McWilliam<a href=\"#_ftn1\" name=\"_ftnref1\">*<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Introduction<\/h2>\n\n\n\n<p>The Supreme Court in <em>Bruen<\/em> clarified many of the issues plaguing post-<em>Heller<\/em> Second Amendment doctrine, most notably that the two-step interest balancing test previously accepted by the circuit courts that combined history and means-end scrutiny was contrary to the analysis performed in <em>Heller<\/em>.<a href=\"#_ftn2\" name=\"_ftnref2\">[1]<\/a> Instead, the Court laid forth a different two-step analysis grounded in text and history: \u201cWhen the Second Amendment\u2019s plain text covers an individual\u2019s conduct, the Constitution presumptively protects that conduct. The government must then justify its regulation by demonstrating that it is consistent with the Nation\u2019s historical tradition of firearm regulation.\u201d<a href=\"#_ftn3\" name=\"_ftnref3\">[2]<\/a> However, one remaining question is, post-<em>Bruen<\/em>, what is the relevance of <em>Heller<\/em>\u2019s command that the Second Amendment only protects those weapons \u201cin common use at the time\u201d?<a href=\"#_ftn4\" name=\"_ftnref4\">[3]<\/a><\/p>\n\n\n\n<p>The few courts that have tried to place the common use standard within <em>Bruen<\/em>\u2019s framework have been largely consistent, with a few exceptions. Many courts cite the common use standard as a limitation on the amendment\u2019s plain text and what it \u201cpresumptively protects.\u201d<a href=\"#_ftn5\" name=\"_ftnref5\">[4]<\/a> A recent case from the Ninth Circuit, however, has recognized that considerations of usual-ness belong to an analysis of historical laws, <a href=\"#_ftn6\" name=\"_ftnref6\">[5]<\/a> which occurs <em>after<\/em> determining that the particular weapon being regulated is indeed covered by the plain text of the Second Amendment.<a href=\"#_ftn7\" name=\"_ftnref7\">[6]<\/a> For its part, the Supreme Court has consistently maintained that the common use standard arises from the \u201chistorical tradition of prohibiting the carrying of dangerous and unusual weapons.\u201d<a href=\"#_ftn8\" name=\"_ftnref8\">[7]<\/a> The Court in <em>Bruen<\/em> raised the common use standard in both the textual and historical steps, with relatively little language devoted to it in both instances. Yet the common use standard was born of history, not the text of the Second Amendment, and considerations of historical tradition arise at <em>Bruen<\/em>\u2019s step two, not step one.<\/p>\n\n\n\n<p>Part I of this essay tracks the evolution of the common use standard from <em>Miller<\/em> to post-<em>Bruen<\/em> lower court decisions. Part II then analyzes the relevance of the common use standard to the <em>Bruen<\/em> framework. Ultimately, based on the structure of <em>Bruen<\/em> and the origins of the common use standard, this essay concludes that the common use standard should be considered in <em>Bruen<\/em>\u2019s second step as a part of the government\u2019s presentment of historical analogues.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">I.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; A Brief History of the Common Use Standard<\/h2>\n\n\n\n<p>The common use standard has its roots in the 1939 Supreme Court case of <em>United States v. Miller<\/em>.<a href=\"#_ftn9\" name=\"_ftnref9\">[8]<\/a> In <em>Miller<\/em>, the defendants were charged with possessing a short-barreled shotgun without registering it under the National Firearms Act (\u201cNFA\u201d).<a href=\"#_ftn10\" name=\"_ftnref10\">[9]<\/a> In the beginning of a series of procedural oddities, the government directly appealed the matter to the Supreme Court.<a href=\"#_ftn11\" name=\"_ftnref11\">[10]<\/a> Thereafter, defendants\u2019 counsel received notice that the appeal had been accepted and, without even reading the government\u2019s brief,<a href=\"#_ftn12\" name=\"_ftnref12\">[11]<\/a> suggested that the case be submitted without a brief or argument for the defendants.