/a><span style=\"font-weight: 400\"> (2005), Ohio firmed up takings requirements under its state constitution, both through <\/span><a href=\"https:\/\/codes.ohio.gov\/ohio-revised-code\/section-163.021\"><span style=\"font-weight: 400\">legislation<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/www.supremecourt.ohio.gov\/rod\/docs\/pdf\/0\/2006\/2006-ohio-3799.pdf\"><span style=\"font-weight: 400\">case law<\/span><\/a><span style=\"font-weight: 400\"> that <\/span><a href=\"https:\/\/harvardlawreview.org\/wp-content\/uploads\/2006\/11\/eminent_domain_ohio_supreme.pdf\"><span style=\"font-weight: 400\">judicially ratcheted down<\/span><\/a><span style=\"font-weight: 400\"> the deference owed to legislative determinations prescribing the government\u2019s eminent domain powers. The challenge reached the state\u2019s highest court, which ruled in <\/span><a href=\"https:\/\/www.supremecourt.ohio.gov\/rod\/docs\/pdf\/0\/2022\/2022-Ohio-4345.pdf\"><i><span style=\"font-weight: 400\">State ex rel. Ohio History Connection v. Moundbuilders Country Club Co.<\/span><\/i><\/a><span style=\"font-weight: 400\"> (2022) that the historical organization could acquire full possessory rights to the \u201cextraordinary piece of land.\u201d The court observed that \u201c[t]he historical, archaeological, and astronomical significance of the Octagon Earthworks is arguably equivalent to Stonehenge or Machu Picchu.\u201d The ruling left the parties to tussle only over the measure of just compensation, which they resolved in the recent confidential settlement.<\/span><\/p>\n<p><span style=\"font-weight: 400\">While the litigation was pending, the larger complex comprising the Hopewell Ceremonial Earthworks was added to the World Heritage List. Under the <\/span><a href=\"https:\/\/whc.unesco.org\/en\/conventiontext\/\"><span style=\"font-weight: 400\">treaty<\/span><\/a><span style=\"font-weight: 400\">, immovable cultural property qualifies if it possesses \u201coutstanding universal value from the point of view of history, art or science\u201d or \u201coutstanding universal value from the historical, aesthetic, ethnological or anthropological point of view.\u201d In addition to the primary criterion of \u201coutstanding universal value,\u201d cultural sites must also meet one of ten additional <\/span><a href=\"https:\/\/whc.unesco.org\/en\/criteria\/\"><span style=\"font-weight: 400\">criteria<\/span><\/a><span style=\"font-weight: 400\">. The Hopewell Ceremonial Earthworks qualified with <\/span><a href=\"https:\/\/whc.unesco.org\/en\/list\/1689\/\"><span style=\"font-weight: 400\">two<\/span><\/a><span style=\"font-weight: 400\">: representing \u201ca masterpiece of human creative genius\u201d and bearing \u201ca unique or at least exceptional testimony to a cultural tradition or to a civilization which is living or which has disappeared.\u201d<\/span><\/p>\n<p><b>Private Custodians and Public Assurances of \u201cAuthenticity\u201d and \u201cIntegrity\u201d<\/b><\/p>\n<p><span style=\"font-weight: 400\">According to the <\/span><a href=\"https:\/\/www.supremecourt.ohio.gov\/rod\/docs\/pdf\/0\/2022\/2022-Ohio-4345.pdf\"><span style=\"font-weight: 400\">Ohio Supreme Court<\/span><\/a><span style=\"font-weight: 400\">, the club asserted that it could maintain its leasehold at the Octagon Earthworks site, notwithstanding the site\u2019s (prospective and then eventual) World Heritage status. It stressed that its leases obligated it \u201cto preserve and maintain\u201d the site and that it provided reasonable public access. The historical organization answered that it \u201ccould not convert the private golf course into a public park\u201d without extinguishing the leasehold.