Bickel<a href=\"#_ftn1\" name=\"_ftnref1\">*<\/a><\/strong><\/p>\n\n\n\n<p>A jurisprudential shift is underway in the area of Establishment Clause law. The slow and painful death of the long derided \u201c<em>Lemon<\/em> Test\u201d is merely a symptom of the Supreme Court\u2019s increasing adherence to text, history, and tradition.<a href=\"#_ftn2\" name=\"_ftnref2\"><sup>[1]<\/sup><\/a> Against that backdrop, this essay will briefly overview this recent shift as it pertains to Establishment Clause doctrine to suggest that there now exists a viable roadmap to chip away at and revisit <em>Engel v. Vitale<\/em>.<a href=\"#_ftn3\" name=\"_ftnref3\"><sup>[2]<\/sup><\/a> Then, after substantiating how this largely forgotten public prayer precedent is again relevant in light of this ongoing shift, this paper will elucidate why <em>Engel<\/em> was egregiously wrong and why it warrants being formally overruled at the earliest opportunity to do so.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">I.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; Background<\/h2>\n\n\n\n<p>From the early Republic through the mid-20th century, it was common practice for public schools to begin the day with a nonsectarian prayer or a Bible excerpt. In fact, as recently as 1960, 42% of public school districts nationwide tolerated or even required Bible reading and 50% reported practicing homeroom daily devotional exercises.<a href=\"#_ftn4\" name=\"_ftnref4\"><sup>[3]<\/sup><\/a> Thus, public school prayer is an entrenched American tradition\u2014epitomizing our Founders\u2019 unrivaled commitment to religious tolerance as well as the role that religious pluralism can play in promoting public morality.<a href=\"#_ftn5\" name=\"_ftnref5\"><sup>[4]<\/sup><\/a> For almost two centuries, teacher-led public school prayer, while not required by the Constitution, was nonetheless <em>permitted\u2014<\/em>and even embraced by at least half of the country\u2019s school districts.<a href=\"#_ftn6\" name=\"_ftnref6\"><sup>[5]<\/sup><\/a><\/p>\n\n\n\n<p>This all came to a screeching halt when the Supreme Court rendered its first decision on this activity in <em>Engel<\/em> and broke away from this custom of accommodationism. In a sweeping ruling, the Court determined that teacher-led public school prayer violated the Establishment Clause. In doing so, the Warren Court deemed voluntary nonsectarian public school prayer unconstitutional nationwide, catalyzing a series of subsequent judicial outcomes that cumulatively purged public schools of almost all semblances of traditional religiosity.<a href=\"#_ftn7\" name=\"_ftnref7\"><sup>[6]<\/sup><\/a> \u201cMoments of silence\u201d were outlawed based on the mere suspicion that silent prayer would be engaged in, commencement ceremonies were stripped of any benedictions, and student-organized prayers at high school sports games were summarily outlawed due to how they risked being \u201cperceived.\u201d<a href=\"#_ftn8\" name=\"_ftnref8\"><sup>[7]<\/sup><\/a><\/p>\n\n\n\n<p>In arriving at this outcome, <em>Engel <\/em>relied on what is known as \u201coffended observer standing,\u201d citing \u201c<em>indirect<\/em> coercive pressure\u201d felt by ten pupils.<a href=\"#_ftn9\" name=\"_ftnref9\"><sup>[8]<\/sup><\/a>&nbsp; In other words, <em>Engel<\/em> recognized the students\u2019 parents\u2019 legal standing and allowed them to sue the school district on the basis of what they considered to be offensive government conduct. Notably, <em>Engel<\/em> made no attempt whatsoever to substantiate any evidence of any direct and particularized injuries suffered by either the pupils or the parents.<\/p>\n\n\n\n<p>In 2019, however, Justices Thomas and Gorsuch called into question the underpinnings of offended observer standing, asserting that: \u201c[R]ecourse for disagreement and offense does not lie in federal litigation. Instead, in a society that holds among its most cherished ambitions mutual respect, tolerance, self-rule, and democratic responsibility, an \u2018offended viewer\u2019 may \u2018avert his eyes,\u2019 . . . or pursue a political solution.\u201d<a href=\"#_ftn10\" name=\"_ftnref10\"><sup>[9]<\/sup><\/a>&nbsp; They argued that merely taking personal &#8220;offense&#8221; at a public display of religion is insufficient to establish an Article III injury. At the time, this opinion only garnered two votes. Now, as of this past June, a 6-3 majority of the Court implicitly supports this reasoning: \u201c\u2018[A] school does not endorse,\u2019 let alone coerce [public school students] to participate in, \u2018speech that it merely permits on a nondiscriminatory basis\u2019 . . . . [S]ome will take offense to . . . prayer they are sure to encounter in a society where those activities enjoy such robust constitutional protection. But \u2018[o]ffense . . . does not equate to coercion.\u2019\u201d<a href=\"#_ftn11\" name=\"_ftnref11\"><sup>[10]<\/sup><\/a> As Professor Josh Blackman recognized, this majority opinion sends a clear message: unless there is <em>direct<\/em> coercion involved, mere personal \u201coffense\u201d to public prayer is an insufficient basis to challenge its legality.