Hammond alleges the school discriminated against him by refusing to let him play football after learning Hammond only has one <a href=\"http:\/\/www.espn.com\/college-football\/story\/_\/id\/21611634\/former-football-player-1-kidney-sues-university-southern-mississippi\">kidney<\/a>. Hammond, a former Louisiana State University (\u201cLSU\u201d) football recruit, transferred to Southern Miss after being recruited by the school\u2019s football coach Dan <a href=\"http:\/\/www.theadvocate.com\/baton_rouge\/news\/article_df28f100-d53d-11e7-b9b9-2f6fda1ae12e.html\">Disch.<\/a> According to Hammond, Disch offered the recruit a full scholarship at the school so long as Hammond assisted the program\u2019s rebuild and earned a second string or better position on the roster. Hammond jumped at the opportunity, withdrawing from LSU and even deferring for a year in order to comply with NCAA transfer <a href=\"http:\/\/www.theadvocate.com\/baton_rouge\/news\/article_df28f100-d53d-11e7-b9b9-2f6fda1ae12e.html\">regulations<\/a>. However, after completing a physical examination and disclosing his condition, Hammond was removed from team practice due to his being a \u2018liability\u2019 to the <a href=\"http:\/\/www.theadvocate.com\/baton_rouge\/news\/article_df28f100-d53d-11e7-b9b9-2f6fda1ae12e.html\">team<\/a>.\u00a0 After the school refused to accept Hammond\u2019s offer to sign a form waiving liability, he filed the <a href=\"http:\/\/www.espn.com\/college-football\/story\/_\/id\/21611634\/former-football-player-1-kidney-sues-university-southern-mississippi\">suit<\/a>.<\/p>\n<p><a href=\"https:\/\/journals.law.harvard.edu\/jsel\/wp-content\/uploads\/sites\/78\/2017\/12\/Therock.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-1879\" src=\"https:\/\/journals.law.harvard.edu\/jsel\/wp-content\/uploads\/sites\/78\/2017\/12\/Therock-300x202.jpg\" alt=\"\" width=\"300\" height=\"202\" srcset=\"https:\/\/journals.law.harvard.edu\/jsel\/wp-content\/uploads\/sites\/78\/2017\/12\/Therock-300x202.jpg 300w, https:\/\/journals.law.harvard.edu\/jsel\/wp-content\/uploads\/sites\/78\/2017\/12\/Therock.jpg 455w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>Hammond states in his lawsuit that Southern Miss\u2019 refusal to let him play constitutes discrimination based on the Americans with Disabilities Act and the Rehabilitation <a href=\"http:\/\/www.theadvocate.com\/baton_rouge\/news\/article_df28f100-d53d-11e7-b9b9-2f6fda1ae12e.html\">Act<\/a>. He contests that having one kidney has never affected his ability to play football during practice or <a href=\"http:\/\/www.espn.com\/college-football\/story\/_\/id\/21611634\/former-football-player-1-kidney-sues-university-southern-mississippi\">games<\/a>. Furthermore, Hammond\u2019s kidney specialist noted that it was highly improbable for Hammond to incur any kidney injury as a result of playing <a href=\"http:\/\/www.espn.com\/college-football\/story\/_\/id\/21611634\/former-football-player-1-kidney-sues-university-southern-mississippi\">football<\/a>.