<\/span><\/p>\n<p><span style=\"font-weight: 400\">By all accounts, the club mostly acted as a good steward during its century-plus use, and its status as a private party was not automatically disqualifying. The World Heritage Convention does not require government control over nominated or listed properties. For example, the privately owned Guggenheim Museum comprises part of the World Heritage site celebrating the architecture of <\/span><a href=\"https:\/\/whc.unesco.org\/en\/list\/1496\/\"><span style=\"font-weight: 400\">Frank Lloyd Wright<\/span><\/a><span style=\"font-weight: 400\">, and several private properties are proposed for the nomination of <\/span><a href=\"https:\/\/www.nps.gov\/orgs\/1207\/interior-department-prepares-to-nominate-u-s-civil-rights-movement-sites-for-world-heritage-list.htm\"><span style=\"font-weight: 400\">Civil Rights Movement sites<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">But the club also operated an active golf course on the site, installed paths for golf carts, and disturbed the mounds when renovating. Tensions over public access increased over time. Several mounds were off-limits to public use for much of the year, and the country club also imposed onerous restrictions that curbed use of the central part of the site. For example, the club assessed an access fee of almost $25,000 for a planned \u201c<\/span><a href=\"https:\/\/www.nytimes.com\/2005\/11\/28\/us\/ohio-indian-mounds-hallowed-ground-and-a-nice-par-3.html\"><span style=\"font-weight: 400\">moonrise celebration<\/span><\/a><span style=\"font-weight: 400\">\u201d at the site, to cover the costs of additional insurance, security, and a temporary platform to keep the public off the green. In arguing that it could coexist with the public on the site\u2014and even making that argument the keystone of its <\/span><a href=\"https:\/\/www.supremecourt.ohio.gov\/pdf_viewer\/pdf_viewer.aspx?pdf=935021.pdf&amp;subdirectory=2020-0191%5CDocketItems&amp;source=DL_Clerk\"><span style=\"font-weight: 400\">motion for reconsideration<\/span><\/a><span style=\"font-weight: 400\">\u2014the club confused the ability of private property owners to maintain World Heritage sites with feasibility.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Not only was coexistence between golfers and the public infeasible, but swinging clubs, roving golf carts, and paved pathways were foreclosed by the treaty\u2019s authenticity and integrity requirements. A nominating country must pledge to ensure the site\u2019s authenticity and integrity, and failure to do so can lead to delisting, a draconian measure that the multinational World Heritage Committee has implemented for <\/span><a href=\"https:\/\/whc.unesco.org\/en\/news\/2314\"><span style=\"font-weight: 400\">Liverpool<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/whc.unesco.org\/en\/news\/522\"><span style=\"font-weight: 400\">Dresden<\/span><\/a><span style=\"font-weight: 400\"> and threatened for <\/span><a href=\"https:\/\/whc.unesco.org\/en\/decisions\/877\/\"><span style=\"font-weight: 400\">Vienna<\/span><\/a><span style=\"font-weight: 400\">. The treaty\u2019s <\/span><a href=\"https:\/\/whc.unesco.org\/en\/guidelines\/\"><span style=\"font-weight: 400\">Operational Guidelines<\/span><\/a><span style=\"font-weight: 400\"> make clear that authenticity means that a site\u2019s cultural values are expressed in attributes that include form and design, use and function, and location and setting. Integrity, on the other hand, \u201cis a measure of the wholeness and intactness\u201d of the site, which considers whether it suffers from development or neglect.<\/span><\/p>\n<p><span style=\"font-weight: 400\">To this end, <\/span><a href=\"https:\/\/www.ecfr.gov\/current\/title-36\/chapter-I\/part-73\/section-73.13#p-73.13(c)\"><span style=\"font-weight: 400\">federal regulations<\/span><\/a><span style=\"font-weight: 400\"> provide that privately owned or controlled properties must have documented protective measures, such as real covenants that prohibit, \u201cin perpetuity, any use that is not consistent with, or which threatens or damages the property&#8217;s universally significant values[.]