Smith<a href=\"#_ftn1\" name=\"_ftnref1\"><strong>[*]<\/strong><\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Introduction<\/h2>\n\n\n\n<p>In the year since <em>New York State Rifle &amp; Pistol Association v. Bruen<\/em><a href=\"#_ftn2\" name=\"_ftnref2\">[2]<\/a> was decided, a line of argument has developed in the lower courts that effectively seeks to relitigate and nullify <em>District of Columbia v. Heller<\/em>.<a href=\"#_ftn3\" name=\"_ftnref3\">[3]<\/a><\/p>\n\n\n\n<p><em>Heller<\/em> established the constitutional test to determine what arms are protected by the Second Amendment. After examining the text of the Second Amendment, as illuminated by history, <em>Heller<\/em> determined that bearable arms that are \u201cin common use\u201d today are constitutionally protected and cannot be banned.<a href=\"#_ftn4\" name=\"_ftnref4\">[4]<\/a><\/p>\n\n\n\n<p>To circumvent <em>Heller<\/em>, government litigants, their amici, and some lower courts have seized upon a single sentence in <em>Bruen<\/em> that states that \u201c[w]hile the historical analogies here and in <em>Heller <\/em>are relatively simple to draw, other cases implicating <em>unprecedented societal concerns<\/em> or <em>dramatic technological changes<\/em> may require a <em>more nuanced<\/em> approach.\u201d<a href=\"#_ftn5\" name=\"_ftnref5\">[5]<\/a> Gun-control proponents claim that improvements in firearms technology, such as the development of semiautomatic weapons, are \u201cdramatic technological changes\u201d and that mass shootings are \u201cunprecedented societal concerns\u201d that did not exist at the Founding. According to some courts, these changes and concerns justify bans on so-called \u201cassault weapons\u201d and what are mislabeled \u201clarge capacity magazines.\u201d<a href=\"#_ftn6\" name=\"_ftnref6\">[6]<\/a><\/p>\n\n\n\n<p>That contention is wrong because <em>Heller<\/em>\u2019s \u201cin common use\u201d test governs in all arms-ban cases including \u201cassault weapon\u201d bans, \u201clarge capacity magazine\u201d bans, and non-roster handgun bans. The language from <em>Bruen<\/em> regarding technological changes and societal concerns is not a legal <em>test<\/em> that governs decisions either in arms-ban cases or in non-arms-ban cases. It is part of a description of the <em>methodology<\/em> that <em>Bruen<\/em> lays out for lower courts in deciding \u201cother cases\u201d not governed by <em>Heller<\/em>\u2019s \u201cin common use\u201d test or by <em>Bruen<\/em>\u2019s actual decision regarding restrictive, discretionary licensing systems regulating the public carry of arms.<\/p>\n\n\n\n<p>Just as generations of Latin students learned that \u201cAll Gaul is divided into three parts,\u201d<a href=\"#_ftn7\" name=\"_ftnref7\">[7]<\/a> all Second Amendment cases after <em>Heller<\/em> and <em>Bruen <\/em>are divided into two categories: 1)&nbsp;laws that ban the possession or sale of particular arms (or the components required for them to function),<a href=\"#_ftn8\" name=\"_ftnref8\">[8]<\/a> or 2)&nbsp;laws that otherwise regulate the sale or use of arms without banning particular weapons.<a href=\"#_ftn9\" name=\"_ftnref9\">[9]<\/a> Cases in the first category are directly controlled by <em>Heller <\/em>and its test for arms bans. Cases in the second category are not.<\/p>\n\n\n\n<p>In arms-ban cases, <em>Heller<\/em>\u2019s \u201cin common use\u201d constitutional <em>test<\/em> controls, and there is nothing for the lower courts to do except apply that <em>test<\/em> to the facts at issue. In other, non-ban cases, the <em>methodology<\/em> described in <em>Bruen<\/em> must be followed to arrive at a <em>test<\/em> that provides the rule for deciding that case and similar cases.<a href=\"#_ftn10\" name=\"_ftnref10\">[10]<\/a> It is only in the second, non-arms ban category of cases that \u201cunprecedented societal concerns\u201d and \u201cdramatic technological changes\u201d might have some application. But that language is not itself a <em>test, <\/em>and it is irrelevant in arms-ban cases.<\/p>\n\n\n\n<p>The <em>Heller<\/em> test looks at what arms are \u201cin common use\u201d today, not in the past. If semiautomatic rifles and handguns that accept detachable magazines are in common use today, they are protected. Their ubiquity, and their being \u201cin common use,\u201d confirms their protected status under the Second Amendment.<\/p>\n\n\n\n<p>Such arms cannot be banned simply because they employ technology that some legislators or judges think is too dangerous. When <em>Heller<\/em> was before the Court, the parties and their amici presented arguments concerning the alleged exceptional \u201cdangerousness\u201d of modern firearms (in that case, handguns).<a href=\"#_ftn11\" name=\"_ftnref11\">[11]<\/a> After considering these arguments, the Supreme Court adopted the \u201cin common use\u201d test without any exceptions for weapons that are allegedly too dangerous.<\/p>\n\n\n\n<p>Likewise, parties also presented arguments concerning \u201cunprecedented societal concerns\u201d to the <em>Heller<\/em> Court.<a href=\"#_ftn12\" name=\"_ftnref12\">[12]<\/a> The Court adopted the \u201cin common use\u201d test without any limitation based on these allegedly unprecedented concerns.<\/p>\n\n\n\n<p>Nevertheless, some post-<em>Bruen<\/em> courts have utterly disregarded the Supreme Court\u2019s binding precedent in <em>Heller<\/em> governing what arms are protected. Having lifted language about \u201cunprecedented societal concerns\u201d and \u201cdramatic technological changes\u201d from <em>Bruen<\/em>\u2019s description of the <em>methodology<\/em> for non-arms-ban cases, some courts, as discussed below, have refused to apply <em>Heller<\/em>\u2019s binding test. Instead, these courts conduct their own historical analyses to determine what arms are protected and formulate new tests that are contrary to <em>Heller<\/em>. Under such tests, lower courts have held that arms that are \u201cexceptionally dangerous\u201d or \u201cparticularly dangerous\u201d\u2014such as \u201cassault weapons\u201d\u2014may be banned, even though they are unquestionably \u201cin common use.