<a href=\"#_ftn12\" name=\"_ftnref12\"><sup>[11]<\/sup><\/a> Justice Gorsuch goes on to conclude in <em>Kennedy<\/em> that: \u201c[T]he \u2018shortcomings\u2019 associated with this \u2018ambitiou[s],\u2019 abstract, and ahistorical approach to the Establishment Clause became so \u2018apparent\u2019 that this Court long ago abandoned <em>Lemon<\/em> and its endorsement test offshoot . . . . In place of <em>Lemon<\/em> and [its infamous] test, this Court has instructed that the Establishment Clause must be interpreted by \u2018<em>reference to historical practices and understandings<\/em>.\u2019\u201d<a href=\"#_ftn13\" name=\"_ftnref13\"><sup>[12]<\/sup><\/a> In summary, rather than avoiding these recurring questions, <em>Kennedy<\/em> affirmed that mere offense <em>does not<\/em> amount to coercion and that <em>Lemon <\/em>is retired. This emerging doctrinal shift signaled by <em>Kennedy<\/em> sends ripples across several decades of Establishment Clause precedents.<\/p>\n\n\n\n<p>There are at least four public prayer holdings seriously undermined by this marked doctrinal shift. From oldest to most recent, these are: <em>Engel v. Vitale<\/em>,<a href=\"#_ftn14\" name=\"_ftnref14\"><sup>[13]<\/sup><\/a> <em>Wallace v. Jaffree<\/em>,<a href=\"#_ftn15\" name=\"_ftnref15\"><sup>[14]<\/sup><\/a> <em>Lee v. Weisman<\/em>,<a href=\"#_ftn16\" name=\"_ftnref16\"><sup>[15]<\/sup><\/a> and <em>Santa Fe Independent School District v. Doe.<\/em><a href=\"#_ftn17\" name=\"_ftnref17\"><sup>[16]<\/sup><\/a> <em>Engel<\/em> and <em>Lee<\/em> each hinged upon dubious findings of indirect coercion, whereas <em>Wallace<\/em> and <em>Sante Fe<\/em> each hinged upon applications of the <em>Lemon<\/em> Test. That said, <em>Engel<\/em>\u2019s unexpected and radical departure from the text, history, and tradition of the Establishment Clause laid the precedential foundation for this \u2018separationist&#8217; cascade of holdings.<a href=\"#_ftn18\" name=\"_ftnref18\"><sup>[17]<\/sup><\/a> This goes to suggest that <em>Wallace<\/em>, <em>Lee<\/em>, and <em>Sante Fe<\/em> each built upon and extended <em>Engel<\/em>\u2019s erroneous outcome to different domains. Although these more recent public school prayer precedents are better positioned to be revisited by the Court in the short-term, this essay will take aim at <em>Engel<\/em> so that it might be overruled in the long-term.<a href=\"#_ftn19\" name=\"_ftnref19\"><sup>[18]<\/sup><\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">II.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;Grounds for Overruling <em>Engel<\/em><\/h2>\n\n\n\n<p>The Supreme Court is not infallible. The Court has overruled itself at least 234 times, dating all the way back to 1810.<a href=\"#_ftn20\" name=\"_ftnref20\"><sup>[19]<\/sup><\/a> Expounding on the legal doctrine of adhering to precedent, Justice Alito asserts in his <em>Dobbs<\/em> opinion that \u201c<em>stare decisis<\/em> is <em>not<\/em> an inexorable command\u201d<a href=\"#_ftn21\" name=\"_ftnref21\"><sup>[20]<\/sup><\/a> and that it \u201cis at its weakest when [the Court] interpret[s] the Constitution.\u201d<a href=\"#_ftn22\" name=\"_ftnref22\"><sup>[21]<\/sup><\/a> He goes on to assert that many of the Court\u2019s most important constitutional decisions in American history have overruled prior holdings. Such flawed precedents (or \u201cderelicts of constitutional law\u201d as they have been referred to)<a href=\"#_ftn23\" name=\"_ftnref23\"><sup>[22]<\/sup><\/a> include <em>Plessy v. Ferguson<\/em>,<a href=\"#_ftn24\" name=\"_ftnref24\"><sup>[23]<\/sup><\/a> <em>Dred Scott v. Sandford<\/em>,<a href=\"#_ftn25\" name=\"_ftnref25\"><sup>[24]<\/sup><\/a> and now <em>Roe<\/em><a href=\"#_ftn26\" name=\"_ftnref26\"><sup>[25]<\/sup><\/a> and <em>Casey<\/em><a href=\"#_ftn27\" name=\"_ftnref27\"><sup>[26]<\/sup><\/a> according to <em>Dobbs<\/em>.<a href=\"#_ftn28\" name=\"_ftnref28\"><sup>[27]<\/sup><\/a> Justice Frankfurter also famously clarified this tension when he wrote that \u201cthe ultimate touchstone of constitutionality is the Constitution itself and not what [the Court has] said about it.\u201d<a href=\"#_ftn29\" name=\"_ftnref29\"><sup>[28]<\/sup><\/a><\/p>\n\n\n\n<p>But how can we know when a \u201cconstitutional derelict\u201d warrants being overruled? The Court recently explained that: \u201c[C]ases have attempted to provide a framework for deciding when a precedent should be overruled, and they have identified factors that should be considered in making such a decision.\u201d<a href=\"#_ftn30\" name=\"_ftnref30\"><sup>[29]<\/sup><\/a> These factors are: the nature of the Court\u2019s error, the quality of the Court\u2019s reasoning, the workability of the rules the decision imposes, the decision\u2019s effect on other areas of law, and the degree to which reliance interests are at stake. This essay will evaluate each factor in turn to reveal that <em>Engel <\/em>was egregiously wrong and warrants being overruled.