Goldsmith filed a counterclaim for copyright infringement shortly after.<\/p>\n<p>This past week, both parties have\u00a0<a href=\"https:\/\/www.docketbird.com\/court-cases\/The-Andy-Warhol-Foundation-For-The-Visual-Arts-Inc-v-Goldsmith-et-al\/nysd-1:2017-cv-02532\">filed motions for summary judgment<\/a>\u00a0in what has become a heated debate. The\u00a0<a href=\"https:\/\/www.hollywoodreporter.com\/thr-esq\/photographer-suing-andy-warhols-estate-claims-his-work-isnt-transformative-1152405\">latest arguments presented by Goldsmith<\/a>\u00a0question the artistic value Warhol adds to his source material by claiming that anyone could modify a photograph in similar ways with today\u2019s technology.<\/p>\n<p>Goldsmith asserts that Warhol was given permission to use her original photograph of Prince as source material for a single work. The resulting series contained 16 prints, all of which Goldsmith asserts are similar enough to her original photograph to be considered a violation of copyright. Warhol\u2019s estate argues that the images were transformative to the extent that they cannot be considered the same image. They contend that the prints are new creations.<\/p>\n<p>Appropriation in art has been an\u00a0ongoing debate as is evidenced by cases such as <a href=\"https:\/\/copyrightalliance.org\/wp-content\/uploads\/sites\/78\/2016\/09\/Cariou-v.-Prince.pdf\"><em>Cariou v. Prince<\/em><\/a> and <a href=\"https:\/\/cyber.harvard.edu\/people\/tfisher\/IP\/2006%20Blanch%20Abridged.pdf\"><em>Blanch v. Koons<\/em><\/a>. The debate focuses on where the lines of fair use should be drawn for the artist versus the creator of the original source image.