<a href=\"#_ftn13\" name=\"_ftnref13\">[12]<\/a><\/p>\n\n\n\n<p>In a concise and at points summary opinion, the Court in <em>Miller<\/em> rejected the idea that the Second Amendment precluded the NFA\u2019s regulation of short-barreled shotguns.<a href=\"#_ftn14\" name=\"_ftnref14\">[13]<\/a> In doing so, the Court relied heavily on a consideration of the types of weapons that were useful to a militia.<a href=\"#_ftn15\" name=\"_ftnref15\">[14]<\/a> Because the Court was not under judicial notice that short-barreled shotguns were \u201cany part of the ordinary military equipment or that its use could contribute to the common defense,\u201d it reasoned that they were not protected by the Second Amendment.<a href=\"#_ftn16\" name=\"_ftnref16\">[15]<\/a> To analyze what types of arms would \u201ccontribute to the common defense,\u201d the Court first looked at <em>who<\/em> the militia was, and decided that at the founding, the militia was made up of ordinary citizens.<a href=\"#_ftn17\" name=\"_ftnref17\">[16]<\/a> Next, the Court looked to the types of arms this citizenry-militia would bear\u2014namely, \u201carms supplied by themselves and of the kind <em>in common use at the time<\/em>.\u201d<a href=\"#_ftn18\" name=\"_ftnref18\">[17]<\/a><\/p>\n\n\n\n<p>The Court in <em>District of Columbia v. Heller<\/em><a href=\"#_ftn19\" name=\"_ftnref19\">[18]<\/a> took this \u201ccommon use\u201d language from <em>Miller<\/em> and ran with it.<a href=\"#_ftn20\" name=\"_ftnref20\">[19]<\/a> In <em>Heller<\/em>, the Court considered whether the Second Amendment protected private ownership of handguns in the home.<a href=\"#_ftn21\" name=\"_ftnref21\">[20]<\/a> Relying on <em>Miller<\/em>, the Court rephrased the common use standard, writing that the \u201cSecond Amendment does not protect those weapons not typically possessed by law-abiding citizens for lawful purposes.\u201d<a href=\"#_ftn22\" name=\"_ftnref22\">[21]<\/a> One of these lawful purposes (and the one most relevant for purposes of that case) was self-defense.<a href=\"#_ftn23\" name=\"_ftnref23\">[22]<\/a> Because handguns were \u201coverwhelmingly chosen by American society for\u201d self-defense, the Court reasoned that they were in common use and thus protected by the Second Amendment.<a href=\"#_ftn24\" name=\"_ftnref24\">[23]<\/a> The Court in <em>Heller<\/em> grounded its common use understanding in \u201cthe historical tradition of prohibiting the carrying of dangerous and unusual weapons.\u201d<a href=\"#_ftn25\" name=\"_ftnref25\">[24]<\/a><\/p>\n\n\n\n<p><em>Heller<\/em> left a number of questions relating to the common use standard unresolved. One issue\u2014whether the common use standard was to be applied at the founding or at the time of judicial review<a href=\"#_ftn26\" name=\"_ftnref26\">[25]<\/a>\u2014has all but been resolved in favor of the latter.<a href=\"#_ftn27\" name=\"_ftnref27\">[26]<\/a> Other issues remain salient, however. Some have suggested that the common use standard turns the Second Amendment into a popularity contest, with evolving standards changing the scope of the right.<a href=\"#_ftn28\" name=\"_ftnref28\">[27]<\/a> Relatedly, the common use standard may make judicial review of laws circular. For example, the NFA regulates machine guns, and a court asked to consider the issue would likely uphold this restriction because machine guns are not in common use by the general public. However, given the extreme popularity of the AR-15, its fully automatic cousins the M16 and M4 are likely only not in common use <em>because they are already regulated<\/em> by the NFA. Thus, the regulation becomes self-approving over time.<\/p>\n\n\n\n<p>Fourteen years after <em>Heller<\/em>, <em>New York State Rifle and Pistol Association v. Bruen<\/em> involved a challenge to New York\u2019s may-issue carry licensing regime.