Jarkesy<\/em>, decided a week later, provides an illustration.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Jarkesy<\/em> was a battle of text and history versus mixed precedent. The question presented was whether the SEC could assess civil money penalties against Jarkesy through administrative adjudication without judicial process.&nbsp; The majority held that it could not.&nbsp; A dissent emphasized that <em>Atlas Roofing<\/em>, a 1977 case, sustained OSHA civil money penalties imposed through administrative adjudication.&nbsp; But the dissent made no argument from text or ratification-era history\u2014because no plausible text-and-history defense of <em>Atlas Roofing <\/em>exists.&nbsp; Scholars across the spectrum agree that as a matter of text and history, the Constitution prohibits the government from depriving Americans of vested property rights outside judicial process (with possible rare and isolated exceptions).&nbsp; So the majority declined to give <em>Atlas Roofing<\/em> the broader reading advocated by the dissent.&nbsp; Under the gravitational-pull principle, when original understanding points a certain direction, misaligned doctrine should be pulled back toward it.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This essay examines the Supreme Court\u2019s gravitational-pull approach in <em>Jarkesy <\/em>and discusses its implications for other constitutional provisions.&nbsp; The Court\u2019s doctrine in various other areas contains statements that the current Court likely considers indefensible as a matter of text and history.&nbsp; The Court likely will be slow to overrule precedent in these areas\u2014as Justice Neil Gorsuch recently observed, the current Court overrules precedent only about half as often as the Warren Court and Burger Court did.&nbsp; But the Court likely will continue to pull its jurisprudence toward original understanding, particularly when it believes that a precedent\u2019s misalignment with original understanding is obvious.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">I. The Gravitational-Pull Principle<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Justice Kavanaugh\u2019s gravitational-pull principle stems from his conception of the judicial role.&nbsp; Concurring in <em>United States v. Rahimi<\/em>, Justice Kavanaugh wrote that the \u201cfirst and most important rule in constitutional interpretation\u201d is \u201cto heed the text\u2014that is, the actual words of the Constitution.\u201d<a href=\"#_ftn2\" name=\"_ftnref2\">[1]<\/a>&nbsp; The text of the Constitution, after all, is the \u201c\u2018Law of the Land.\u2019\u201d<a href=\"#_ftn3\" name=\"_ftnref3\">[2]<\/a>&nbsp; Judges should interpret the text \u201caccording to its ordinary meaning as originally understood.\u201d<a href=\"#_ftn4\" name=\"_ftnref4\">[3]<\/a>&nbsp; In doing so, Justice Kavanaugh continued, courts should \u201crespect precedent\u201d given that \u201c[t]he \u2018judicial power\u2019 established in Article III incorporates the principle of <em>stare decisis<\/em>.\u201d <a href=\"#_ftn5\" name=\"_ftnref5\">[4]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But even when the courts have developed \u201cextensive bodies of precedent,\u201d Justice Kavanaugh wrote, \u201ctext and history still matter a great deal.\u201d<a href=\"#_ftn6\" name=\"_ftnref6\">[5]<\/a>&nbsp; When determining \u201chow broadly or narrowly to read a precedent,\u201d or \u201cwhether to extend, limit, or narrow a precedent,\u201d courts should consider \u201chow the precedent squares with the Constitution\u2019s text and history.\u201d<a href=\"#_ftn7\" name=\"_ftnref7\">[6]<\/a>&nbsp; Courts should resolve questions about a precedent\u2019s scope \u201cin light of and in the direction of\u201d that text and history.<a href=\"#_ftn8\" name=\"_ftnref8\">[7]<\/a>&nbsp; In other words, text and history should exert a \u201cgravitational pull\u201d on the court\u2019s interpretation of precedent.<a href=\"#_ftn9\" name=\"_ftnref9\">[8]<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">II. SEC v. Jarkesy<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">A week later, the Supreme Court applied the gravitational-pull principle in <em>SEC v. Jarkesy<\/em>\u2014a case that involved mixed precedent, some of which clearly is inconsistent with text and history.&nbsp; The Court held that a defendant in a securities-fraud suit has the right to be tried by a jury in an Article III court.