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">A.&nbsp;&nbsp;&nbsp; &nbsp;The Nature of the Court\u2019s Error<\/h3>\n\n\n\n<p><em>Engel<\/em> \u201cwas on a collision course with the Constitution from the day it was decided.\u201d<a href=\"#_ftn31\" name=\"_ftnref31\"><sup>[30]<\/sup><\/a> Subsequent public school prayer holdings such as <em>Wallace v. Jaffree<\/em>,<a href=\"#_ftn32\" name=\"_ftnref32\"><sup>[31]<\/sup><\/a> which ruled moments of silence to be unconstitutional, and <em>Lee v. Weisman<\/em>,<a href=\"#_ftn33\" name=\"_ftnref33\"><sup>[32]<\/sup><\/a> which ruled once-per-year graduation benedictions from guest speakers unconstitutional, have only perpetuated its grievous errors and exacerbated social division.<a href=\"#_ftn34\" name=\"_ftnref34\"><sup>[33]<\/sup><\/a> Justice Gorsuch underscored the significance of religious pluralism in <em>Kennedy<\/em>, noting that \u201c[r]espect for religious expressions is indispensable to life in a free and diverse Republic.\u201d<a href=\"#_ftn35\" name=\"_ftnref35\"><sup>[34]<\/sup><\/a> That being understood, the Court was woefully \u201cunrestrained\u201d in <em>Engel<\/em>: by usurping the power to legislate on this profoundly important political issue, despite the Constitution leaving it for the People to determine.<a href=\"#_ftn36\" name=\"_ftnref36\"><sup>[35]<\/sup><\/a> The Warren Court circumvented the democratic process by \u2018settling\u2019 this political question on behalf of the entire country, despite the majority of Americans supporting public school prayer at the time of the ruling.<a href=\"#_ftn37\" name=\"_ftnref37\"><sup>[36]<\/sup><\/a> As Justice Byron White explained, \u201cdecisions that find in the Constitution principles or values that cannot fairly be read into that document usurp the people\u2019s authority, for such decisions represent choices that the people have <em>never<\/em> made and that they <em>cannot<\/em> disavow through corrective legislation.\u201d<a href=\"#_ftn38\" name=\"_ftnref38\"><sup>[37]<\/sup><\/a> In these most severe situations, he asserted, \u201cit is essential that [the] Court maintain the power to restore authority to its proper possessors by correcting constitutional decisions that, on reconsideration, are found to be mistaken.\u201d<a href=\"#_ftn39\" name=\"_ftnref39\"><sup>[38]<\/sup><\/a> Thus, <em>Engel<\/em> damaged the Court\u2019s reputation as a neutral arbiter of law by removing this debate from the People and from the democratic process.<a href=\"#_ftn40\" name=\"_ftnref40\"><sup>[39]<\/sup><\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">B.&nbsp;&nbsp;&nbsp;&nbsp; The Quality of the Court\u2019s Reasoning<\/h3>\n\n\n\n<p>Even a rudimentary overview of <em>Engel<\/em>\u2019s holding is enough to expose some of its exceptionally weak reasoning, most of which is premised upon the \u201canti-divisiveness\u201d rationale.<a href=\"#_ftn41\" name=\"_ftnref41\"><sup>[40]<\/sup><\/a> The Court explicitly invoked this rationale in <em>Engel<\/em> when it insisted that: \u201c[W]henever government [has] allied itself with <em>one particular <\/em>form of religion, the inevitable result [has] been that it [has] incurred the hatred, disrespect and even contempt of those who [hold] contrary beliefs.\u201d<a href=\"#_ftn42\" name=\"_ftnref42\"><sup>[41]<\/sup><\/a> In other words, the practical effect of accommodating nonsectarian teacher-led public school prayer is incessant competition between sects for public accommodation. Granted, this rationale appeals to our nation\u2019s turbulent religious history.<a href=\"#_ftn43\" name=\"_ftnref43\"><sup>[42]<\/sup><\/a> Yet quite confusingly, the end of the <em>Engel <\/em>opinion concedes the opposite, that the nonsectarian prayer in question \u201c<em>does not<\/em> amount to a total establishment of <em>one particular<\/em> religious sect to the exclusion of all others . . . .\u201d<a href=\"#_ftn44\" name=\"_ftnref44\"><sup>[43]<\/sup><\/a> Even if we disregard this blatant contradiction, this abstract doctrine nevertheless instructs against <em>Engel<\/em>\u2019s outcome because while outlawing voluntary nonsectarian public prayer may indeed alleviate tension between varying sects, this prohibition foments a different kind of tension\u2014and one that is far more fraught. While <em>Engel<\/em> and its progeny may have been somewhat successful in staving off sectarian strife within our country, rulings like these that impose strict separationism between church and state tend to inflame the tension between theists and atheists, or between those of faith and those who seek to subvert the integral role that religious pluralism plays in public life.<a href=\"#_ftn45\" name=\"_ftnref45\"><sup>[44]<\/sup><\/a> The Court must not only beware of the state favoring certain sects over others, such as favoring Protestantism over Catholicism, but it must also stymie any shortsighted attempts to advance or establish a \u201csecular orthodoxy\u201d\u2014which arguably constitutes a de facto religion, even by the Court\u2019s own admission.