<a href=\"#_ftn29\" name=\"_ftnref29\">[28]<\/a> In analyzing the issue, the Supreme Court expanded on <em>Heller<\/em>, clarifying that the appropriate analysis for Second Amendment challenges involves two steps: first, \u201cwhen the Second Amendment\u2019s plain text covers an individual\u2019s conduct, the Constitution presumptively protects that conduct\u201d; and second, to overcome this presumption, \u201cthe government must demonstrate that the regulation is consistent with this Nation\u2019s historical tradition of firearm regulation.\u201d<a href=\"#_ftn30\" name=\"_ftnref30\">[29]<\/a> Notably, \u201ccommon use\u201d is mentioned nowhere in <em>Bruen<\/em>\u2019s general formulation of this test, so what consideration should courts give to the commonality of weapons subject to regulation?<\/p>\n\n\n\n<p>While only a few appeals courts have provided explanations thus far as to how the common use standard fits into <em>Bruen<\/em>\u2019s test, they generally suggest that it fits into the first step of <em>Bruen<\/em> (i.e., they suggest that the plain text of the Second Amendment only presumptively protects arms in common use). For example, in <em>United States v. Rahimi<\/em>, the Fifth Circuit considered whether the federal law prohibiting the possession of firearms by someone subject to a domestic violence restraining order violated the Second Amendment.<a href=\"#_ftn31\" name=\"_ftnref31\">[30]<\/a> When faced with the question of whether the plain text covered the types of weapons Rahimi possessed, the Fifth Circuit wrote that the weapons were \u201cin common use, such that they fall within the scope of the amendment.\u201d<a href=\"#_ftn32\" name=\"_ftnref32\">[31]<\/a> Because they were in common use, the court found <em>Bruen<\/em>\u2019s first step met.<a href=\"#_ftn33\" name=\"_ftnref33\">[32]<\/a> The court then turned to <em>Bruen<\/em>\u2019s second step, and ultimately found that the government failed to offer proper historical analogies to the challenged law.<a href=\"#_ftn34\" name=\"_ftnref34\">[33]<\/a><\/p>\n\n\n\n<p>The Ninth Circuit case of <em>Young v. Hawaii<\/em> involved a challenge to Hawaii\u2019s may-issue carry licensing regime.<a href=\"#_ftn35\" name=\"_ftnref35\">[34]<\/a> While the en banc majority remanded the case to the district court to conduct a <em>Bruen<\/em> analysis, the dissent argued that the court should have answered the question itself, and offered an analysis doing so.<a href=\"#_ftn36\" name=\"_ftnref36\">[35]<\/a> The dissent gave only a brief consideration of <em>Bruen<\/em>\u2019s first step, but importantly noted that \u201chandguns are weapons \u2018in common use\u2019 today for self-defense\u201d before deciding that the right to bear such arms in public was \u201cpresumptively guaranteed\u201d by the Second Amendment.<a href=\"#_ftn37\" name=\"_ftnref37\">[36]<\/a> The dissent went on to find that Hawaii would be unable to meet its burden of historically supporting the challenged licensing regime.<a href=\"#_ftn38\" name=\"_ftnref38\">[37]<\/a><\/p>\n\n\n\n<p>Some federal district courts have also considered the common use standard during step one of <em>Bruen<\/em>. In <em>Renna v. Bonta<\/em>, the Southern District of California considered a challenge to California\u2019s handgun \u201croster\u201d requirements, which prohibited the manufacturing and resale, within the state of California, of a large number of otherwise common handguns.<a href=\"#_ftn39\" name=\"_ftnref39\">[38]<\/a> In concluding that the prohibited handguns fell within the plain text of the Second Amendment, the court rejected arguments that such arms were not in common use.<a href=\"#_ftn40\" name=\"_ftnref40\">[39]<\/a> Only after considering the common use standard did the court turn to the historical analogies of the challenged law. Other district courts have similarly tied the common use standard to the text of the amendment and the first step of <em>Bruen<\/em>.