{"id":2983,"date":"2021-02-25T13:30:10","date_gmt":"2021-02-25T18:30:10","guid":{"rendered":"https:\/\/journals.law.harvard.edu\/jsel\/?p=2983"},"modified":"2023-07-25T11:40:51","modified_gmt":"2023-07-25T15:40:51","slug":"how-are-sports-leagues-clarifying-player-punishments-for-sports-gambling-controversies","status":"publish","type":"post","link":"https:\/\/journals.law.harvard.edu\/jsel\/2021\/02\/how-are-sports-leagues-clarifying-player-punishments-for-sports-gambling-controversies\/","title":{"rendered":"How are sports leagues clarifying player punishments for sports gambling controversies?"},"content":{"rendered":"<p><span style=\"font-weight: 400\">Brown and red leaves weren\u2019t the only unusual sight during last year\u2019s Masters Tournament. On top of an unprecedented November scene at Augusta National, one of the game\u2019s most historic sites witnessed another peculiarity: one of the game\u2019s most influential players donning a sports betting company\u2019s logo on his hat.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Bryson DeChambeau, the reigning U.S. Open champion and No. 6 golfer in the world at the time, <\/span><a href=\"https:\/\/www.actionnetwork.com\/golf\/bryson-dechambeau-signs-endorsement-deal-with-draftkings-sportsbook-the-first-of-its-kind\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">signed a multi-year endorsement contract<\/span><\/a><span style=\"font-weight: 400\"> with DraftKings in early November. DeChambeau became the first athlete to strike a deal with the well-known fantasy sports betting company, and, given the company\u2019s growth, he likely won\u2019t be the last.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Ever since the Supreme Court\u2019s ruling in <\/span><i><span style=\"font-weight: 400\">Murphy v. NCAA<\/span><\/i><span style=\"font-weight: 400\"> in 2018,<\/span> <span style=\"font-weight: 400\">sports gambling has consistently found itself in the spotlight. As a result, DraftKings was busy in 2020. Not only did it <\/span><a href=\"https:\/\/www.draftkings.com\/about\/news\/2020\/02\/draftkings-signs-multi-year-partnerships-with-three-nba-franchises\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">partner with professional sports teams<\/span><\/a><span style=\"font-weight: 400\">, but it also <\/span><a href=\"https:\/\/www.cnbc.com\/2019\/12\/23\/draftkings-to-become-public-company-forgoing-traditional-ipo.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">went public through a special purpose acquisition corporation<\/span><\/a><span style=\"font-weight: 400\"> (\u201cSPAC\u201d).<\/span><\/p>\n<p><span style=\"font-weight: 400\">Public perception, for the most part, <\/span><a href=\"https:\/\/www.actionnetwork.com\/news\/sports-betting-legalization-poll-october-10-2019\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">seems to support<\/span><\/a><span style=\"font-weight: 400\"> the legalization and growth of sports gambling. While sports leagues in the past have opposed sports gambling, even <\/span><a href=\"https:\/\/www.legalsportsreport.com\/sports-betting-deals\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">they are taking advantage<\/span><\/a><span style=\"font-weight: 400\"> and cashing in on newfound revenue (especially given COVID-19 financial difficulties).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Yet, what are sports leagues doing to protect the integrity of their games? While looking only at a small sample, it\u2019s clear that leagues have taken different approaches.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Just about any baseball fan (and most sports fans) will know the name Pete Rose, and because of his infamous gambling habits, Major League Baseball instituted the harshest penalty when it comes to athletes gambling on games. <\/span><a href=\"http:\/\/content.mlb.com\/documents\/8\/2\/2\/296982822\/Major_League_Rule_21.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">MLB Rule 21(d)<\/span><\/a><span style=\"font-weight: 400\"> details the following: If a player bets on any MLB game, the player will be suspended for one year. If a player bets on a game in which he participates, he is suspended indefinitely.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The NCAA has explicit rules, but they aren\u2019t quite as harsh. <\/span><a href=\"https:\/\/ncaaorg.s3.amazonaws.com\/ncaa\/wagering\/WAGER_DontBetOnItWhatSANeedToKnow.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">Current NCAA rules<\/span><\/a><span style=\"font-weight: 400\"> say athletes and athletics employees are not allowed \u201c(1) to bet on any sport sponsored by the NCAA at any level, including college and\/or professional or (2) to share information for sports wagering purposes.\u201d If an athlete gambles, he\/she loses eligibility for one year.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Meanwhile, the NFL, NBA, and MLS don\u2019t have concrete minimum punishments in their Constitutions and\/or collective bargaining agreements (CBAs) for gambling on games. Rather, those leagues give their respective Commissioners great flexibility in determining player punishment. The NFL\u2019s Constitution, <\/span><a href=\"https:\/\/www.onlabor.org\/wp-content\/uploads\/2017\/04\/co_.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">under Article 8.13(C)<\/span><\/a><span style=\"font-weight: 400\">, grants the Commissioner discretion in choosing a punishment. The 2020 CBA player contract also says the following:\u00a0<\/span><\/p>\n<blockquote><p><span style=\"font-weight: 400\">Commissioner will have the right, but only after giving Player the opportunity for a hearing at which he may be represented by counsel of his choice, to fine Player in a reasonable amount, to suspend Player for a period certain or indefinitely, and\/or to terminate this contract.