\u201d The regulations also provide that \u201cno non-Federal property may be nominated to the World Heritage List unless its owner concurs in writing to such nomination.\u201d New federal regulations on World Heritage nominations were <\/span><a href=\"https:\/\/www.federalregister.gov\/documents\/2024\/12\/04\/2024-27373\/world-heritage-convention\"><span style=\"font-weight: 400\">proposed<\/span><\/a><span style=\"font-weight: 400\"> in December 2024 to help close gaps, including by shoring up the definition of an \u201cowner\u201d whose concurrence is required. The proposed regulations would limit the definition to holders in fee simple\u2014unlike the definition of \u201cowner\u201d under <\/span><a href=\"https:\/\/codes.ohio.gov\/ohio-revised-code\/section-163.01\"><span style=\"font-weight: 400\">Ohio\u2019s eminent domain statutes<\/span><\/a><span style=\"font-weight: 400\">, which extends to any individual or entity \u201chaving any estate, title, or interest in any real property sought to be appropriated.\u201d<\/span><\/p>\n<p><b>Aesthetic Takings<\/b><\/p>\n<p><span style=\"font-weight: 400\">The club\u2019s strenuous assertion that the taking was not \u201cnecessary\u201d for a valid \u201cpublic use\u201d is more perplexing, even though the site\u2019s World Heritage status was aspirational at the time of the taking and only materialized during the litigation. A government\u2019s ability to take property through eminent domain for public parks is well-trod law, and Ohio law <\/span><a href=\"https:\/\/codes.ohio.gov\/ohio-revised-code\/section-163.01\"><span style=\"font-weight: 400\">expressly specifies<\/span><\/a><span style=\"font-weight: 400\"> that public parks \u201care presumed to be public uses.\u201d But the state\u2019s <\/span><a href=\"https:\/\/codes.ohio.gov\/ohio-revised-code\/section-163.021\"><span style=\"font-weight: 400\">post-<\/span><i><span style=\"font-weight: 400\">Kelo<\/span><\/i><span style=\"font-weight: 400\"> legislative changes<\/span><\/a><span style=\"font-weight: 400\"> added the necessity requirement as a preamble to more specific requirements about taking blighted areas for redevelopment. The elevation of state takings standards above the federal minimum standard decoupled a long history of shared interpretation. The result may ultimately give less force to longstanding precedent for aesthetic takings for cultural heritage sites.<\/span><\/p>\n<p><span style=\"font-weight: 400\">As far back as the late 19th century, the U.S. Supreme Court made clear that takings could be used for public parks. The Court in <\/span><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/160\/668\/\"><i><span style=\"font-weight: 400\">United States v. Gettysburg Electric Railway Co.<\/span><\/i><\/a><span style=\"font-weight: 400\"> (1896), for example, extolled the virtues of eminent domain to acquire private property rights to form a historically and culturally significant site: the Gettysburg National Military Park.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In 1929, on similar facts to those here, the Court even awarded penalties for a <\/span><a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/278\/191\/\"><span style=\"font-weight: 400\">\u201cfrivolous\u201d appeal<\/span><\/a><span style=\"font-weight: 400\"> because the appellant had \u201cno basis for doubting the power of the State to condemn places of unusual historical interest for the use and benefit of the public.