<a href=\"#_ftn41\" name=\"_ftnref41\">[40]<\/a><\/p>\n\n\n\n<p>On the other hand, when Hawaii\u2019s restriction on butterfly knives was challenged in <em>Teter v. Lopez<\/em>, the Ninth Circuit rejected \u201cHawaii\u2019s argument that the purported \u2018dangerous and unusual\u2019 nature of butterfly knives means that they are not \u2018arms\u2019 as that term is used in the Second Amendment.\u201d<a href=\"#_ftn42\" name=\"_ftnref42\">[41]<\/a> Instead, the court acknowledged that \u201c<em>Heller<\/em> itself stated that the relevance of a weapon\u2019s dangerous and unusual character lies in the <em>historical tradition<\/em> of prohibiting the carrying of dangerous and unusual weapons.\u201d<a href=\"#_ftn43\" name=\"_ftnref43\">[42]<\/a> Because Hawaii failed to provide evidence that butterfly knives were uniquely dangerous and were not \u201ccommonly owned for lawful purposes,\u201d<a href=\"#_ftn44\" name=\"_ftnref44\">[43]<\/a> or that they were analogous to any other historical laws, the court concluded that the law violated the Second Amendment.<a href=\"#_ftn45\" name=\"_ftnref45\">[44]<\/a><\/p>\n\n\n\n<p>With the exception of <em>Teter<\/em>, courts appear to be settling into the idea that the common use standard applies at the first step of <em>Bruen<\/em>. It is worth noting, however, that in the cases cited above, the role of the common use test was not dispositive, and so the courts did not need to spend precious time on reasoning for their placement of the standard within <em>Bruen<\/em>\u2019s framework. It was enough that the common use standard was satisfied, regardless of where such an inquiry belonged. Looking to the future, cases may not be quite so clear-cut. Whether the common use standard is a textual inquiry or an historical one may decide the case. With that in mind, the next section suggests that the common use standard is relevant not to a determination of what weapons are presumptively covered by the Second Amendment\u2019s text, but rather to the historical analysis conducted in step two of <em>Bruen<\/em>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">II.&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; The Relevance of \u201cIn Common Use\u201d to <em>Bruen<\/em>\u2019s History and Tradition Test<\/h2>\n\n\n\n<p>As described in Part I above, <em>Bruen<\/em> laid out a two-part test for reviewing Second Amendment challenges. First, conduct is presumptively protected if it is covered by the \u201cplain text\u201d of the amendment.<a href=\"#_ftn46\" name=\"_ftnref46\">[45]<\/a> The government may then rebut that presumption by presenting analogous historical laws to show that the type of regulation is \u201cconsistent with the Nation\u2019s historical tradition of firearm regulation.\u201d<a href=\"#_ftn47\" name=\"_ftnref47\">[46]<\/a> At the same time, <em>Bruen<\/em> acknowledged <em>Heller<\/em>\u2019s finding that the Second Amendment protects weapons \u201cin common use at the time,\u201d as opposed to \u201cdangerous and unusual\u201d weapons.<a href=\"#_ftn48\" name=\"_ftnref48\">[47]<\/a> This presents two possible readings: first, that the plain text of the amendment only covers arms in common use; or second, that there is a tradition of regulating dangerous and unusual weapons such that only those weapons in common use can survive a showing by the government of such a tradition. Let us consider each in turn.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">A.&nbsp;&nbsp;&nbsp; Common Use as a Limitation of the Second Amendment\u2019s Text<\/h3>\n\n\n\n<p>As discussed in Part I, above, some courts appear to be taking the position that the common use standard is a limitation on the types of arms presumptively protected by the Second Amendment. In other words, they interpret the \u201cplain text\u201d of the amendment as excluding arms not in common use. In doing so, they appear to be relying on a number of statements made in <em>Bruen<\/em> and <em>Heller<\/em>.