<a href=\"#_ftn46\" name=\"_ftnref46\"><sup>[45]<\/sup><\/a> For the foregoing reasons, <em>Engel<\/em>\u2019s shallow \u201canti-divisiveness\u201d rationale cannot coherently justify its blanket prohibition of voluntary nonsectarian public school prayer.<\/p>\n\n\n\n<p>Similarly, the \u201canti-corruption\u201d rationale that <em>Engel <\/em>is predicated upon is not persuasive. This rationale says that any occasion of state entanglement with religion that is <em>neither <\/em>\u201cceremonial\u201d <em>nor<\/em> \u201cpatriotic,\u201d is unduly \u201creligious\u201d and therefore problematic\u2014because both religion and government are inevitably \u201cdegraded\u201d and \u201cdestroyed\u201d whenever they rely upon each other for support.<a href=\"#_ftn47\" name=\"_ftnref47\"><sup>[46]<\/sup><\/a> James Madison argued that \u201creligion is too personal, too sacred, too holy, to permit its \u2018unhallowed perversion\u2019 by a civil magistrate.\u201d<a href=\"#_ftn48\" name=\"_ftnref48\"><sup>[47]<\/sup><\/a> While this concern is valid, there is no guarantee that the state-sponsored recital of nonsectarian religious language inevitably distorts its message or diminishes its \u201cgood fruit.\u201d Instead, it is actually quite plausible that public school prayer bolsters and reinforces basic quasi-religious tenets such as humility and gratitude.<a href=\"#_ftn49\" name=\"_ftnref49\"><sup>[48]<\/sup><\/a> Moreover, it is not clear that the government becomes worse at serving its citizens&#8217; interests when it advances religion <em>in general<\/em>. On the contrary, a \u201creligious\u201d or Lockean conception of inalienable natural rights endowed unto us by \u201cour Creator\u201d (rather than a man-made government) could be vital to the limited nature of our self-government because it reminds the state that its officials cannot arbitrarily deprive us citizens of our most basic rights, given that our individual rights are derived from a \u201cHigher Power.\u201d<a href=\"#_ftn50\" name=\"_ftnref50\"><sup>[49]<\/sup><\/a> To be clear, this \u201cis <em>not<\/em> a matter of believing that God exists, though [citizens might personally] believe that,\u201d as Justice Scalia said.<a href=\"#_ftn51\" name=\"_ftnref51\"><sup>[50]<\/sup><\/a> Instead, as he explained: \u201cIt is a matter of believing, as our founders did, that belief in God is very conducive to a successful republic.\u201d<a href=\"#_ftn52\" name=\"_ftnref52\"><sup>[51]<\/sup><\/a> Thus, the government is able to acknowledge the existence of God as the fundamental source of our rights <em>philosophically<\/em> but not religiously. Again, this Founding Era notion of the \u201cPhilosophers\u2019 God\u201d is a conception of God not predicated upon theological revelation, but instead upon intuitive human reason. The takeaway is that there is a sharp distinction between \u201cthe Creator\u201d referenced in the Declaration of Independence and \u201cthe God\u201d of sectarian faith traditions, and nonsectarian state-sponsored speech (such as public school prayer) merely pays homage to our nation\u2019s religious heritage.<a href=\"#_ftn53\" name=\"_ftnref53\"><sup>[52]<\/sup><\/a> This last point suggests that the Court erred when it did not classify nonsectarian public prayer as \u201cpatriotic\u201d in the first place.<a href=\"#_ftn54\" name=\"_ftnref54\"><sup>[53]<\/sup><\/a> Even putting this misstep aside, however, the Court nevertheless failed to substantiate that this form of minimal entanglement corrupts either church or state.<\/p>\n\n\n\n<p>Now that <em>Engel<\/em>\u2019s two main rationales have each been debunked, the Court\u2019s legal determination that this bedrock American tradition amounts to \u201cestablishing an official religion\u201d must be questioned. After all, despite concurring in <em>Engel<\/em>, Justice Douglas actually goes as far to admit that authorizing prayer does <em>not<\/em> establish a religion \u201cin the strictly historic meaning of those words.\u201d<a href=\"#_ftn55\" name=\"_ftnref55\"><sup>[54]<\/sup><\/a> He goes on to concede that: \u201cA religion is<em> not<\/em> established in the usual sense merely by letting those who choose to do so say [a] prayer that the public school teacher leads.\u201d<a href=\"#_ftn56\" name=\"_ftnref56\"><sup>[55]<\/sup><\/a> To Justice Douglas\u2019s credit, his damning admission is thoroughly borne out by a proper historical analysis of the Founding Era, which reveals that: \u201c[A]lthough the laws constituting [official] establishment were ad hoc and unsystematic, they can be summarized by: (1) control over doctrine, governance, and personnel of the church; (2) compulsory church attendance; (3) financial support; (4) prohibitions on worship in dissenting churches; (5) use of church institutions for public functions; and (6) restriction of political participation to members of the established church.