{"id":5749,"date":"2012-02-16T08:00:44","date_gmt":"2012-02-16T13:00:44","guid":{"rendered":"http:\/\/www.journals.law.harvard.edu\/ilj\/?p=5749"},"modified":"2020-07-03T09:40:55","modified_gmt":"2020-07-03T13:40:55","slug":"online_53_so_sachs","status":"publish","type":"post","link":"https:\/\/journals.law.harvard.edu\/ilj\/2012\/02\/online_53_so_sachs\/","title":{"rendered":"Making Intellectual Property Work for Global Health"},"content":{"rendered":"<p>Intellectual property rights (IPRs) are often conceived narrowly from the vantage\u00a0point of offering incentives for private sector investment in research and\u00a0development (R&amp;D), but the legal regime of IPRs can also work to improve access to\u00a0public goods for global health, particularly for those disadvantaged by destitution and\u00a0disease. The WHO Global Strategy and Plan of Action on Public Health, Innovation\u00a0and Intellectual Property (GSPOA), adopted by the World Health Assembly in 2008,\u00a0calls for an \u201cenhanced and sustainable basis for needs-driven, essential health research\u00a0and development relevant to diseases that disproportionately affect developing\u00a0countries.\u201d1 How knowledge is generated, owned, and harnessed to support pro-poor\u00a0development is at the heart of this effort. New approaches to tiering, pooling, and\u00a0open-source collaboration have resulted from the struggle to deliver affordable\u00a0treatments for AIDS and neglected diseases. In examining how intellectual property\u00a0rights can most effectively and strategically support developing countries in\u00a0implementing this ambitious and potentially catalytic agenda in enabling innovation\u00a0for global health, this paper seeks to outline a coherent and strategic approach to\u00a0address human development needs and to facilitate the harnessing of innovation and\u00a0the