&nbsp; The case arose when the SEC alleged that Jarkesy violated various securities laws, held an adjudication before its own in-house tribunal, found Jarkesy liable, and imposed a $300,000 civil money penalty.&nbsp; Jarkesy sued in federal court, arguing that the SEC violated the Seventh Amendment, which provides that in \u201c[s]uits at common law, . . . the right of trial by jury shall be preserved.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court agreed with Jarkesy, concluding that the proceeding was a suit at common law and that the public-rights doctrine (which in exceptional cases allows for adjudication outside Article III) did not apply.&nbsp; The Court focused largely on the remedy\u2014the civil penalties remedy, the Court emphasized, can \u201conly be enforced in courts of law.\u201d<a href=\"#_ftn10\" name=\"_ftnref10\">[9]<\/a>&nbsp; Three justices dissented, arguing that the public-rights doctrine allows Congress to \u201ccreate statutory obligations\u201d entitling the government to civil penalties and \u201cassign their enforcement\u201d to executive adjudication.<a href=\"#_ftn11\" name=\"_ftnref11\">[10]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Text and history clearly favored the majority.&nbsp; Scholars across the ideological spectrum agree that the public-rights doctrine historically asks about the deprivation rather than the government interest being pursued.&nbsp; Under the original understanding, the government may not deprive Americans of vested property rights absent judicial process.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But precedent was mixed.&nbsp; While the Court had largely hewed to the historical understanding, the <em>Jarkesy <\/em>dissent relied heavily on <em>Atlas Roofing<\/em>, a 1977 case that upheld certain civil penalties imposed by OSHA without judicial process.&nbsp; That case arguably had been implicitly overruled or limited by later cases, but it had never been explicitly overruled.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">A. Text and History<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Historically, as Caleb Nelson has shown, public rights are rights created by the government that have no counterpart in the Lockean state of nature.<a href=\"#_ftn12\" name=\"_ftnref12\">[11]<\/a>&nbsp; Public roads are an example\u2014no one has a right to government-operated roads in a state of nature that has no government.&nbsp; Similarly, the government sometimes creates benefits or privileges that no one has a natural right to.&nbsp; Private rights, in contrast, are those associated with the natural rights that individuals would enjoy even in the absence of political society.<a href=\"#_ftn13\" name=\"_ftnref13\">[12]<\/a>&nbsp; The paradigmatic examples are life, liberty, and property\u2014Congress did not create those rights; they existed before Congress existed.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under our Constitution, the government may deprive Americans of <em>public<\/em> rights without judicial process\u2014what the political branches give, the political branches may take away.&nbsp; But the government may deprive Americans of <em>private<\/em> rights only with judicial process.&nbsp; That is evident from multiple provisions of the Constitution.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>First<\/em>, Article III vests the \u201cjudicial power\u201d \u201cof the United States\u201d in the Supreme Court and the lower federal courts.&nbsp; And the core of the judicial power is the power to bind parties and to authorize the deprivation of private rights.<a href=\"#_ftn14\" name=\"_ftnref14\">[13]<\/a>&nbsp; The executive does not hold that power; Article II grants the executive only executive power.<a href=\"#_ftn15\" name=\"_ftnref15\">[14]<\/a> &nbsp;&nbsp;Under the Constitution\u2019s vesting clauses, therefore, unilateral executive action cannot deprive Americans of vested property rights.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Second<\/em>, the Constitution\u2019s due process clauses provide that the federal and state governments may deprive persons of \u201clife, liberty, and property\u201d only with \u201cdue process of law.\u201d&nbsp; Due process \u201chas always been the insistence that the executive . . . deprive persons of rights only in accordance with settled rules independent of executive will, in accordance with a judgment by an independent magistrate.