{"id":2103,"date":"2018-10-28T20:50:20","date_gmt":"2018-10-29T00:50:20","guid":{"rendered":"http:\/\/journals.law.harvard.edu\/jsel\/?p=2103"},"modified":"2023-07-25T11:44:23","modified_gmt":"2023-07-25T15:44:23","slug":"all-the-stars-leads-to-a-lawsuit","status":"publish","type":"post","link":"https:\/\/journals.law.harvard.edu\/jsel\/2018\/10\/all-the-stars-leads-to-a-lawsuit\/","title":{"rendered":"&#8220;All The Stars&#8221; Leads to a Lawsuit"},"content":{"rendered":"<p><a href=\"https:\/\/journals.law.harvard.edu\/jsel\/wp-content\/uploads\/sites\/78\/2018\/10\/36059988466_fae5da6bc8_z.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-2105\" src=\"https:\/\/journals.law.harvard.edu\/jsel\/wp-content\/uploads\/sites\/78\/2018\/10\/36059988466_fae5da6bc8_z-300x200.jpg\" alt=\"\" width=\"300\" height=\"200\" srcset=\"https:\/\/journals.law.harvard.edu\/jsel\/wp-content\/uploads\/sites\/78\/2018\/10\/36059988466_fae5da6bc8_z-300x200.jpg 300w, https:\/\/journals.law.harvard.edu\/jsel\/wp-content\/uploads\/sites\/78\/2018\/10\/36059988466_fae5da6bc8_z.jpg 640w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/p>\n<p>Lina Iris Viktor <a href=\"https:\/\/www.hollywoodreporter.com\/thr-esq\/judge-wont-rule-reputational-damage-kendrick-lamars-all-my-stars-video-1154960\">is suing\u00a0<\/a>Universal, Kendrick Lamar, SZA and others, over the \u201cAll The Stars\u201d music video where she claims her paintings are shown. \u201c<a href=\"https:\/\/www.documentcloud.org\/documents\/5019347-Viktor.html\">Viktor alleges\u00a0<\/a>that a 19-second part of the Video infringes on her artwork by displaying, without a license, distinctive paintings of Viktor\u2019s, which are based on ancient Egyptian and African symbolism and feature gold leaf and black paint.\u201d <a href=\"https:\/\/umich.instructure.com\/files\/7920123\/download?download_frd=1\">Her complaint\u00a0<\/a>alleges three counts: copyright infringement, vicarious copyright infringement and contributory copyright infringement. \u00a0She is seeking a permanent injunction along with actual damages and indirect profits stemming from (1) damages to her reputation and (2) profits directly and indirectly attributable to the music video.<\/p>\n<p>In response, the defendants moved for a <a href=\"https:\/\/www.documentcloud.org\/documents\/4614055-Viktor.html\">partial summary judgment\u00a0<\/a>against Viktor\u2019s claims, but <a href=\"https:\/\/www.documentcloud.org\/documents\/5019347-Viktor.html\">in an opinion\u00a0<\/a>delivered by the court on October 24, 2018, the motion was denied. The partial summary judgment motion focused on two arguments. Under <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/17\/504\">17 U.S.C. Section 504(b)<\/a> of the Copyright Act, the copyright owner is entitled to profits \u201cof the infringer that are attributable to the infringement.\u201d Defendants deny that Viktor has met its burden in demonstrating a relationship between the profits of the music video and its use of her work. \u00a0The second argument surrounds Viktor\u2019s request for reputational damages. Viktor \u201c<a href=\"https:\/\/news.artnet.com\/market\/mariane-ibrahim-abdis-lina-iris-viktor-armory-show-1240124\">said\u00a0<\/a>that the video appropriated and misinterpreted [her] highly feminized\u201d paintings therefore having a reputational effect. Since the Copyright Act does not explicitly offer recovery for this, defendants argue that Viktor&#8217;s request should be dismissed.