\u201d<a href=\"#_ftn13\" name=\"_ftnref13\">[13]<\/a> In doing so, these courts have not only refused to apply binding Supreme Court precedent but have also resurrected the discredited \u201cinterest balancing tests\u201d rejected in <em>Heller<\/em> and expressly abrogated in <em>Bruen<\/em>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">I. <em>Heller\u2019s<\/em> \u201cin common use\u201d test was reaffirmed in <em>Bruen <\/em>and governs in arms-ban cases.<\/h2>\n\n\n\n<p><em>Heller<\/em> was an arms-ban case. The District of Columbia had imposed a ban on the possession of handguns, with only minor exceptions.<a href=\"#_ftn14\" name=\"_ftnref14\">[14]<\/a> The <em>Heller<\/em> Court, therefore, had to decide whether handguns fell within the scope of the Second Amendment\u2019s protection of \u201carms,\u201d and thus could not be banned. To do that, the Court first had to decide the constitutional test for determining whether a class of arms is protected by the Second Amendment, and then determine whether that protection extended to the kind of arm at issue in the case.<\/p>\n\n\n\n<p>The <em>Heller<\/em> Court applied the methodology later explicitly spelled out in <em>Bruen<\/em> to decide the appropriate constitutional test.<a href=\"#_ftn15\" name=\"_ftnref15\">[15]<\/a> That methodology starts with evaluating the plain text of the Second Amendment. The plain text of the Second Amendment is clear\u2014it protects the right to \u201ckeep and bear arms.\u201d<a href=\"#_ftn16\" name=\"_ftnref16\">[16]<\/a> Because it is the right to keep <em>and bear <\/em>arms, that implies one limitation of the right\u2014the arms it protects must be \u201cbearable.\u201d<a href=\"#_ftn17\" name=\"_ftnref17\">[17]<\/a> And what are arms? \u201cWeapons of offence, or armour of defence\u201d; in other words, \u201cany thing that a man wears for his defence, or takes into his hands or useth in wrath to cast at or strike another.\u201d<a href=\"#_ftn18\" name=\"_ftnref18\">[18]<\/a> The plain text of the Second Amendment thus has an expansive scope: \u201cthe Second Amendment extends, <em>prima facie<\/em>, to all instruments that constitute bearable arms, even those that were not in existence at the time of the founding.\u201d<a href=\"#_ftn19\" name=\"_ftnref19\">[19]<\/a> Moreover, the term \u201carms\u201d includes \u201cmodern instruments that facilitate armed self-defense.\u201d<a href=\"#_ftn20\" name=\"_ftnref20\">[20]<\/a><\/p>\n\n\n\n<p><em>Heller <\/em>also indicated that the Second Amendment\u2019s protection, like that of other constitutional rights, is \u201cnot unlimited.\u201d<a href=\"#_ftn21\" name=\"_ftnref21\">[21]<\/a> Although those in support of arms bans quote that language as a talisman, the statement is really an unremarkable observation about constitutional law. The Court read <em>United States v. Miller<\/em><a href=\"#_ftn22\" name=\"_ftnref22\">[22]<\/a> as recognizing that \u201cthe Second Amendment extends only to certain types of weapons.\u201d<a href=\"#_ftn23\" name=\"_ftnref23\">[23]<\/a> When it came to consider \u201cwhat types of weapons <em>Miller<\/em> permits,\u201d the Court noted that \u201c<em>Miller<\/em> said \u2026 that the sorts of weapons protected were those \u2018in common use at the time.\u2019\u201d<a href=\"#_ftn24\" name=\"_ftnref24\">[24]<\/a> The Court identified one and only one historical tradition that could fairly support a ban on possession of a type of arm: \u201cthe historical tradition of prohibiting the carrying of \u2018dangerous and unusual weapons.\u2019\u201d<a href=\"#_ftn25\" name=\"_ftnref25\">[25]<\/a> This limitation dovetailed with the historical practice of the militia bringing \u201cthe sorts of lawful weapons that they possessed at home to militia duty\u201d; <em>i.e.<\/em>, weapons that were \u201cin common use at the time.\u201d<a href=\"#_ftn26\" name=\"_ftnref26\">[26]<\/a><\/p>\n\n\n\n<p>These passages, taken together, established a <em>constitutional test<\/em> for determining what kinds of arms are protected under the Second Amendment. In more formal language, <em>Heller<\/em> established the <em>rule of decision<\/em> for arms-ban cases: that is, the legal principle governing judicial decision-making in cases of a particular kind.<a href=\"#_ftn27\" name=\"_ftnref27\">[27]<\/a> The general rule of decision embraced in <em>Heller <\/em>is that arms \u201cin common use\u201d are protected by the Second Amendment and cannot be banned. That is the legal test in a Second Amendment challenge to an arms ban. The Court then applied that constitutional test or rule of decision to the facts presented by <em>Heller<\/em> and held that because handguns are \u201cin common use,\u201d handguns cannot be banned.<\/p>\n\n\n\n<p><em>Heller <\/em>remains good law and provides the binding rule of decision in arms-ban cases.<a href=\"#_ftn28\" name=\"_ftnref28\">[28]<\/a> When the modern-day regulation seeks to ban a type of arm, the <em>Heller <\/em>test controls. Far from undermining or altering <em>Heller<\/em>, <em>Bruen <\/em>reinforced it, stating expressly that <em>Heller <\/em>found that \u201cthe Second Amendment protects the possession and use of weapons that are in common use.\u201d<a href=\"#_ftn29\" name=\"_ftnref29\">[29]<\/a> And <em>Bruen<\/em> added that \u201ceven though the Second Amendment\u2019s definition of \u2018arms\u2019 is fixed according to its historical understanding, that general definition covers modern instruments that facilitate armed self-defense.