\u201d<a href=\"#_ftn16\" name=\"_ftnref16\">[15]<\/a>&nbsp; Whatever due process\u2019s precise definition, it definitely requires some kind of judicial process\u2014the executive branch cannot unilaterally deprive persons of life, liberty, or property.<a href=\"#_ftn17\" name=\"_ftnref17\"><sup>[16]<\/sup><\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Third<\/em>, the Seventh Amendment provides that \u201c[i]n Suits at common law,\u201d \u201cthe right of trial by jury shall be preserved.\u201d&nbsp; Because suits imposing civil penalties are suits at common law, they require a jury trial.<a href=\"#_ftn18\" name=\"_ftnref18\">[17]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Scholars across the ideological spectrum agree about these textual and historical points.&nbsp; In a prominent article otherwise supporting the <em>Jarkesy <\/em>dissent\u2019s position, for example, Adam B. Cox &amp; Emma Kaufman observed that \u201cFounding Era lawyers would have been shocked to learn that the government could take a person\u2019s recognized due-process rights without a trial before an Article III tribunal.\u201d<a href=\"#_ftn19\" name=\"_ftnref19\">[18]<\/a>&nbsp; And while Gregory Ablavsky tried to unsettle the consensus in a recent article, his effort only highlights that there is no real debate on the issue.&nbsp; He argues that in the mid-nineteenth century the government could deprive individuals of what he calls <em>imperfect <\/em>vested property rights without judicial process, but agrees with every other scholar that perfect and vested property rights\u2014the ordinary kind\u2014\u201ccould be challenged only in court.\u201d<a href=\"#_ftn20\" name=\"_ftnref20\">[19]<\/a>&nbsp; No one has seriously contested Nelson\u2019s account.<a href=\"#_ftn21\" name=\"_ftnref21\">[20]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a matter of text and history, then, the question whether <em>Jarkesy<\/em> concerned public or private rights was among the easiest in the Supreme Court\u2019s history.&nbsp; To recap, public rights are those the government may take away as a matter of prerogative without judicial process.&nbsp; And it has always been understood\u2014and enshrined in the Constitution\u2019s text\u2014that the government may <em>not<\/em> take away a person\u2019s \u201clife, liberty, or property\u201d by prerogative. &nbsp;After all, those rights precede government; they exist in a state of nature.&nbsp; The founding generation understood that only through exercise of \u201cjudicial power\u201d with \u201cdue process of law\u201d could the government deprive a person of a property right.&nbsp; Because the SEC sought to deprive Jarkesy of a property right, the proceeding concerned private rights and required the concomitant constitutional protections.&nbsp; As a matter of text and history, it was as simple as that.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">B. Precedent<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">For the most part, the Supreme Court has heeded the Constitution\u2019s text in this area.&nbsp; Its longstanding precedent establishes that \u201conly\u201d controversies in the public-rights category \u201cmay be removed from Art[icle] III courts and delegated to . . . administrative agencies.\u201d<a href=\"#_ftn22\" name=\"_ftnref22\">[21]<\/a>&nbsp; Congress \u201clacks the power to strip parties contesting matters of private right of their constitutional right to a trial by jury.\u201d<a href=\"#_ftn23\" name=\"_ftnref23\">[22]<\/a> &nbsp;And the Court generally has recognized that the public-rights doctrine asks about the deprivation, not the public interest being pursued.&nbsp; It is only when Congress \u201ccreates\u201d a \u201cstatutory <em>right<\/em>\u201d\u2014not an obligation\u2014that Congress may provide that those \u201cseeking to vindicate that right\u201d must do so in executive adjudication.<a href=\"#_ftn24\" name=\"_ftnref24\">[23]<\/a>&nbsp; That is, when \u201cit depends upon the will of congress\u201d whether a \u201cremedy\u201d \u201cshall be allowed at all,\u201d Congress can \u201climit the extent to which a judicial forum [is] available.\u201d<a href=\"#_ftn25\" name=\"_ftnref25\">[24]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In its 1977 <em>Atlas Roofing <\/em>decision, however, the Court drifted from text and history.&nbsp; The opinion\u2019s author believed that \u201cArticle III . . . must be balanced against . . . legislative responsibilities.