<\/p>\n\n\n\n<p>First, the Court in <em>Bruen<\/em> raised the common use standard at the beginning of its plain text analysis, writing that no party \u201cdispute[s] that handguns are weapons \u2018in common use\u2019 today for self-defense.\u201d<a href=\"#_ftn49\" name=\"_ftnref49\">[48]<\/a> Based on this, it could be inferred that the Court considered such weapons to be the only kinds of \u201carms\u201d that the Second Amendment protects. Other than this one line, however, <em>Bruen<\/em> was unqualified in its description of the first step as one related to the amendment\u2019s <em>plain text<\/em>.<a href=\"#_ftn50\" name=\"_ftnref50\">[49]<\/a> The text of the Second Amendment does not raise the issue of commonality. Instead, as discussed in more detail below, the common use standard arises from the tradition of regulating weapons that could be called \u201cuncommon.\u201d<\/p>\n\n\n\n<p>Next, some courts rely on the statement in <em>Bruen<\/em> that \u201cthe Second Amendment protects only the carrying of weapons that are those \u2018in common use at the time,\u2019 as opposed to those that \u2018are highly unusual in society at large.\u2019\u201d<a href=\"#_ftn51\" name=\"_ftnref51\">[50]<\/a> In a vacuum, this statement, backed up by similarly sweeping statements in <em>Heller<\/em>,<a href=\"#_ftn52\" name=\"_ftnref52\">[51]<\/a> supports the suggestion that the amendment <em>per se <\/em>lacks protection for uncommon arms. However, such a reading takes this statement out of its context in <em>Bruen<\/em>. This line is taken from the portion of <em>Bruen<\/em> that examines the historical analogues presented by the government. The sentence immediately prior discussed how \u201c[a]t most, respondents can show that colonial legislatures sometimes prohibited the carrying of dangerous and unusual weapons.\u201d<a href=\"#_ftn53\" name=\"_ftnref53\">[52]<\/a> The Court then wrote that \u201c[d]rawing from this historical tradition,\u201d the Second Amendment protects weapons in common use, and not those that are highly unusual.<a href=\"#_ftn54\" name=\"_ftnref54\">[53]<\/a> The rest of the paragraph continues with an analysis of historical laws regulating \u201cdangerous and unusual\u201d weapons.<a href=\"#_ftn55\" name=\"_ftnref55\">[54]<\/a><\/p>\n\n\n\n<p>Another statement in <em>Bruen<\/em> that courts have pointed to says that <em>Heller<\/em> \u201cdemands a test rooted in the Second Amendment\u2019s text, as informed by history.\u201d<a href=\"#_ftn56\" name=\"_ftnref56\">[55]<\/a> For example, in <em>Renna<\/em>, the court quoted this line, before writing that \u201c[i]n <em>Bruen<\/em>, the Supreme Court interpreted the Second Amendment in light of \u2018historical tradition\u2019 and held the Amendment protects all arms \u2018in common use\u2019 . . . .\u201d<a href=\"#_ftn57\" name=\"_ftnref57\">[56]<\/a> Because the handguns regulated by the roster requirements were in common use, the court reasoned, they \u201ccategorically are \u2018Arms\u2019 covered by the Second Amendment.\u201d<a href=\"#_ftn58\" name=\"_ftnref58\">[57]<\/a> This insertion of history into the first step of <em>Bruen<\/em>, however, renders the second step superfluous. If the text of the amendment (i.e., \u201cArms\u201d) does not cover weapons that were historically regulated, then the entire step two analysis is simply folded into the meaning of the amendment\u2019s \u201cplain text.\u201d Instead, the description of the <em>Bruen<\/em> test as \u201crooted in the Second Amendment\u2019s text, as informed by history\u201d better describes the test as a whole\u2014it is first based in the plain text of the amendment, which is overcome only by history. This reading is textually supported by the fact that, in <em>Bruen<\/em>, the line is used to compare the proper test with the means-end scrutiny previously employed by the lower courts.