\u201d<a href=\"#_ftn30\" name=\"_ftnref30\"><sup>[30]<\/sup><\/a><\/p>\n\n\n\n<p>In its discussion of historical analogues, <em>Bruen<\/em> was merely describing, for the benefit of litigants and lower courts, the <em>methodology <\/em>that should be followed in future <em>non-<\/em>arms-ban cases, so that courts could perform the proper analysis in those cases. Only in non-arms-ban cases might the societal concerns and technological changes have some relevance. But such concerns and changes do not create an exception to <em>Heller<\/em>\u2019s \u201cin common use\u201d test or allow that test to be cast aside. The <em>Heller <\/em>test is not an exception to the <em>Bruen <\/em>methodology, but rather the <em>result <\/em>of the Court\u2019s application of that same \u201ctext and historical tradition\u201d methodology to the facts in <em>Heller<\/em>. <em>Bruen<\/em> merely described for lower courts how to apply that methodology in types of Second Amendment cases yet to be decided. Arms-ban cases are not such cases, for <em>Heller<\/em> already has decided that the \u201cin common use\u201d test governs.<\/p>\n\n\n\n<p>Straightforward application of the \u201cin common use\u201d test should lead courts to strike down bans on \u201cassault weapons\u201d and on \u201clarge capacity magazines\u201d because those arms and magazines are unquestionably in common use.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">II. <em>Bruen <\/em>described the methodology to be followed in cases in which <em>Heller<\/em> does not establish the rule of decision.<\/h2>\n\n\n\n<p><em>Heller<\/em>\u2019s \u201cin common use\u201d test is of little, if any, relevance in Second Amendment cases in which the question presented is not whether a particular arm is protected, but some other issue regarding the possession or use of arms.<\/p>\n\n\n\n<p>Because the lower courts had largely misapplied <em>Heller <\/em>for fourteen years, the <em>Bruen<\/em> Court felt compelled to explain exactly how an originalist approach should proceed in non-arms-ban cases in the future. The Supreme Court used <em>Bruen<\/em> as a teaching tool for lower courts that failed to follow the clear originalist methodology demonstrated in <em>Heller<\/em>. But <em>Bruen<\/em> first had to clear away the underlying mistakes made by the lower courts. No, <em>Bruen <\/em>said, there is no two-step test, in which Second Amendment rights could be, and nearly always were, eliminated by intermediate scrutiny \u201cinterest balancing.\u201d<a href=\"#_ftn31\" name=\"_ftnref31\">[31]<\/a> No, <em>Bruen <\/em>said, addressing the specific issue before the Court, Second Amendment rights are not a privilege that can be denied to almost everyone through a restrictive, discretionary licensing system that requires a showing of \u201cproper cause\u201d (that is, a special need) to obtain a license.<a href=\"#_ftn32\" name=\"_ftnref32\">[32]<\/a><\/p>\n\n\n\n<p>Having done away with these past errors, <em>Bruen<\/em> then outlined how lower courts should conduct an originalist analysis in non-arms-ban cases. Courts should begin with an examination of the plain text of the Second Amendment as it bears on the question under consideration.<\/p>\n\n\n\n<p>In keeping with <em>Heller<\/em>, we hold that when the Second Amendment\u2019s plain text covers an individual\u2019s conduct, the Constitution presumptively protects that conduct. To justify its regulation, the government may not simply posit that the regulation promotes an important interest. Rather, the government must demonstrate that the regulation is consistent with this Nation\u2019s historical tradition of firearm regulation. Only if a firearm regulation is consistent with this Nation\u2019s historical tradition may a court conclude that the individual\u2019s conduct falls outside the Second Amendment\u2019s \u201cunqualified command.\u201d<a href=\"#_ftn33\" name=\"_ftnref33\">[33]<\/a><\/p>\n\n\n\n<p>Note that this is not itself a test or a rule of decision. This is instead a <em>description<\/em> of a <em>methodology<\/em> that a court must employ to <em>arrive at<\/em> a <em>rule of decision<\/em> comparable to the \u201cin common use\u201d test that <em>Heller <\/em>ultimately arrived at for arms-ban cases. <em>Bruen <\/em>expressly tied this methodology to the approach the Court had followed in <em>Heller<\/em>; hence, <em>Bruen<\/em>\u2019s phrase \u201cin keeping with <em>Heller<\/em>.\u201d In explaining why the two-step approach previously employed by the lower courts must be rejected, the <em>Bruen<\/em> court \u201csummarize[d] <em>Heller<\/em>\u2019s methodological approach to the Second Amendment.\u201d<a href=\"#_ftn34\" name=\"_ftnref34\">[34]<\/a> That summary showed that <em>Heller<\/em>\u2019s methodological approach, even though not made so explicit, was the same as the methodology described in <em>Bruen<\/em>. Indeed, in explaining and exemplifying a methodology for Second Amendment cases to come, <em>Bruen<\/em> bolstered <em>Heller<\/em>\u2019s approach and constitutional test. <em>Bruen<\/em> not only described the methodology to be applied, but also served as its own example of how the text-and-historical-tradition methodology is to be applied by the lower courts\u2014i.e., <em>Bruen<\/em> showed by practice how to do what it and <em>Heller<\/em> preached.<\/p>\n\n\n\n<p>Having explained the ways in which the lower courts had gone wrong under <em>Heller<\/em>, <em>Bruen <\/em>then went on to prescribe in detail how <em>Heller<\/em>\u2019s methodology should be implemented in other cases by use of historical analogues. That methodology for the future included observations about three situations in which the presence or absence of analogues might suggest the unconstitutionality of a present-day law,<a href=\"#_ftn35\" name=\"_ftnref35\">[35]<\/a> a discussion of reasoning by analogy and when two laws may be \u201crelevantly similar,\u201d<a href=\"#_ftn36\" name=\"_ftnref36\">[36]<\/a> two important \u201cmetrics\u201d for comparing analogues,<a href=\"#_ftn37\" name=\"_ftnref37\">[37]<\/a> and related matters.<\/p>\n\n\n\n<p>It is deep within this discussion of analogues that <em>Bruen<\/em> noted that, unlike the relatively straightforward analogues in <em>Heller<\/em> and in <em>Bruen<\/em> itself, there might be circumstances in \u201c<em>other cases<\/em>\u201d in which \u201c<em>unprecedented societal concerns<\/em> or <em>dramatic technological changes<\/em> may require a <em>more nuanced<\/em> approach.