{"id":7035,"date":"2013-11-15T21:26:09","date_gmt":"2013-11-16T02:26:09","guid":{"rendered":"http:\/\/www.journals.law.harvard.edu\/ilj\/?p=7035"},"modified":"2013-11-19T00:16:59","modified_gmt":"2013-11-19T05:16:59","slug":"7035","status":"publish","type":"post","link":"https:\/\/journals.law.harvard.edu\/ilj\/2013\/11\/7035\/","title":{"rendered":"Stalled Iran Nuclear Talks Highlight Divergent Interpretation of the 1968 Nuclear Non-Proliferation Treaty"},"content":{"rendered":"<p style=\"text-align: left;\" align=\"center\">Posted by Ashley Belyea &#8211; November 15, 2013 @ 21:26.<\/p>\n<p style=\"text-align: left;\" align=\"center\">On November 10, 2013, talks on the future of Iran&#8217;s nuclear program stalled between Iran and the P5+1\u2014the United States, the United Kingdom, France, Russia, China, and Germany.\u00a0 Negotiators were unable to conclude an interim agreement governing Iran\u2019s nuclear program.\u00a0 The process is not dead, however; <a href=\"http:\/\/www.bbc.co.uk\/news\/world-middle-east-24887253\">low-level negotiators are set to resume talks on November 20<\/a>.\u00a0 \u00a0At issue is <a href=\"http:\/\/www.bloomberg.com\/news\/2013-10-13\/iran-nuclear-talks-pit-un-demands-against-atomic-treaty.html\">Iran\u2019s insistence on its right to enrich uranium for nuclear fuel production<\/a>. \u00a0The United States, on the other hand, <a href=\"http:\/\/www.nytimes.com\/2013\/11\/11\/world\/middleeast\/kerry-no-deal-in-hand-defends-negotiating-strategy-on-iran.html?pagewanted=1&amp;_r=0&amp;nl=todaysheadlines&amp;emc=edit_th_20131111\">\u201cdoes not believe there is an inherent right to enrichment.\u201d<\/a>\u00a0Diplomatic and political concerns loom large, but the disagreement has its roots in treaty interpretation.<\/p>\n<p>Iran\u2019s assertion of a right to enrich for energy production <a href=\"http:\/\/www.csmonitor.com\/World\/Security-Watch\/2013\/1112\/Does-Iran-have-a-right-to-enrich-Answer-is-key-to-nuclear-deal-and-beyond.-video\">invokes<\/a>\u00a0and tracks the language of the <a href=\"http:\/\/www.un.org\/disarmament\/WMD\/Nuclear\/NPTtext.shtml\">1968 Nuclear Non-Proliferation Treaty (\u201cNPT\u201d)<\/a>, <a href=\"http:\/\/disarmament.un.org\/treaties\/t\/npt\">to which it is a party<\/a>.\u00a0 Article IV of the NPT reads: \u00a0\u201cNothing in this Treaty shall be interpreted as affecting the inalienable right of all the Parties to the Treaty to develop research, production and use of nuclear energy for peaceful purposes without discrimination and in conformity with Articles I and II of this Treaty.\u201d\u00a0 The right to \u201cdevelop research, production and use of nuclear energy,\u201d <a href=\"http:\/\/www.telegraph.co.uk\/news\/worldnews\/10439093\/Iranian-president-Hassan-Rouhani-Our-right-to-enrich-uranium.html\">Iran argues<\/a>, includes the right to enrich uranium for fuel production.<\/p>\n<p>For its part, the United States may be relying on three parts of Article IV to deny Iran\u2019s right to enrich.<\/p>\n<ul>\n<li>First, while nothing in the NPT can affect Iran\u2019s right to pursue nuclear development for peaceful purposes, the United States could argue that extra-treaty forces may still affect that right.\u00a0 For example, article 103 of the United Nations Charter (\u201cUNC\u201d) trumps any treaty inconsistent with the UNC, <a href=\"http:\/\/www.bloomberg.com\/news\/2013-10-13\/iran-nuclear-talks-pit-un-demands-against-atomic-treaty.html\">\u201cincluding the Nuclear Non-Proliferation Treaty.\u201d<\/a>\u00a0\u00a0Unanimity among the P5 in negotiating a proposed deal with Iran <a href=\"http:\/\/www.bloomberg.com\/news\/2013-10-13\/iran-nuclear-talks-pit-un-demands-against-atomic-treaty.html\">could be read as action<\/a>\u00a0by the UN requiring compliance under UNC Article 103 affecting Iran\u2019s right to enrich.<\/li>\n<li>Second, <a href=\"http:\/\/www.csmonitor.com\/World\/Security-Watch\/2013\/1112\/Does-Iran-have-a-right-to-enrich-Answer-is-key-to-nuclear-deal-and-beyond.-video\">the U.S. has argued<\/a>\u00a0that Article IV makes no mention of a specific right to <i>enrich uranium<\/i>, and that a ban on enrichment does not bar Iran from pursuing its Article IV rights.<\/li>\n<li>Third,<i> <\/i><a href=\"http:\/\/www.bloomberg.com\/news\/2013-10-13\/iran-nuclear-talks-pit-un-demands-against-atomic-treaty.html\">U.S. negotiators could argue Iran has not complied with Article II of the NPT<\/a>, which prohibits \u201cnon-nuclear\u201d countries from pursuing a nuclear weapons program.\u00a0 As a matter of treaty interpretation, non-conformity with Article II could be interpreted to nullify a state\u2019s ability to claim a right under Article IV. Perceived non-conformity bridges the language of the treaty and the security concerns <a href=\"http:\/\/www.aljazeera.com\/news\/europe\/2013\/11\/iran-nuclear-talks-continue-third-day-201311984344448450.html\">motivating the P5+1 to insist on more stringent nuclear control in Iran<\/a>.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Posted by Ashley Belyea &#8211; November 15, 2013 @ 21:26.