<a href=\"#_ftn59\" name=\"_ftnref59\">[58]<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">B.&nbsp;&nbsp;&nbsp;&nbsp; Common Use as an Historical Analogue<\/h3>\n\n\n\n<p>The alternative role of the common use standard is as an historical analogue in step two of <em>Bruen<\/em>. More precisely, the tradition of regulating \u201cdangerous and unusual weapons\u201d may be an historical analogue to modern regulations. From its very inception, the common use standard was tied to this tradition. <em>Miller<\/em> involved the NFA, which \u201caffects weapons which form the arsenal of the gangster and desperado,\u201d<a href=\"#_ftn60\" name=\"_ftnref60\">[59]<\/a> and is prototypical of regulations designed to cover dangerous and unusual weapons.<a href=\"#_ftn61\" name=\"_ftnref61\">[60]<\/a> <em>Heller<\/em> found the common use standard \u201csupported by the historical tradition of prohibiting the carrying of dangerous and unusual weapons.\u201d<a href=\"#_ftn62\" name=\"_ftnref62\">[61]<\/a> <em>Bruen<\/em> also examined common use during its analysis of the relevant historical analogues, finding that historical laws regulating \u201cdangerous and unusual\u201d weapons could not be analogous to the licensing regime\u2019s restriction on carrying handguns, because handguns were \u201cindisputably in common use.\u201d<a href=\"#_ftn63\" name=\"_ftnref63\">[62]<\/a><\/p>\n\n\n\n<p>Under this conception, the Second Amendment would be initially applied according to its plain text, as <em>Bruen<\/em> demanded,<a href=\"#_ftn64\" name=\"_ftnref64\">[63]<\/a> with \u201carms\u201d meaning any bearable weapon. This is consistent with <em>Heller<\/em>\u2019s acknowledgement that \u201cthe Second Amendment extends, prima facie, to all instruments that constitute bearable arms, even those that were not in existence at the time of the founding.\u201d<a href=\"#_ftn65\" name=\"_ftnref65\">[64]<\/a> Then, the government could present historical analogues to rebut this prima facie presumption.<a href=\"#_ftn66\" name=\"_ftnref66\">[65]<\/a> These historical analogues might take a number of forms, depending on the law at issue, one of which could be those historical laws regulating dangerous and unusual weapons.<\/p>\n\n\n\n<p>It could be argued that the distinction argued for here would have little practical effect. After all, if a weapon is dangerous and unusual, it might be unprotected no matter which way the common use standard is folded into the <em>Bruen<\/em> test. Under the conception described in Part II.A., as used by the courts, it would be found not in common use, and thus not even entitled to a presumption of protection at step one. Under that put forth in Part II.B., the law could be found consistent with the tradition of regulating such arms. Either way, the challenged law survives.<\/p>\n\n\n\n<p>There are, however, some key practical differences. The first is who bears the burden with respect to a weapon\u2019s commonality. If the common use standard arises at step one, then the challenger must show that the weapon is in common use, and thus covered by the amendment\u2019s plain text.<a href=\"#_ftn67\" name=\"_ftnref67\">[66]<\/a> If it arises at step two, the government must show that the law is consistent with the historical laws that regulated dangerous and unusual weapons.<a href=\"#_ftn68\" name=\"_ftnref68\">[67]<\/a> The Ninth Circuit illustrated this well in <em>Teter<\/em>, when it placed the burden of proof on Hawaii to show that butterfly knives were dangerous and unusual.<a href=\"#_ftn69\" name=\"_ftnref69\">[68]<\/a> The second difference is in the actual analysis that is undertaken. When the common use standard is applied to limit the text of the amendment, courts generally undertake a quantitative analysis as to the popularity of the weapon.