\u201d The case concerned the Shawnee Mission, a site of \u201cunusual historical interest\u201d for which the state historical society acted as custodian. The <\/span><a href=\"https:\/\/exhibits.ced.berkeley.edu\/exhibits\/show\/citybeautiful\/tenets\"><span style=\"font-weight: 400\">City Beautiful<\/span><\/a><span style=\"font-weight: 400\"> movement of this same era often relied on takings to replace tenements and other downtrodden urban areas with public parks and scenic areas. Such initiatives sometimes had a sinister side when they disproportionately impacted minority communities, as when an African-American neighborhood in Charlottesville was <\/span><a href=\"https:\/\/www.dhr.virginia.gov\/VLR_to_transfer\/PDFNoms\/104-0251_Thomas_Jonathan_Jackson_Sculpture_1997_Final_Nomination.pdf\"><span style=\"font-weight: 400\">replaced<\/span><\/a><span style=\"font-weight: 400\"> with a public park containing a monument to Confederate General Thomas \u201cStonewall\u201d Jackson. (The Jackson monument and the infamous statue to General Robert E. Lee nearby were both donated by a city benefactor in the 1920s and <\/span><a href=\"https:\/\/www.npr.org\/2021\/07\/10\/1014926659\/charlottesville-removes-robert-e-lee-statue-that-sparked-a-deadly-rally\"><span style=\"font-weight: 400\">removed<\/span><\/a><span style=\"font-weight: 400\"> in 2021.)<\/span><\/p>\n<p><span style=\"font-weight: 400\">Here, the club <\/span><a href=\"https:\/\/www.supremecourt.ohio.gov\/pdf_viewer\/pdf_viewer.aspx?pdf=891943.pdf&amp;subdirectory=2020-0191%5CDocketItems&amp;source=DL_Clerk\"><span style=\"font-weight: 400\">suggested<\/span><\/a><span style=\"font-weight: 400\"> that it established a higher \u201cpublic use\u201d than a less-profitable heritage site. As the Ohio Supreme Court <\/span><a href=\"https:\/\/www.supremecourt.ohio.gov\/pdf_viewer\/pdf_viewer.aspx?pdf=231702.pdf&amp;subdirectory=2020-0191%5CDecisionItems&amp;source=DL_Clerk\"><span style=\"font-weight: 400\">observed<\/span><\/a><span style=\"font-weight: 400\">, the club argued \u201cthat its positive economic impact in the community and its efforts to preserve the earthworks provided a far greater tangible benefit to the public than the hypothetical and unlikely benefit to the public that allegedly would be realized by the appropriation [if listed on the World Heritage List].\u201d Curiously, this argument is the antithesis of the anti-<\/span><i><span style=\"font-weight: 400\">Kelo<\/span><\/i><span style=\"font-weight: 400\"> resistance, which objects to <\/span><i><span style=\"font-weight: 400\">Kelo<\/span><\/i><span style=\"font-weight: 400\">\u2019s deferential gloss on \u201cpublic use\u201d based on increased tax revenue and economic development. Indeed, counsel for the <\/span><i><span style=\"font-weight: 400\">Kelo<\/span><\/i><span style=\"font-weight: 400\"> homeowners raised the <\/span><a href=\"https:\/\/www.supremecourt.gov\/pdfs\/transcripts\/2004\/04-108.pdf\"><span style=\"font-weight: 400\">opposite hypothetical<\/span><\/a><span style=\"font-weight: 400\"> in their oral argument, arguing that it would subject a church to a valid taking when it \u201cwould produce more tax revenue and jobs if it were a Costco, a shopping mall or a private office building.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">To be clear, courts so far seem poised to reject such arguments, as the state courts did here. A <\/span><a href=\"https:\/\/sanantonioreport.org\/alamo-trust-bar-moses-roses-settlement-san-antonio\/\"><span style=\"font-weight: 400\">similar takings dispute<\/span><\/a><span style=\"font-weight: 400\"> was also settled in 2023 for a visitor center and museum near The Alamo in San Antonio, part of another World Heritage site. Congress, too, has <\/span><a href=\"https:\/\/constitution.congress.gov\/browse\/essay\/amdt5-9-2\/ALDE_00013281\/#essay-16\"><span style=\"font-weight: 400\">annotated<\/span><\/a><span style=\"font-weight: 400\"> the Takings Clause by acknowledging that use of eminent domain \u201cto establish public parks, to preserve places of historic interest, and to promote beautification has substantial precedent.\u201d Last year, the Second Circuit <\/span><a href=\"https:\/\/law.justia.com\/cases\/federal\/appellate-courts\/ca2\/22-2722\/22-2722-2024-03-13.html\"><span style=\"font-weight: 400\">upheld<\/span><\/a><span style=\"font-weight: 400\"> a city\u2019s exercise of eminent domain even for a \u201cpassive use park,\u201d an unimproved tract acquired to prevent the construction of a so-called \u201cbig-box\u201d store.