\u201d<a href=\"#_ftn57\" name=\"_ftnref57\"><sup>[56]<\/sup><\/a> As one can see, teacher-led, voluntary, nondenominational public school prayer contains <em>none<\/em> of these elements\u2014rendering <em>Engel<\/em>\u2019s determination of \u201cofficial establishment\u201d dubious at best, if historical understandings are to serve as any reference point. Furthermore, an analysis of historical practices reveals that shortly following the ratification of the 14th Amendment, public school prayer was still being practiced in virtually every state in the country.<a href=\"#_ftn58\" name=\"_ftnref58\"><sup>[57]<\/sup><\/a> Therefore, we can be quite confident that the educated public did not commonly understand the ratification of the 14th Amendment in 1868 to prohibit public schools from accommodating nonsectarian prayer. This inference is only compounded by the fact that when the Establishment Clause was formally incorporated against the states in 1947 by <em>Everson v. Board of Education<\/em>, there did <em>not<\/em> follow any systematic or coordinated national effort to \u201cdisestablish\u201d public schools of teacher-led prayer.<a href=\"#_ftn59\" name=\"_ftnref59\"><sup>[58]<\/sup><\/a> Thus, <em>Engel<\/em><em>\u2019s <\/em>reasoning fails to comport with \u201creferences to historical practices and understandings,\u201d indicating that <em>Engel<\/em> misinterpreted the Establishment Clause.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">C.&nbsp;&nbsp;&nbsp; Workability of the Rules this Decision Imposes<\/h3>\n\n\n\n<p>Not only is <em>Engel<\/em> predicated upon superficial reasoning, but the rationales it offers are also unworkable and confusing. Consider Justice Black\u2019s statement: \u201cWhen the power, prestige and financial support of government is placed behind a particular religious belief, the <em>indirect coercive pressure<\/em> upon religious minorities to conform to the prevailing officially approved religion is plain.\u201d<a href=\"#_ftn60\" name=\"_ftnref60\"><sup>[59]<\/sup><\/a> On its own, this could mean that assessing the relative \u201ccoercive pressure\u201d at play should be employed as a legal test for whether something has sufficiently \u201cestablished a religion.\u201d Additionally, we might reasonably infer that the reverse is true\u2014or that official establishments of religion necessarily entail some coercive element. Perplexingly, however, despite explicitly acknowledging some degree of interrelationship between \u201cestablishment\u201d and \u201ccoercion,\u201d Justice Black goes on to specify that: \u201cThe Establishment Clause, unlike the Free Exercise Clause, <em>does not<\/em> depend upon any showing of direct governmental compulsion and is violated by the enactment of laws which establish an official religion <em>whether<\/em> those laws operate directly to coerce non-observing individuals <em>or not<\/em>.\u201d<a href=\"#_ftn61\" name=\"_ftnref61\"><sup>[60]<\/sup><\/a> This second statement not only contradicts the first statement by downplaying any interrelatedness between \u201cestablishment\u201d and \u201ccoercion,\u201d but it also lacks concrete historical support from the Founding Era. Recall <em>Engel<\/em>\u2019s assertions that 1) a fully compulsory established church in the United States and in England historically had \u201cincurred the hatred, disrespect and even contempt of those who held contrary beliefs,\u201d and 2) that established churches \u201cgo hand in hand\u201d with religious persecution.<a href=\"#_ftn62\" name=\"_ftnref62\"><sup>[61]<\/sup><\/a> As Professor McConnell points out, \u201c[t]hese facts seem merely to reinforce that compulsion\u2014yes, even persecution\u2014had been an element of the established church as our forefathers knew it.\u201d<a href=\"#_ftn63\" name=\"_ftnref63\"><sup>[62]<\/sup><\/a><\/p>\n\n\n\n<p>On top of lacking historical support, <em>Engel<\/em>\u2019s decision to eschew coercion as a necessary element of any Establishment Clause claim lacked precedent support.<a href=\"#_ftn64\" name=\"_ftnref64\"><sup>[63]<\/sup><\/a> In <em>Cantwell v. Connecticut <\/em>(1940), just 22 years prior to <em>Engel<\/em>, the Court had paraphrased the Establishment Clause as \u201cforestall[ing] compulsion by law of the acceptance of any creed or the practice of any form of worship.\u201d<a href=\"#_ftn65\" name=\"_ftnref65\"><sup>[64]<\/sup><\/a> Making matters even worse, the presence or lack of compulsion had been central to the Court&#8217;s decisions in <em>McCollum v. Board of Education<\/em> (1948)<a href=\"#_ftn66\" name=\"_ftnref66\"><sup>[65]<\/sup><\/a> and <em>Zorach v. Clauson <\/em>(1952),<a href=\"#_ftn67\" name=\"_ftnref67\"><sup>[66]<\/sup><\/a> which concerned release time programs in the public schools. And interestingly, just one year before <em>Engel<\/em>, Chief Justice Warren had actually explained the distinction between Sunday closing laws and the release time program in <em>McCollum<\/em> on the basis that Sunday closing laws did not <em>compel<\/em> religious participation. This indicates that the <em>Engel<\/em> Court conspicuously failed to supply any supporting precedential authority for its radical position.