Blackhorse Defendants Seek Dismissal of Redskins Lawsuit

According to the Washington Post, attorneys for five Native Americans have asked a federal district judge in Alexandria, VA to dismiss a lawsuit brought against them by the Washington Redskins. The Native Americans are the same group who successfully challenged the Redskins’ trademarks in front of the U.S. Patent and Trademark Office board. The group claims that the lawsuit should not have been filed against them, but rather against the trademark office in the U.S. Court of Appeals for the Federal Circuit. The Redskins insist that it was proper to sue the Native American group because the group was responsible for the trademark office’s decision. The team also argues that if the judge was to dismiss the case, the Redskins would be denied an appeal from the trademark ruling.