\u201d<a href=\"#_ftn26\" name=\"_ftnref26\">[25]<\/a>&nbsp; The Court, accordingly, invoked the public-rights doctrine to approve adjudication of OSHA civil penalties in an administrative tribunal \u201csupplying speedy and expert resolutions of the issues involved.\u201d<a href=\"#_ftn27\" name=\"_ftnref27\">[26]<\/a>&nbsp; The Court invoked \u201cthe practical limitations of a jury trial\u201d and its \u201cfunctional [in]compatibility\u201d with administrative proceedings,<a href=\"#_ftn28\" name=\"_ftnref28\">[27]<\/a> and concluded that Congress need not \u201cchoke the already crowded federal courts with new types of litigation,\u201d but rather may \u201ccommit[] [them] to administrative agencies with special competence in the relevant field.\u201d<a href=\"#_ftn29\" name=\"_ftnref29\">[28]<\/a>&nbsp; In short, as it later recognized, the Court focused on \u201cthe practical effect\u201d of statutory law and \u201cthe concerns that drove Congress\u201d to \u201cdepart from the requirements of Article III.\u201d<a href=\"#_ftn30\" name=\"_ftnref30\">[29]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Atlas Roofing <\/em>faced severe and sustained scholarly criticism across the ideological spectrum.&nbsp; For example, prominent scholar Martin Redish wrote that <em>Atlas Roofing <\/em>is \u201cindefensible\u201d \u201cas a matter of Seventh Amendment construction.\u201d<a href=\"#_ftn31\" name=\"_ftnref31\">[30]<\/a>&nbsp; The Court\u2019s \u201cabandonment of a constitutional right,\u201d \u201cfor no other reason than the Court\u2019s deference to the conclusion of the majoritarian branches that enforcement of that right would be politically or socially difficult or inconvenient,\u201d was \u201cwholly unprincipled.\u201d<a href=\"#_ftn32\" name=\"_ftnref32\">[31]<\/a>&nbsp; \u201c[N]othing in the text, structure, or history of the Seventh Amendment provides any basis on which to permit reliance on . . . a social balancing process.\u201d<a href=\"#_ftn33\" name=\"_ftnref33\">[32]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">A few years after <em>Atlas Roofing<\/em>, the Court arguably \u201coverrule[d] or severely limit[ed]\u201d it.<a href=\"#_ftn34\" name=\"_ftnref34\">[33]<\/a>&nbsp; In <em>Granfinanciera v. Nordberg<\/em>, the Court rejected <em>Atlas Roofing<\/em>\u2019s assertion that the Seventh Amendment \u201cdoes not apply when Congress assigns the adjudication of [certain] rights to specialized tribunals where juries have no place.\u201d<a href=\"#_ftn35\" name=\"_ftnref35\">[34]<\/a>&nbsp; Dissenting, <em>Atlas Roofing<\/em>\u2019s author suggested that <em>Atlas Roofing<\/em> \u201cis no longer good law after today\u2019s decision.\u201d<a href=\"#_ftn36\" name=\"_ftnref36\">[35]<\/a>&nbsp; And by the time <em>Jarkesy <\/em>was litigated, several decades of more recent public-rights cases had consistently looked to text and history.<a href=\"#_ftn37\" name=\"_ftnref37\">[36]<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">C. The SEC\u2019s Position In Jarkesy<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">In <em>Jarkesy<\/em>, the SEC\u2019s main argument was that the public-rights doctrine applied, but it had no theory of what the public-rights doctrine actually is.&nbsp; The SEC invoked <em>Atlas Roofing<\/em>, but that case \u201cleft the term \u2018public rights\u2019 undefined.\u201d<a href=\"#_ftn38\" name=\"_ftnref38\">[37]<\/a>&nbsp; And rather than advancing a definition of its own, the SEC asked the Court to refrain from \u201cexplain[ing] the distinction between public and private rights\u201d at all.<a href=\"#_ftn39\" name=\"_ftnref39\">[38]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The untheorized rule of decision that the SEC did advance, moreover, was obviously wrong.&nbsp; The SEC asserted that Congress can override the Constitution\u2019s judicial-process protections whenever it creates \u201cnew statutory obligations.\u201d<a href=\"#_ftn40\" name=\"_ftnref40\">[39]<\/a>&nbsp; But that proved far too much\u2014the creation of new statutory obligations cannot possibly be sufficient to trigger the public-rights doctrine because all agree that \u201cthe public-rights doctrine does not extend to any criminal matters.\u201d<a href=\"#_ftn41\" name=\"_ftnref41\">[40]<\/a>&nbsp; No one would argue that judicial process is unnecessary whenever Congress creates new statutory felonies.&nbsp; When it comes to criminal prosecution, everyone recognizes that no matter how salutary the government objective, it is the deprivation that matters. &nbsp;The same is true for the backend of \u201clife, liberty, or property.