<\/p>\n\n\n\n<p>Thus, by renouncing coercion as a necessary element for establishment, <em>Engel<\/em> relied upon a circular definition for \u201can establishment of religion.\u201d In doing so, <em>Engel <\/em>failed to provide any useful guidance on what <em>actually<\/em> constitutes establishing a religion. The resulting reality is that almost anything can be characterized as an \u201cestablishment\u201d due to the lack of any objective legal test to gauge violations. The consequence is emboldened judges playing the role of policymakers: arbitrarily deciding how and when to advance their agenda\u2014whether it be that of \u201crevisionist secularization\u201d or something else.<a href=\"#_ftn68\" name=\"_ftnref68\"><sup>[67]<\/sup><\/a> It is for this reason that lower courts have since been able \u201creach almost any result in almost any case.\u201d<a href=\"#_ftn69\" name=\"_ftnref69\"><sup>[68]<\/sup><\/a> This all goes to illustrate that <em>Engel<\/em> was \u201cflawed in its fundamentals\u201d and has proven \u201cunworkable in practice.\u201d<a href=\"#_ftn70\" name=\"_ftnref70\"><sup>[69]<\/sup><\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">D.&nbsp;&nbsp;&nbsp; Effect on Other Areas of Law<\/h3>\n\n\n\n<p>Apart from being unworkable, <em>Engel<\/em> has led to the distortion of various legal doctrines. Its uniquely disruptive effect on the law provides further support for overruling this bad precedent.<\/p>\n\n\n\n<p><em>Engel<\/em> has rendered a large chunk of religious liberty jurisprudence incoherent because \u201centanglement\u201d between church and state continues to be permitted by the Court in plenty of other contexts. The Court continues to permit Christian currency inscriptions, inauguration invocations, military chaplainship, public religious displays (including the Ten Commandments and the Cross), federal religious holidays (such as Christmas and National Prayer Day), and the words \u201cone nation, under God\u201d in the Pledge of Allegiance.<a href=\"#_ftn71\" name=\"_ftnref71\"><sup>[70]<\/sup><\/a> Hence <em>Engel<\/em> represents a postmodern departure from the traditional approach to the Establishment Clause known as \u201caccommodationism,\u201d by which the state makes space for religious pluralism in the public sphere without \u2018favoriting\u2019 any one religion.<a href=\"#_ftn72\" name=\"_ftnref72\"><sup>[71]<\/sup><\/a> This incongruence only testifies to the uniquely disruptive effect <em>Engel<\/em> has had upon the rule of law\u2014as <em>Engel<\/em> sticks out as an anomaly (or a \u201cmisadventure\u201d) both relative to the historical lineage of interpreting the Establishment Clause, as well as relative to the present-day landscape of Establishment-Clause-related holdings.<a href=\"#_ftn73\" name=\"_ftnref73\"><sup>[72]<\/sup><\/a><\/p>\n\n\n\n<p><em>Engel<\/em> also distorts some important but unrelated legal doctrines; namely that pertaining to legal standing. Traditionally, federal courts may decide <em>only<\/em> cases and controversies that the Constitution and Congress have authorized them to hear. To establish legal standing, a plaintiff must show: (1) injury-in-fact, (2) causation, and (3) redressability.<a href=\"#_ftn74\" name=\"_ftnref74\"><sup>[73]<\/sup><\/a> Rather than dismissing <em>Engel<\/em>\u2019s appeal on the basis of \u201clack of standing\u201d due to \u201cabsence of injury-in-fact\u201d in accordance with the aforementioned criteria, however, the<em> Engel <\/em>Court mistakenly granted standing to the petitioners on the basis that these parents felt sufficiently \u201coffended\u201d that their children were being exposed to the state-government-approved policy of voluntary nondenominational prayer.<\/p>\n\n\n\n<p>But this \u201coffended observer doctrine,\u201d according to Justice Gorsuch, \u201ccannot be squared with this Court\u2019s [historical] teachings about the limits of Article III.\u201d<a href=\"#_ftn75\" name=\"_ftnref75\"><sup>[74]<\/sup><\/a> Recognizing the distorting effect <em>Engel<\/em> and its progeny had on standing doctrine, Justice Gorsuch asserts that: \u201c[T]his Court has [since <em>Engel<\/em>] rejected the notion that offense alone qualifies as a \u2018concrete and particularized\u2019 injury sufficient to confer standing. We could hardly have been clearer: \u2018The presence of a disagreement, however sharp and acrimonious it may be, is insufficient by itself to meet Article III\u2019s requirements.\u2019\u201d<a href=\"#_ftn76\" name=\"_ftnref76\"><sup>[75]<\/sup><\/a> \u201cOffended observer standing is deeply inconsistent, too, with many other longstanding principles and precedents.\u201d \u201cFor example,\u201d he explained, \u201cthis Court has consistently ruled that \u2018\u201cgeneralized grievances\u201d about the conduct of Government\u2019 are insufficient to confer standing . . . .