\u201d<a href=\"#_ftn38\" name=\"_ftnref38\">[38]<\/a> But this consideration comes into play only when a court is engaged in examining analogues in non-arms-ban cases for which <em>Heller<\/em> does not provide the binding rule of decision<em>. Bruen <\/em>acknowledges that in these \u201cother,\u201d non-arms-ban cases some questions may require a \u201cmore nuanced\u201d approach to the use of historical analogues than the relatively easy questions presented in <em>Heller<\/em> and <em>Bruen.<\/em> Because <em>Bruen<\/em>\u2019s discussion of societal concerns and technological changes applies only in non-arms-ban cases, arguments about alleged societal concerns and technological changes are not relevant in arms-ban cases because <em>Heller <\/em>provides the relevant legal test.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">III. The <em>Heller<\/em> \u201cin common use\u201d test already accounts for technological changes and societal concerns arising from those changes by providing Second Amendment protection to arms \u201cin common use\u201d today.<\/h2>\n\n\n\n<p>A common argument raised in support of \u201cassault weapon\u201d bans is that due to alleged \u201cdramatic technological changes\u201d so-called \u201cassault weapons\u201d and \u201clarge capacity magazines\u201d are more lethal than previous kinds of firearms, and lead to increased mortality in mass shootings. But that argument is misplaced for many reasons.<\/p>\n\n\n\n<p>First, the Supreme Court has been aware of such contentions throughout the development of its Second Amendment jurisprudence. In the 2010 <em>McDonald<\/em> case, some respondents had urged that the \u201cSecond Amendment differs from all of the other provisions of the Bill of Rights because it concerns the right to possess a deadly implement and thus has implications for public safety.\u201d<\/p>\n\n\n\n<p>But the Supreme Court dismissed this assertion by correctly noting that:<\/p>\n\n\n\n<p>The right to keep and bear arms, however, is not the only constitutional right that has controversial public safety implications. All of the constitutional provisions that impose restrictions on law enforcement and on the prosecution of crimes fall into the same category.<a href=\"#_ftn39\" name=\"_ftnref39\">[39]<\/a><\/p>\n\n\n\n<p>Second, briefing in <em>Heller<\/em> pointed out the alleged exceptionally dangerous nature of handguns, the rise of mass shootings, and similar concerns about violence and public safety. Ironically, when <em>Heller <\/em>was briefed in 2008, the District of Columbia and its amici argued that <em>handguns<\/em> were particularly dangerous and lethal, while there were few, if any, mentions of <em>rifles<\/em> such as \u201cassault weapons\u201d being \u201cespecially dangerous.\u201d In <em>Heller<\/em>, the District argued that its handgun ban \u201cdo[es] not disarm the District\u2019s citizens, who may still possess operational rifles and shotguns.\u201d<a href=\"#_ftn40\" name=\"_ftnref40\"><sup>[40]<\/sup><\/a> It further argued that \u201cthe [D.C.] Council . . . adopted a focused statute that continues to allow private home possession of shotguns and rifles, which some gun rights\u2019 proponents contend are actually the weapons of choice for home defense.\u201d<a href=\"#_ftn41\" name=\"_ftnref41\"><sup>[41]<\/sup><\/a> Today, gun ban advocates argue that so-called \u201cassault rifles\u201d are unusually dangerous and must be banned.<\/p>\n\n\n\n<p>While the public policy arguments based on \u201cdangerousness\u201d that were briefed in <em>Heller<\/em> cannot be listed comprehensively here, the following are a few examples:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201cIn the recent Virginia Tech shooting, a single student with two handguns discharged over 170 rounds in nine minutes, killing 32 people and wounding 25 more.\u201d<a name=\"_ftnref42\" href=\"#_ftn42\">[42]<\/a><\/li>\n\n\n\n<li>\u201cWhen more rounds are fired and guns can be more quickly reloaded, the likelihood of inflicting wounds, and the severity of the resulting injuries, increases. This unfortunate fact is illustrated all too often in mass shootings in America\u2019s schools, malls, places of worship, and other public arenas.\u201d<a name=\"_ftnref43\" href=\"#_ftn43\">[43]<\/a><\/li>\n\n\n\n<li>\u201cHandguns also are used in an extraordinary percentage of this country\u2019s well-publicized shootings, including the large majority of mass shootings. A review of 50 high-profile shootings over the past four decades revealed that from 1980 onward the bulk of such incidents (39) were mass shootings. A handgun was used in 74 percent of these mass shootings as the only or primary weapon.\u201d<a name=\"_ftnref44\" href=\"#_ftn44\">[44]<\/a><\/li>\n\n\n\n<li>\u201cThe [D.C.] Council targeted handguns because they are disproportionately linked to violent and deadly crime&#8230;. [The Council found that] \u2018handguns are used in roughly 54% of all murders, 60% of robberies, 26% of assaults and 87% of all murders of law enforcement officials.\u2019 Handguns were also particularly deadly in other contexts: \u2018A crime committed with a pistol is 7 times more likely to be lethal than a crime committed with any other weapon.\u2019\u201d<a name=\"_ftnref45\" href=\"#_ftn45\">[45]<\/a><\/li>\n\n\n\n<li>\u201cThe District considered evidence indicating that murders, robberies, and assaults were more likely to be committed with a handgun. Based on this evidence, the District concluded that handguns were <em>uniquely dangerous<\/em> and that it was necessary to prohibit the possession and use of such guns, while still permitting access to other weaponry if licensed and stored safely.\u201d<a name=\"_ftnref46\" href=\"#_ftn46\">[46]<\/a><\/li>\n\n\n\n<li>\u201cHandguns for the civilian market now fire ammunition capable of piercing <em>body armor<\/em>\u2014the last line of defense responsible for saving thousands of police officers\u2019 lives.