{"id":2114,"date":"2018-10-31T15:30:33","date_gmt":"2018-10-31T19:30:33","guid":{"rendered":"http:\/\/journals.law.harvard.edu\/jsel\/?p=2114"},"modified":"2023-07-25T11:44:05","modified_gmt":"2023-07-25T15:44:05","slug":"writer-sues-pbs-after-network-terminates-employment-for-meghan-markle-comment","status":"publish","type":"post","link":"https:\/\/journals.law.harvard.edu\/jsel\/2018\/10\/writer-sues-pbs-after-network-terminates-employment-for-meghan-markle-comment\/","title":{"rendered":"Writer Sues PBS after Network Terminates Employment for Meghan Markle Comment"},"content":{"rendered":"<p><span style=\"font-weight: 400;\"><a href=\"https:\/\/journals.law.harvard.edu\/jsel\/wp-content\/uploads\/sites\/78\/2018\/10\/Prince_Harry_and_Meghan_Markle.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-medium wp-image-2115\" src=\"https:\/\/journals.law.harvard.edu\/jsel\/wp-content\/uploads\/sites\/78\/2018\/10\/Prince_Harry_and_Meghan_Markle-300x300.jpg\" alt=\"\" width=\"300\" height=\"300\" srcset=\"https:\/\/journals.law.harvard.edu\/jsel\/wp-content\/uploads\/sites\/78\/2018\/10\/Prince_Harry_and_Meghan_Markle-300x300.jpg 300w, https:\/\/journals.law.harvard.edu\/jsel\/wp-content\/uploads\/sites\/78\/2018\/10\/Prince_Harry_and_Meghan_Markle-150x150.jpg 150w, https:\/\/journals.law.harvard.edu\/jsel\/wp-content\/uploads\/sites\/78\/2018\/10\/Prince_Harry_and_Meghan_Markle.jpg 600w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/a><\/span><\/p>\n<p><span style=\"font-weight: 400;\">On Thursday, October 25, a former PBS writer <\/span><a href=\"https:\/\/www.scribd.com\/document\/391882528\/Heckman-v-PBS-Newshour-et-al\"><span style=\"font-weight: 400;\">filed a lawsuit<\/span><\/a><span style=\"font-weight: 400;\"> accusing the network of unlawfully firing him because of sex and sex stereotyping after he made an \u201cinnocuous remark\u201d about Meghan Markle. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The plaintiff, Hugh Heckman, alleges that he was fired as a result of sex discrimination in violation of Title VII of the Civil Rights Act of 1964. \u00a0On November 25, 2017, Heckman was at work, looking at a picture of the Duchess with another employee while working on a story regarding the Royal Family of Britain. He said \u201cnot bad\u201d to this co-worker. \u00a0At that point, a female employee, Corinne Segal, who was sitting 20 feet away and could not see the picture being shown to Heckman, criticized Heckman for the comment and stated that he was not abiding by the sexual harassment training the employees had recently attended. Heckman immediately explained that he did not intend any sexually harassing remark and that he meant to convey that \u201cthe Duchess possessed charm and beauty and was a suitable match for her fiance.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Corinne Segal then complained to Scott Davis, the Executive Producer, about Heckman\u2019s \u201cnot bad\u201d comment. On November 27, 2017, just two days after the incident, Davis called Heckman and told him that he was fired because of the comment. The defendants did not conduct an investigation of the facts. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Heckman informed and complained to the defendants that Segal and another female employee had stated that Prime Minister of Canada Justin Trudeau is \u201chot\u201d in the presence of witnesses. The defendants took no action on this complaint.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Heckman alleges that the defendants enforced their policies regarding sexual harassment in a manner that was discriminatory, \u201cspecifically that they dismissed a male employee with no investigation within two days, but took no action when placed on notice of a similar remark by female employees in the presence of witnesses.\u201d <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The complaint provides a strong prima facie case. To make a prima facie case of discrimination, the courts <\/span><a href=\"https:\/\/www.justice.gov\/sites\/default\/files\/usao\/legacy\/2009\/05\/07\/usab5702.pdf\"><span style=\"font-weight: 400;\">apply the McDonnell Douglas test. <\/span><\/a><span style=\"font-weight: 400;\">The plaintiff must show that he: (1) belongs to a protected case; (2) was qualified for the job; and (3) was subjected to an adverse employment action; and that (4) the employer gave better treatment to a similarly-situated person outside the plaintiff\u2019s protected class. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Heckman has argued all four prongs.