\u201d<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">D. The Jarkesy Opinion<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">The Supreme Court held that Jarkesy is \u201centitled to a jury trial in an Article III court,\u201d concluding that the public-rights doctrine was inapplicable.<a href=\"#_ftn42\" name=\"_ftnref42\">[41]<\/a>&nbsp; The Court stated that the public-rights doctrine is \u201can <em>exception<\/em>\u201d to the constitutional norm that \u201chas no textual basis.\u201d<a href=\"#_ftn43\" name=\"_ftnref43\">[42]<\/a>&nbsp; And \u201cwhat matters,\u201d the Court explained, is \u201cthe substance of the action, not where Congress has assigned it.\u201d<a href=\"#_ftn44\" name=\"_ftnref44\">[43]<\/a>&nbsp; The SEC\u2019s claims were \u201ctraditional legal claims\u201d because they sought civil penalties\u2014a remedy that can \u201conly be enforced in courts of law.\u201d<a href=\"#_ftn45\" name=\"_ftnref45\">[44]<\/a>&nbsp; The majority distinguished <em>Atlas Roofing <\/em>on the ground that the statute in that case \u201cdid not borrow its cause of action from the common law\u201d but rather \u201cresembled a detailed building code.\u201d<a href=\"#_ftn46\" name=\"_ftnref46\">[45]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The dissent concluded that \u201ca statutory right belonging to the Government in its sovereign capacity\u201d falls within the public-rights exception.<a href=\"#_ftn47\" name=\"_ftnref47\">[46]<\/a>&nbsp; For the dissent, then, the public-rights doctrine asks about the <em>government\u2019s<\/em> \u201crights,\u201d not the citizen\u2019s.<a href=\"#_ftn48\" name=\"_ftnref48\">[47]<\/a>&nbsp; And whether a defendant receives judicial process is entirely up to Congress: the only question is \u201c[w]hether Congress assigned the Government\u2019s sovereign rights to civil penalties to a non-Article III [adjudicator].\u201d<a href=\"#_ftn49\" name=\"_ftnref49\">[48]<\/a>&nbsp; In a concurring opinion, Justice Gorsuch called this \u201castonishing.\u201d<a href=\"#_ftn50\" name=\"_ftnref50\">[49]<\/a>&nbsp; The dissent\u2019s view, Justice Gorsuch observed, is that the Constitution \u201cimposes <em>no <\/em>limits\u201d on the government\u2019s power to seek civil penalties outside Article III.<a href=\"#_ftn51\" name=\"_ftnref51\">[50]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The dissent did not attempt to reconcile its conception of public rights with the Constitution\u2019s text or ratification-era history.&nbsp; And the dissent offered no original-understanding defense for its assertion that the public-rights doctrine concerns the government\u2019s \u201crights.\u201d<a href=\"#_ftn52\" name=\"_ftnref52\">[51]<\/a> &nbsp;Instead, the dissent relied exclusively on precedent, focusing foremost on <em>Atlas Roofing<\/em>.&nbsp; The majority criticized the dissent for creating a rule based \u201cnot in the constitutional text (where it would find no foothold), nor in the ratification history (where again it would find no support).\u201d<a href=\"#_ftn53\" name=\"_ftnref53\">[52]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the majority declined to formally overrule <em>Atlas Roofing<\/em>, it did not leave the case upright.&nbsp; The majority observed that \u201c<em>Granfinanciera<\/em> might have overruled <em>Atlas Roofing<\/em>,\u201d at least \u201cthe author of <em>Atlas Roofing <\/em>certainly thought . . . so.\u201d<a href=\"#_ftn54\" name=\"_ftnref54\">[53]<\/a>&nbsp; It called <em>Atlas Roofing<\/em>\u2019s definition of public rights \u201ccircular,\u201d noting that <em>Atlas Roofing <\/em>said the public-rights doctrine applies \u201cin cases in which \u2018public rights\u2019 are being litigated\u201d such as cases in which the government \u201cenforce[s] public rights.\u201d<a href=\"#_ftn55\" name=\"_ftnref55\">[54]<\/a>&nbsp; And it asserted that <em>Atlas Roofing <\/em>\u201crepresents a departure from our legal traditions.\u201d<a href=\"#_ftn56\" name=\"_ftnref56\">[55]<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">*&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; *&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; *<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Jarkesy <\/em>employs Justice Kavanaugh\u2019s gravitational-pull principle.&nbsp; The majority plainly considered <em>Atlas Roofing <\/em>indefensible as a matter of original understanding.&nbsp; The dissent advanced no text-and-history defense of the decision, and scholars haven\u2019t either.