\u201d<a name=\"_ftnref47\" href=\"#_ftn47\">[47]<\/a><\/li>\n<\/ul>\n\n\n\n<p>Arguments that certain firearms must be banned because of alleged technological changes or social problems are not new. As illustrated above, those same arguments were made to the Supreme Court about handguns in <em>Heller<\/em>. Parties supporting the District of Columbia\u2019s handgun ban in <em>Heller<\/em> focused a great deal on societal problems such as the criminal misuse of the firearms, mass shootings, and the allegedly dramatic technological developments in firearms that supposedly created or exacerbated these problems. The only difference between those arguments in <em>Heller<\/em> and the arguments today is that those made in 2008 concerned the \u201cuniquely\u201d dangerous nature of modern handguns in relation to societal problems. Now, those very arguments are being advanced against modern rifles and magazines, <em>i.e<\/em>., so-called \u201cassault rifles\u201d and \u201clarge capacity magazines,\u201d with no substantive difference. In short, arms-ban advocates switched their pre-<em>Heller<\/em> strategy of \u201crifles good, handguns bad\u201d to a post-<em>Heller<\/em> strategy of \u201chandguns good, rifles bad.\u201d If those arguments failed to persuade the Supreme Court in <em>Heller<\/em> to rule against handguns, they can\u2019t work against rifles\u2014the criminal misuse of handguns is orders of magnitude higher than the criminal misuse of rifles.<\/p>\n\n\n\n<p>After <em>Heller<\/em>, these arguments against \u201cassault weapons\u201d and \u201clarge capacity magazines\u201d were again advanced under the now-discredited two-step interest balancing test that was erroneously adopted by many courts post-<em>Heller<\/em>.<a href=\"#_ftn48\" name=\"_ftnref48\">[48]<\/a> The <em>Heller<\/em> test does not involve weighing the dangers and benefits of weapons, but instead asks only whether they are \u201cin common use\u201d at the present time.<a href=\"#_ftn49\" name=\"_ftnref49\">[49]<\/a><\/p>\n\n\n\n<p>Recent decisions by courts post-<em>Bruen<\/em> seek to get around <em>Heller<\/em>\u2019s \u201cin common use\u201d test by ignoring <em>Heller<\/em> and then smuggling in dangerousness arguments under the guise of historical analogues. Arguments about \u201cdramatic technological changes\u201d cannot affect the \u201cin common use\u201d test mandated by <em>Heller<\/em>. That is because the \u201cin common use\u201d test looks at arms that are in common use by Americans <em>now,<\/em> and that necessarily includes any modern or new technology which those firearms use. Even though technology may have changed or improved over time, any form of modern firearm technology that is currently \u201cin common use\u201d is constitutionally protected.<a href=\"#_ftn50\" name=\"_ftnref50\">[50]<\/a><\/p>\n\n\n\n<p>As the <em>Bruen<\/em> Court explained, even if a state could identify historical \u201claws [that] prohibited the carrying of handguns because they were considered \u2018dangerous and unusual weapons\u2019\u201d at that time, that would \u201cprovide no justification for laws restricting the public carry of weapons that are unquestionably in common use today.\u201d<a href=\"#_ftn51\" name=\"_ftnref51\">[51]<\/a> With this language, <em>Bruen<\/em> reaffirmed the test <em>Heller<\/em> prescribes for identifying protected arms, which already and necessarily accounts for technological changes and societal concerns allegedly caused by those changes; it does this by ensuring that the Second Amendment\u2019s protection extends to all firearms that are in common use at the time a court conducts the \u201cin common use\u201d analysis\u2014even if such firearms or such firearms technology were not in common use at some time in the past.<\/p>\n\n\n\n<p>Because the \u201cin common use\u201d test looks at contemporary firearms and thus firearms technology in existence today,<a href=\"#_ftn52\" name=\"_ftnref52\">[52]<\/a> there is no justification for trying to limit the technology<a href=\"#_ftn53\" name=\"_ftnref53\">[53]<\/a> available to civilian possession of arms to some indefinite point in the past. <em>Heller<\/em> made this point explicitly, stating that \u201c[s]ome have made the argument, bordering on the frivolous, that only those arms in existence in the 18th century are protected by the Second Amendment.\u201d<a href=\"#_ftn54\" name=\"_ftnref54\">[54]<\/a> By classifying ordinary semiautomatic rifles as \u201cassault weapons,\u201d legislatures in some states have sought to limit Second Amendment protection only to firearms technology that existed at some point in the past. That, too, \u201cborders on the frivolous.\u201d<\/p>\n\n\n\n<p>Underlying the \u201cin common use\u201d test is the premise that the American people\u2014not the government\u2014get to choose their desired firearms technology. It is \u201cthe American people [who] have considered the handgun to be the quintessential self-defense weapon,\u201d and since \u201chandguns are the most popular weapon chosen by Americans for self-defense in the home, \u2026 a complete prohibition of their use is invalid.\u201d<a href=\"#_ftn55\" name=\"_ftnref55\">[55]<\/a> Likewise, Americans choose modern-day rifles for any number of lawful purposes including for self-defense, and under <em>Heller<\/em>\u2019s test the courts must defer to their choices.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">IV. Lower courts have improperly disregarded <em>Heller<\/em>\u2019s \u201cin common use\u201d test in arms-ban cases and replaced it with a \u201cdangerousness\u201d test of their own.<\/h2>\n\n\n\n<p>Confusion on the part of courts between the <em>rule of decision<\/em> announced in <em>Heller<\/em> and the <em>methodology<\/em> described in <em>Bruen<\/em> has led to erroneous results in firearms-ban cases. For example, three consolidated lawsuits in Delaware challenged that state\u2019s newly enacted bans on so-called \u201cassault weapons\u201d and \u201clarge capacity magazines,\u201d and sought a preliminary injunction against their enforcement.