\u201d<a href=\"#_ftn77\" name=\"_ftnref77\"><sup>[76]<\/sup><\/a> This all goes to show that the <em>Engel<\/em> Court departed from the usual demands of Article III (requiring a real controversy with real impact on real persons to make a federal case out of it), and unwittingly ushered in a new era of standing doctrine premised on arbitrary personal offense.<a href=\"#_ftn78\" name=\"_ftnref78\"><sup>[77]<\/sup><\/a><\/p>\n\n\n\n<p>Thus, despite masquerading as a long overdue First Amendment victory that corrected an obvious violation, <em>Engel<\/em> actually generated far more constitutional questions than it resolved. One of these questions is: does \u201csocial peer pressure\u201d fit under the doctrine of coercion, or does legal \u201ccoercion\u201d only recognize things that are backed with a penalty or threat of force?<a href=\"#_ftn79\" name=\"_ftnref79\"><sup>[78]<\/sup><\/a> Another quandary <em>Engel<\/em> leaves unresolved for other areas of law is whether there exists any meaningful distinction between preteens and teenagers here. After all, if it is indeed true that more mature audiences are less \u201csusceptible\u201d to being \u201cindoctrinated\u201d into religious creeds, then should the Establishment Clause apply more strongly against elementary schools compared to high schools for this reason?<a href=\"#_ftn80\" name=\"_ftnref80\"><sup>[79]<\/sup><\/a> This concern regarding maturity remains uncontended with. And as long as <em>Engel<\/em> remains valid precedent, there will remain little incentive to flesh out this legal ambiguity.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">E.&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;Reliance Interests<\/h3>\n\n\n\n<p>Traditional \u201creliance interests\u201d arise \u201cwhere advance planning of great precision is most obviously a necessity,\u201d according to the Court\u2019s case history.<a href=\"#_ftn81\" name=\"_ftnref81\"><sup>[80]<\/sup><\/a> In <em>Engel<\/em>, however, the majority opinion concedes that those traditional reliance interests are not implicated because the prayer is both \u201cdenominationally neutral\u201d and \u201cvoluntary.\u201d<a href=\"#_ftn82\" name=\"_ftnref82\"><sup>[81]<\/sup><\/a> In other words, if we accept <em>Engel<\/em>\u2019s descriptors, then it is exceedingly difficult to understand why a student would ever need to transfer schools <em>solely<\/em> as a result of their school district voting to reimplement teacher-led prayer, since students presumably 1) recognize the prayer\u2019s inclusive and nonsectarian nature and 2) recognize that they retain the choice to not participate in it. For these reasons, the <em>Engel<\/em> majority was correct that conventional, concrete reliance interests are not present in this case.<\/p>\n\n\n\n<p>Unable to find reliance in the conventional sense, the controlling opinion in <em>Engel<\/em> perceives a far more intangible form of reliance related to America\u2019s national identity: as a nation founded by men fleeing \u201creligions and religious persecution.\u201d<a href=\"#_ftn83\" name=\"_ftnref83\"><sup>[82]<\/sup><\/a> In this way, <em>Engel<\/em> misrepresents the historical purposes behind the First Amendment, which are significantly \u201cmore obscure and complex\u201d than the six justices make them out to be.<a href=\"#_ftn84\" name=\"_ftnref84\"><sup>[83]<\/sup><\/a> The Court explained that the Framers inherited \u201cwell-justified fears . . . arising out of an awareness that governments of the past had shackled men\u2019s tongues to make them speak only the religious thoughts that the government wanted them to speak and to pray only to the God that the government wanted them to pray to.\u201d<a href=\"#_ftn85\" name=\"_ftnref85\"><sup>[84]<\/sup><\/a> By providing this truncated and selective account of the Founding Era zeitgeist (which has since been condemned by scholars as \u201cseriously misleading as a matter of history\u201d), the Court implied that the American citizenry actively relied upon some generalized libertarian notion of \u201cfreedom <em>from <\/em>religion\u201d as citizens conducted their daily lives.<a href=\"#_ftn86\" name=\"_ftnref86\"><sup>[85]<\/sup><\/a> Again, it cannot be overstated that the <em>Engel<\/em> majority \u201cnever analyzed any of the books, essays, sermons, speeches, or judicial opinions setting forth the philosophical and political arguments <em>in favor<\/em> of an establishment of religion, and relied on only one, perhaps unrepresentative, example [\u2018wall of separation\u2019] from among the hundreds of arguments made <em>against<\/em> the establishment.\u201d<a href=\"#_ftn87\" name=\"_ftnref87\"><sup>[86]<\/sup><\/a><\/p>\n\n\n\n<p>As the Court explained in <em>Dobbs,<\/em> it \u201cis ill-equipped to assess \u2018generalized assertions about the national psyche.