&#8221;<\/span><\/p><\/blockquote>\n<p><span style=\"font-weight: 400\">The <\/span><a href=\"https:\/\/ak-static.cms.nba.com\/wp-content\/uploads\/sites\/4\/2019\/09\/NBA-Constitution-By-Laws-September-2019-1.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">NBA Constitution<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/s3.amazonaws.com\/mlspa\/Collective-Bargaining-Agreement-February-1-2015.pdf?mtime=20180213190926\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">former MLS CBA<\/span><\/a><span style=\"font-weight: 400\"> use very similar language. NFL Commissioner Roger Goodell, in his first and only gambling-related punishment, <\/span><a href=\"https:\/\/www.si.com\/gambling\/2019\/11\/29\/josh-shaw-suspension-betting-cardinals\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">suspended the Arizona Cardinals\u2019 Josh Shaw for a season<\/span><\/a><span style=\"font-weight: 400\"> when he bet on the Cardinals to lose a game. But he wasn\u2019t required to suspend Shaw.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The PGA TOUR\u2019s policy strikes an interesting balance between the approaches of the NFL and MLB but adds a new wrinkle. Article VI(D) of the TOUR\u2019s Tournament Regulations states players are subject to a minimum two-year suspension from tournament play for gambling activities. Interestingly, the <\/span><a href=\"https:\/\/www.pgatour.com\/company\/2017\/09\/18\/pga-tour-implementing-new-integrity-program-in-2018.html\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">TOUR also partnered with Genius Sports in 2018<\/span><\/a><span style=\"font-weight: 400\"> to institute an \u201cIntegrity Program.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Genius Sports offers a monitoring program that \u201cutilizes proprietary algorithms to identify potentially suspicious patterns occurring in global betting markets.\u201d The TOUR believes the integrity of its game is worth partnering with the monitoring system.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">But what is leading different leagues to take different approaches? It might be a result of the various leagues\u2019 distinct and diverging histories with gambling scandals. The\u00a0 NCAA, MLB, and PGA TOUR have the most explicit provisions and have had some history with gambling controversies. The <\/span><a href=\"https:\/\/www.theatlantic.com\/entertainment\/archive\/2013\/04\/the-college-basketball-victory-that-seemed-too-good-to-be-true-and-was\/275263\/\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">NCAA<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/www.history.com\/news\/the-black-sox-baseball-scandal-95-years-ago\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">MLB<\/span><\/a><span style=\"font-weight: 400\"> have dealt with scandals that rocked their product. Meanwhile, the PGA TOUR\u2019s Phil Mickelson <\/span><a href=\"https:\/\/bleacherreport.com\/articles\/2645060-pgas-silence-hypocrisy-on-phil-mickelsons-misdeeds-is-par-for-the-course#:~:text=Then%2C%20on%20Monday%20in%20Los,Tour%20winner's%20undisclosed%20gambling%20debts\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">garnered headlines for his relationship<\/span><\/a><span style=\"font-weight: 400\"> with an infamous Las Vegas gambler, and <\/span><a href=\"https:\/\/www.golfdigest.com\/story\/why-is-the-pga-tour-concerned-about-gambling-because-the-potential-problems-are-too-great-to-ignore\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">some caddies have suggested<\/span><\/a><span style=\"font-weight: 400\"> caddie gambling is not uncommon on the TOUR (and could be likelier for players on mini tours).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">On the flip side, the NFL, NBA, and MLS don\u2019t have concrete minimum punishments. The NFL, while it has had a few scandals throughout its history, has not been impacted like MLB or the NCAA. The NBA endured a <\/span><a href=\"https:\/\/www.espn.com\/nba\/story\/_\/id\/25980368\/how-former-ref-tim-donaghy-conspired-fix-nba-games\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">referee scandal<\/span><\/a><span style=\"font-weight: 400\">, but it didn\u2019t gain quite the recognition of the Pete Rose story or some of the NCAA scandals. The author could not identify any known examples of player gambling in MLS.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Additionally, maybe some leagues fear gambling more than others simply because of the makeup of the sport. Controlling the outcome of a game is easier in basketball, where there are only ten players on the court, as opposed to football, where it is more difficult for one player to determine the outcome (except for, perhaps, the quarterback).\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Yet, as DeChambeau\u2019s partnership with DraftKings shows, athletes and gambling operations are now closer to each other than ever before (at least publicly). Athletes will continually be surrounded by gambling operations and their logos, and there\u2019s already evidence that athlete gambling activities are likely underreported; <\/span><a href=\"https:\/\/ncaaorg.s3.amazonaws.com\/ncaa\/wagering\/WAGER_DontBetOnItWhatSANeedToKnow.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"font-weight: 400\">an NCAA study<\/span><\/a><span style=\"font-weight: 400\"> showed 24 percent of male and 5 percent of female athletes had recently gambled on sports.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The PGA TOUR has a system in place and is, likely, not surprised by one of its players partnering with a sports betting company.