<a href=\"#_ftn56\" name=\"_ftnref56\">[56]<\/a> The plaintiffs, relying on <em>Heller <\/em>as providing the rule of decision, correctly argued that \u201conce a weapon is found to be \u2018in common use\u2019 it cannot be regulated, and no historical analysis is necessary.\u201d<a href=\"#_ftn57\" name=\"_ftnref57\">[57]<\/a> The district court responded:<\/p>\n\n\n\n<p>I disagree. As the Supreme Court made clear in <em>Bruen<\/em>, \u201cthe standard for applying the Second Amendment is as follows: When the Second Amendment\u2019s plain text covers an individual\u2019s conduct, the Constitution presumptively protects that conduct. The government must then justify its regulation by demonstrating that it is consistent with the Nation\u2019s historical tradition of firearm regulation.\u201d<a href=\"#_ftn58\" name=\"_ftnref58\">[58]<\/a><\/p>\n\n\n\n<p>That would be true if a court was analyzing a non-arms-ban firearms law <em>ab initio<\/em>. But the Delaware court was not analyzing a Second Amendment question anew. The issue in that case was whether so-called \u201cassault weapons\u201d and \u201clarge capacity magazines\u201d are protected arms under the Second Amendment. <em>Heller<\/em> had already done the historical analysis to determine what kinds of arms are protected by the Second Amendment and had determined that the test is whether they are \u201cin common use\u201d today. Lower courts are not permitted to do their own historical analysis and invent their own new test in cases where the Supreme Court has already done the work and provided the test that lower courts must apply. The only question presented in an arms-ban case is whether the arms in question meet the \u201cin common use\u201d test. The Delaware district court continued:<\/p>\n\n\n\n<p>If the standard were as Plaintiffs propose, then <em>Bruen<\/em> need not have proceeded beyond the first step of the analysis. Instead, however, after concluding that the Second Amendment\u2019s plain text \u201cpresumptively guarantee[d]\u201d the plaintiffs a right to bear arms in public for self-defense, the Supreme Court turned to the question of historical tradition. Thus, so do I.<a href=\"#_ftn59\" name=\"_ftnref59\">[59]<\/a><\/p>\n\n\n\n<p>That is simply incorrect. The reason <em>Bruen<\/em> proceeded to examine the historical tradition is because the question in <em>Bruen<\/em> <em>did not involve an arms ban <\/em>and could not be resolved by applying <em>Heller<\/em>\u2019s rule of decision. The question in <em>Bruen<\/em>, for which it performed a historical review, was whether New York\u2019s highly restrictive licensing system for the public carry of firearms was justified by historical analogues. That and related issues had never been addressed by the Supreme Court using historical methodology, whereas the question of what arms are protected had been addressed and settled in <em>Heller.<\/em><\/p>\n\n\n\n<p>As illustrated above, this passage from the Delaware district court\u2019s decision deeply confuses the <em>rule of decision<\/em> or <em>constitutional test <\/em>that <em>Heller<\/em> mandates in arms-ban cases, with the description of the <em>methodology <\/em>to be applied in non-ban cases that are not controlled by <em>Heller<\/em>, as described in <em>Bruen.<\/em> The district court did not understand that <em>Bruen<\/em> proceeded beyond the first step because <em>Bruen<\/em> was not an arms-ban case controlled by <em>Heller.<\/em> As a result, that court erroneously strayed off into its own historical analysis for bans on arms that are unquestionably in common use by Americans today.<\/p>\n\n\n\n<p>That took the district court right back into the interest balancing rejected in <em>Bruen.<\/em> \u201cDefendants argue that the instant regulations implicate \u2018unprecedented societal concerns\u2019 and \u2018dramatic technological changes.\u2019 I agree.\u201d<a href=\"#_ftn60\" name=\"_ftnref60\">[60]<\/a> The court then adopted defendants\u2019 view of the history of semiautomatic technology, arguing that \u201cassault long guns and LCMs represent recent advances in technology.\u201d<a href=\"#_ftn61\" name=\"_ftnref61\">[61]<\/a> The opinion then goes on to address \u201cunprecedented societal concerns,\u201d allegedly due to the rise in public mass shootings over the past four decades.<a href=\"#_ftn62\" name=\"_ftnref62\">[62]<\/a><\/p>\n\n\n\n<p>The district court concluded that defendants had \u201csufficiently established that assault long guns and LCMs implicate dramatic technological change and unprecedented societal concerns for public safety.\u201d<a href=\"#_ftn63\" name=\"_ftnref63\">[63]<\/a> The court found that defendants had demonstrated that \u201cassault rifles and LCMs are exceptionally dangerous.\u201d<a href=\"#_ftn64\" name=\"_ftnref64\">[64]<\/a><\/p>\n\n\n\n<p>These \u201csocietal\u201d and \u201ctechnological\u201d arguments are precisely the same types of arguments advanced by the gun-ban advocates in <em>Heller<\/em> and pushed for years under intermediate scrutiny before <em>Bruen<\/em>. These are merely interest-balancing arguments dressed up as \u201cdramatic technological change\u201d and \u201cunprecedented societal concerns.\u201d But those changes and concerns were never presented by <em>Bruen<\/em> as forming a separate test or rule of decision. They were merely an acknowledgment that in cases not involving arms bans the examination of analogues might need to be \u201cmore nuanced.\u201d<a href=\"#_ftn65\" name=\"_ftnref65\">[65]<\/a> There is nothing in <em>Bruen<\/em> or in any other Supreme Court case that indicates that the rule of decision in arms-ban cases\u2014the \u201cin common use\u201d test announced in <em>Heller<\/em>\u2014has been overruled, replaced, or modified.