\u2019\u201d<a href=\"#_ftn88\" name=\"_ftnref88\"><sup>[87]<\/sup><\/a> This tenuous notion of reliance thus finds little support in the Court\u2019s prior holdings, which instead emphasize very concrete reliance interests (like those that develop in cases involving property and contract rights).<a href=\"#_ftn89\" name=\"_ftnref89\"><sup>[88]<\/sup><\/a> Furthermore, \u201cmost members of the founding generation believed deeply that some type of religious conviction was necessary for public virtue, and hence for republican government.\u201d<a href=\"#_ftn90\" name=\"_ftnref90\"><sup>[89]<\/sup><\/a> Consider the Massachusetts Constitution of 1780, which declared that: \u201c[T]he happiness of a people, and the good order and preservation of civil government, essentially depend upon piety, religion and morality . . . .\u201d<a href=\"#_ftn91\" name=\"_ftnref91\"><sup>[90]<\/sup><\/a> In other words, if the so-called \u201cnational psyche\u201d of the American citizenry could be characterized by any single quotation, then the following one would be far more accurate: \u201cWe are a religious people whose institutions presuppose a Supreme Being.\u201d<a href=\"#_ftn92\" name=\"_ftnref92\"><sup>[91]<\/sup><\/a> This all goes to suggest that the United States has a far more robust legal history of religious accommodationism than it does a history of \u201ccomplete and permanent separationism.\u201d Once again, as has been widely alluded to throughout this essay, \u201cthere is no persuasive evidence that the [Founding Fathers themselves] considered evenhanded support for all religions or religion in general . . . an establishment of religion.\u201d<a href=\"#_ftn93\" name=\"_ftnref93\"><sup>[92]<\/sup><\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">III.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;Conclusion<\/h2>\n\n\n\n<p>In summary, <em>Engel <\/em>was egregiously wrong from the start and its freewheeling analysis strayed far outside the bounds of the text, history, and tradition of the Establishment Clause. On top of being wrongly decided, its errant reading of this constitutional provision deepened national division, its reasoning was exceptionally weak, the rules it imposed on the country were imprecise and unworkable, it disrupted other areas of law, and it lacks concrete reliance interests. Thus, <em>Engel<\/em> satisfies all five modern criteria for being overruled. Accordingly, <em>Engel<\/em> should be strategically undermined via appellate litigation until the Court is left with no option but to revert to an earlier, longer-standing line of precedent that better fits with the legal landscape as a whole.<\/p>\n\n\n\n<p>Opposing <em>Engel<\/em> and its progeny does not require one to desire the revival of public school prayer.<a href=\"#_ftn94\" name=\"_ftnref94\"><sup>[93]<\/sup><\/a> Instead, all such opposition requires is the mere recognition that school prayer was never addressed by the text of Constitution or voted upon via the passage of a federal statute. Therefore, States must be permitted to implement nonsectarian public school prayer how they so elect to, out of basic respect for federalism and self-government. Anything short of this constitutes judicial overreach whereby this issue is robbed of a fair hearing before the People.<\/p>\n\n\n\n<p>The most viable pathway to overruling <em>Engel<\/em> is to view <em>Sante Fe<\/em>, <em>Lee<\/em>, and <em>Wallace<\/em> (in that order), each as dominos that may lead to the eventual toppling of <em>Engel<\/em>. With each successful overruling of these more recent public prayer precedents, momentum will build up against <em>Engel<\/em> until a critical mass is reached. It is this point of \u201ccritical mass\u201d that must be arrived at in order for the Court to complete its transition away from its divisive \u201ctop-down theorizing habits\u201d towards a \u201cbottom up approach\u201d that fosters civil disagreement\u2014both between citizens of differing faiths and between States with differing constituencies.<a href=\"#_ftn95\" name=\"_ftnref95\"><sup>[94]<\/sup><\/a><\/p>\n\n\n\n<p>Perhaps this is a long shot, as it would almost certainly be met with fierce opposition both from within the conservative legal movement and from outside (just like any challenge to the \u201cstatus quo\u201d is inevitably met). However, if the path from <em>Roe<\/em> to <em>Dobbs <\/em>teaches us anything at all, it is that we ought to avoid suffering from a \u201cpoverty of political imagination.\u201d<a href=\"#_ftn96\" name=\"_ftnref96\"><sup>[95]<\/sup><\/a> Change really <em>can<\/em> happen. And as the Federalist Society has successfully demonstrated since its inception only 40 years ago, \u201cour political world is far more fluid, malleable, and shapeable through the intentional action of committed political minorities\u201d than we might be ready to admit to ourselves.<a href=\"#_ftn97\" name=\"_ftnref97\"><sup>[96]<\/sup><\/a> Now that <em>Roe<\/em> is finally dead along with the <em>Lemon<\/em> Test, it is time to identify new goals and to galvanize the conservative movement in new directions.