<a href=\"#_ftn70\" name=\"_ftnref70\">[69]<\/a> When analogizing to laws applied to dangerous and unusual weapons, on the other hand, the analysis should be more nuanced,<a href=\"#_ftn71\" name=\"_ftnref71\">[70]<\/a> involving both the weapon\u2019s prevalence and its dangerousness.<a href=\"#_ftn72\" name=\"_ftnref72\">[71]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p><em>Bruen<\/em> raised the common use standard in both its analysis of the Second Amendment\u2019s plain text and its review of analogous historical laws.<a href=\"#_ftn73\" name=\"_ftnref73\">[72]<\/a> So what role does it play in a Second Amendment analysis after <em>Bruen<\/em>? Having reviewed the history of the common use standard and compared the alternative methods of placing it within <em>Bruen<\/em>\u2019s two-step framework, this essay concludes that the proper method for evaluating restrictions on uncommon arms is the following. First, if the weapon is covered by the <em>plain text<\/em> of the Second Amendment\u2014meaning any bearable arm<a href=\"#_ftn74\" name=\"_ftnref74\">[73]<\/a>\u2014then it is presumptively protected by the amendment. The government then bears the burden of showing that the challenged law fits within our historical tradition\u2014namely, for these purposes, the \u201ctradition of prohibiting the carrying of dangerous and unusual weapons.\u201d<a href=\"#_ftn75\" name=\"_ftnref75\">[74]<\/a> This runs contrary to much post-<em>Bruen<\/em> caselaw at the circuit and district court levels, which finds that the plain text of the amendment only applies to weapons in common use. Interestingly, the Third Circuit Court of Appeals, sitting en banc in the case of <em>Range v. Att\u2019y Gen. United States of Am.<\/em>, made an analogous argument. 69 F.4th 96, 101 (3d. Cir. 2023). There, the court considered the issue of felon disarmament. While the Supreme Court in <em>Heller<\/em> wrote that \u201cthe Second Amendment does not protect those weapons not typically possessed by law-abiding citizens for lawful purposes,\u201d <em>Heller<\/em>, 554 U.S. at 625, Judge Hardiman made the following observation: \u201cIn isolation, this language seems to support the Government\u2019s argument. But <em>Heller<\/em> said more; it explained that \u2018the people\u2019 as used throughout the Constitution \u2018unambiguously refers to all members of the political community, not an unspecified subset.\u2019 So the Second Amendment right, <em>Heller<\/em> said, presumptively \u2018belongs to all Americans.\u2019\u201d <em>Range<\/em>, 69 F.4th at 101 (internal citations omitted). The Third Circuit found that <em>Heller<\/em>\u2019s specific claim about the scope of the people protected\u2014all members of the political community\u2014controlled over its general statement regarding law-abiding citizens. Similarly, <em>Heller<\/em>\u2019s specific statement that \u201carms\u201d refers to all bearable arms should control over its general one regarding weapons \u201ctypically possessed.\u201d<\/p>\n\n\n\n<p><a href=\"#_ftnref66\" name=\"_ftn66\">[65]<\/a> <em>See Bruen<\/em>, 597 U.S. at 15.<\/p>\n\n\n\n<p><a href=\"#_ftnref67\" name=\"_ftn67\">[66]<\/a> <em>See <\/em>Delaware State Sportsmen\u2019s Ass\u2019n, Inc. v. The difference in analysis between step one and step two could be even larger if, as some have suggested, the category of prohibitions on dangerous and unusual weapons \u201creferred to the carrying of certain arms in a manner that terrified the people, such as by creating an affray,\u201d rather than simply characteristics of the weapons themselves. Others have suggested that <em>Heller<\/em>\u2019s declaration that the \u201cSecond Amendment does not protect those weapons not typically possessed by law-abiding citizens for lawful purposes\u201d could provide guidance for analysis under the dangerous and unusual standard.