<\/p>\n\n\n\n<p>Several other post-<em>Bruen<\/em> \u201cassault weapon\u201d ban cases and litigants have employed a similarly confused approach. First, they ignore <em>Heller<\/em> and the binding, applicable test concerning what arms are constitutionally protected. Then they perform an idiosyncratic historical analysis of what weapons are protected, generally finding that weapons that are particularly or exceptionally dangerous can be banned, regardless of whether they are \u201cin common use.\u201d<\/p>\n\n\n\n<p>For example, a group of law professors purporting to be Second Amendment experts recently submitted an amicus brief in support of the United States in <em>United States v. Rahimi<\/em>, a case the Supreme Court will hear this term. <em>Rahimi <\/em>will consider the constitutionality of the federal ban on firearm possession by anyone subject to a domestic violence restraining order. In their brief, the professors (unnecessarily) expounded on the test applicable to arms-ban cases but twisted it, asserting that \u201c[i]f a firearm is in \u2018common use\u2019 and can facilitate armed self-defense,\u2019 then it is relevantly similar to the arms protected by the Second Amendment at the time of its adoption and the right to bear that weapon warrants constitutional protection.\u201d<a href=\"#_ftn66\" name=\"_ftnref66\">[66]<\/a><\/p>\n\n\n\n<p>Seeking to unnecessarily complicate the straightforward test prescribed by <em>Heller<\/em>, these professors attempt to create a conjunctive test requiring <em>not just <\/em>common use, but also that the arm be shown to \u201cfacilitate armed self-defense.\u201d As explained in detail above, this second requirement is <em>not <\/em>part of the rule of decision in arms ban cases, but in the wake of <em>Bruen <\/em>the professors have again sought to create a test that is \u201cone step too many.\u201d<a href=\"#_ftn67\" name=\"_ftnref67\">[67]<\/a> Rather, it acts as an open invitation to courts to assess whether individuals really need the banned firearms, or whether their features are, in the judgment of experts and the courts, well-suited to the self-defense needs of Americans. But <em>Heller <\/em>made clear that such questions are not for expert or even court decision. Rather, it is the judgment of the American people that matters and \u201cwhatever the reason\u201d that they choose certain weapons, that they choose them is enough.<a href=\"#_ftn68\" name=\"_ftnref68\">[68]<\/a><\/p>\n\n\n\n<p>In a federal district court case from Washington State,<a href=\"#_ftn69\" name=\"_ftnref69\">[69]<\/a> the court performed a similar distortion of <em>Heller\u2019s<\/em> \u201cin common use\u201d test. There, plaintiffs properly relied on the \u201cin common use\u201d test to urge that the weapons at issue in that case could not be banned. The district court responded:<\/p>\n\n\n\n<p>The Plaintiffs misread <em>Heller <\/em>and <em>Bruen. Heller <\/em>noted that the right to keep and bear arms protected under the Second Amendment is limited to the sorts of weapons \u201cin common use at the time.\u201d <em>Heller <\/em>at 627. It found that this limitation is \u201csupported by the historical tradition of prohibiting \u2018dangerous and unusual weapons.\u2019\u201d <em>Id. Heller <\/em>does not hold that access to all weapons \u201cin common use\u201d are <em>automatically<\/em> entitled to Second Amendment protection <em>without limitation.<\/em><a href=\"#_ftn70\" name=\"_ftnref70\">[70]<\/a><\/p>\n\n\n\n<p>But, yes, <em>Heller <\/em>does so hold. Where did this \u201cautomatically\u201d and \u201cwithout limitation\u201d language come from? <em>Heller<\/em> did not create any exceptions to the \u201cin common use\u201d test, and nothing in <em>Heller <\/em>or <em>Bruen <\/em>permits lower courts to create exceptions to that test. The court then continued:<\/p>\n\n\n\n<p>Further, under <em>Bruen, <\/em>if Plaintiffs demonstrate that their proposed conduct, that of buying and selling weapons regulated by HB1240, is covered by the Second Amendment, the \u201cConstitution <strong>presumptively <\/strong>protects that conduct.\u201d <em>Bruen <\/em>at 2126, 2129-2130 (<em>emphasis added<\/em>). This presumption can be overcome. <em>Id.<a href=\"#_ftn71\" name=\"_ftnref71\"><strong>[71]<\/strong><\/a><\/em><\/p>\n\n\n\n<p>But that language about presumptions is just the first part of <em>Bruen<\/em>\u2019s methodology description. In short, the court shrugs off <em>Heller<\/em>, and then launches into its own historical analysis, <em>contra<\/em> <em>Heller<\/em>, of which arms are not protected by the Second Amendment. It concludes that \u201c[t]hese weapons are exceptionally dangerous,\u201d and that there is a tradition of \u201cexceptionally dangerous arms regulation.\u201d<a href=\"#_ftn72\" name=\"_ftnref72\">[72]<\/a> But that is not the test. And this is yet another instance of improper interest balancing in another guise.<\/p>\n\n\n\n<p>Another federal district court case that gets it wrong, albeit through more convoluted reasoning, is <em>Bevis v. City of Naperville.<\/em><a href=\"#_ftn73\" name=\"_ftnref73\">[73]<\/a> The district court there denied a preliminary injunction against the enforcement of city and state-wide \u201cassault weapon\u201d and \u201clarge capacity magazine\u201d bans. In doing so, it erroneously considered the challenged regulations \u201con a <em>tabula rasa<\/em>,\u201d concluded that \u201c<em>Bruen<\/em> is now the starting point,\u201d and substituted its own dangerousness test for <em>Heller<\/em>\u2019s \u201cin common use\u201d test. <a href=\"#_ftn74\" name=\"_ftnref74\">[74]<\/a> But \u201cdangerousness\u201d alone is not the test. To be banned, a weapon must be \u201cunusual\u201d (by definition, <em>not<\/em> \u201cin common use\u201d) as well as dangerous.