&nbsp; The majority therefore declined to give <em>Atlas Roofing<\/em> the broader reading the dissent proposed.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">III. Implications For Other Constitutional Questions<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">The current Supreme Court is by no means quick to overrule or limit precedent\u2014it actually appears slower to overrule precedent now than in the past.&nbsp; As Justice Gorsuch recently observed, the current Court is overruling only about half as many prior decisions per term as the Warren Court and the Burger Court did.<a href=\"#_ftn57\" name=\"_ftnref57\">[56]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But in recent years the Court has been willing to narrow (or occasionally overrule) precedent that it perceives as plainly inconsistent with original understanding.&nbsp; The more indefensible a precedent is as a matter of text and history, the more vulnerable it is.&nbsp; Stare decisis, the Court observed in 2020, \u201cisn\u2019t supposed to be the art of methodically ignoring what everyone knows to be true.\u201d<a href=\"#_ftn58\" name=\"_ftnref58\">[57]<\/a>&nbsp; To this Court, a \u201cdemonstrably\u201d or \u201cegregiously\u201d wrong precedent is categorically different from a precedent whose correctness is reasonably contestable.<a href=\"#_ftn59\" name=\"_ftnref59\">[58]<\/a>&nbsp; When the current Court believes that a precedent cannot be seriously defended as a matter of text and history, it is unlikely to extend or broadly read that precedent.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><em>Atlas Roofing <\/em>is not the only case with doctrinal statements that the current Court likely considers indefensible as a matter of text and history.&nbsp; For example, in 1983 the Court wrote: \u201cThe Court balance[s] the language of the Contracts Clause against the State\u2019s interest in exercising its police power.\u201d<a href=\"#_ftn60\" name=\"_ftnref60\">[59]<\/a>&nbsp; In 2004 the Court wrote that Congress\u2019s legislative power in military and foreign affairs rests in part \u201cnot upon affirmative grants of the Constitution\u201d but \u201cupon the Constitution\u2019s adoption of preconstitutional powers necessarily inherent in any Federal Government.\u201d<a href=\"#_ftn61\" name=\"_ftnref61\">[60]<\/a>&nbsp; In 1988 the Court wrote that the U.S. Sentencing Commission \u201cdoes not exercise judicial power\u201d but may nevertheless be placed \u201cwithin the Judicial Branch.\u201d<a href=\"#_ftn62\" name=\"_ftnref62\">[61]<\/a>&nbsp; In 2012 the Court summarized previous cases as holding that \u201cthe power of Congress over interstate commerce is not confined to the regulation of commerce among the states,\u201d even though the Interstate Commerce Clause says that \u201cCongress shall have Power To . . . regulate Commerce . . . among the several States.\u201d<a href=\"#_ftn63\" name=\"_ftnref63\">[62]<\/a><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The current Court likely considers these statements indefensible as a matter of text and history.&nbsp; All nine justices believe that the Court may not \u201cbalance\u201d the Constitution\u2019s text against something else.&nbsp; The justices likely believe that the notion of inherent preconstitutional Congressional power cannot be squared with the Article I Vesting Clause and the Tenth Amendment.&nbsp; The justices likely believe that an entity exercising nonjudicial power of the United States cannot be placed in the judicial branch.&nbsp; And whatever the proper scope of the Interstate Commerce Clause, the justices likely believe that their doctrine cannot properly be formulated as a quotation of the Constitution\u2019s text with a \u201cnot\u201d in front.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That is not to say that the Court will likely uproot its jurisprudence in any of these areas or others.&nbsp; Gravitational pull is just pull.&nbsp; But given that these doctrinal statements and certain others seem severely misaligned with the Court\u2019s views about its interpretive obligations, <em>Jarkesy <\/em>probably will not be the last case in which the Court pulls precedent back toward the best reading of the \u201cLaw of the Land.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref1\" name=\"_ftn1\">*<\/a> J.D. 2016, Yale Law School.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"#_ftnref2\" name=\"_ftn2\">[1]<\/a> United States v.