<a href=\"#_ftn75\" name=\"_ftnref75\">[75]<\/a><\/p>\n\n\n\n<p>Another case from the Northern District of Illinois, <em>Herrera v. Raoul<\/em>,<a href=\"#_ftn76\" name=\"_ftnref76\">[76]<\/a> applied the \u201cdangerousness\u201d test devised by the <em>Bevis<\/em> court. But it also leaned heavily on the \u201cdramatic technological changes\u201d and \u201cunprecedented societal concerns\u201d language from <em>Bruen<\/em>. According to the court, this language allows \u201clocal and state governments to respond to \u201c\u2018dramatic technological changes\u2019 and \u2018unprecedented societal concerns\u2019 of increasing mass shootings by regulating the sale of weapons and magazines used to perpetrate them.\u201d<a href=\"#_ftn77\" name=\"_ftnref77\">[77]<\/a> Once again, the flagrant conflict between the \u201cin common use\u201d test and the <em>ad hoc<\/em> determination that any weapon that is \u201cparticularly dangerous\u201d can be banned was not addressed.<\/p>\n\n\n\n<p>A case from the District of Connecticut, <em>National Association for Gun Rights v. Lamont<\/em>,<a href=\"#_ftn78\" name=\"_ftnref78\">[78]<\/a> misconceived <em>Heller<\/em> and <em>Bruen <\/em>on two fronts. There, the district court began by fabricating a \u201ccommon use\u201d test requiring Plaintiffs to show that \u201cassault weapons\u201d are commonly used specifically for self-defense.<a href=\"#_ftn79\" name=\"_ftnref79\">[79]<\/a> But there is no such mandate in <em>Heller <\/em>or <em>Bruen<\/em>. After finding that Plaintiffs failed to meet their newly created burden, the district court doubled down, concluding that <em>Bruen<\/em> permits bans on \u201cnew and dangerous weapon technology\u201d that underpins \u201cunprecedented societal concerns\u201d\u2014which, according to the district court, encompasses \u201cassault weapons.\u201d<a href=\"#_ftn80\" name=\"_ftnref80\">[80]<\/a> Again, this is plainly wrong. <em>Bruen<\/em>\u2019s language concerns only non-arms-ban cases, and the whole point of the \u201ccommon use\u201d test is that it inherently accounts for changes in firearm technology.<\/p>\n\n\n\n<p>Fortunately, the district court in <em>Barnett v. Raoul<\/em> got it right when it preliminarily enjoined enforcement of the Illinois \u201cassault weapon\u201d and \u201clarge capacity magazine\u201d bans.<a href=\"#_ftn81\" name=\"_ftnref81\">[81]<\/a> Regarding the probability of success on the merits of the preliminary injunction, he noted that \u201cPlaintiffs rely on recent Supreme Court decisions that made it clear that the Second Amendment protects the possession and use of weapons that are in common use.\u201d<a href=\"#_ftn82\" name=\"_ftnref82\">[82]<\/a> Plaintiffs contend there can be no question regarding the likelihood of success because the items banned under [the Illinois statute] are in common use today.\u201d<a href=\"#_ftn83\" name=\"_ftnref83\">[83]<\/a> The court agreed.<a href=\"#_ftn84\" name=\"_ftnref84\">[84]<\/a> And while the district court did consider Defendants\u2019 analogues, the court concluded that \u201cthe commonality of \u2018arms\u2019 banned under [the Illinois act] is <em>dispositive<\/em>.\u201d<a href=\"#_ftn85\" name=\"_ftnref85\">[85]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Conclusion<\/h2>\n\n\n\n<p>Many lower courts have made fundamental legal errors in \u201cassault weapon\u201d and \u201clarge capacity magazine\u201d ban cases. They have failed to recognize that <em>Heller<\/em>\u2019s \u201cin common use\u201d test governs in arms-ban cases and have wrongly relied on a single sentence in <em>Bruen<\/em> describing the methodology to be applied in non-arms-ban cases. Those courts have treated the \u201cdramatic technological changes\u201d and \u201cunprecedented societal concerns\u201d language from <em>Bruen<\/em>\u2019s methodological description as if it formed part of the governing test for determining which arms are protected by the Second Amendment, when that language has no role whatsoever in arms-ban cases. Because the \u201cin common use\u201d test looks to arms that are in common use today, that test automatically and necessarily protects existing technology, and addresses any contemporary societal concerns stemming from such modern technology. Lower courts are not free to disregard <em>Heller<\/em>\u2019s \u201cin common use\u201d test and instead substitute a \u201cdangerousness\u201d test of their own devising. Doing so is merely \u201cinterest balancing\u201d in a different guise, which is prohibited by both <em>Heller<\/em> and <em>Bruen<\/em> in Second Amendment challenges to gun-control laws.<\/p>\n\n\n\n<p><a href=\"#_ftnref1\" name=\"_ftn1\">[*]<\/a> Mark W. It is for that reason that it would be absurd for a State to say after <em>Heller<\/em>, for example, that people can <em>keep<\/em> whatever handguns they have, but ban all sales, manufacture, and import of handguns. After all, constitutional rights \u201cimplicitly protect those closely related acts necessary to their exercise.\u201d Luis v. United States, 578 U.S. 5, 26 (2016) (Thomas, J., concurring). Similarly, the right to keep and bear arms also necessarily entails the right to keep and bear the components of protected arms that make them what they are\u2014triggers, magazines, barrels, etc. <em>are all protected.<\/em> Furthermore, all these components are themselves \u201cmodern instruments that facilitate armed self-defense\u201d that <em>Bruen<\/em> clarified are protected as a matter of text. <em>Bruen<\/em>, 142 S.Ct. at 2132.<\/p>\n\n\n\n<p><a href=\"#_ftnref9\" name=\"_ftn9\">[9]<\/a> Such laws concern the age at which young people can acquire or possess arms, where and under what conditions arms can be carried, restrictions on gun ranges or training, and other issues that do not involve the question of whether an arm or class of arms is protected.<\/p>\n\n\n\n<p><a href=\"#_ftnref10\" name=\"_ftn10\">[10]<\/a> For example, after a review of alleged historical analogues to New York\u2019s restrictive licensing regime for public carry, <em>Bruen<\/em> concluded that a licensing scheme that \u201cprevents law-abiding citizens with ordinary self-defense needs from exercising their right to keep and bear arms\u201d is unconstitutional. <em>Bruen, <\/em>142 S.Ct. at 2156.
