Several people involved with the movie production faced criminal and civil liability for the shooting, including Alec Baldwin, the star and producer of \u201cRust.\u201d Baldwin had the prop gun in his hand when it fired, but he <\/span><a href=\"https:\/\/www.nytimes.com\/2023\/08\/16\/arts\/alec-baldwin-gun-trigger-rust.html\"><span style=\"font-weight: 400\">claims the gun went off without him firing it<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p><span style=\"font-weight: 400\">In July 2024, Baldwin\u2019s criminal case, where he was charged with involuntary manslaughter, was <\/span><a href=\"https:\/\/www.cbsnews.com\/news\/alec-baldwin-dismissal-involuntary-manslaughter-rust-shooting\/#:~:text=The%20charge%20against%20Baldwin%20was,of%20the%20decision%20are%20exhausted.\"><span style=\"font-weight: 400\">dismissed with prejudice<\/span><\/a><span style=\"font-weight: 400\"> due to withheld evidence. Baldwin\u2019s lawyers argued the state buried the fact that the live rounds came from the prop supplier and not the film\u2019s armorer. Prosecutors asked the judge to reconsider, but on October 25, Judge Sommer of the First Judicial District Court of New Mexico ruled that Baldwin\u2019s involuntary manslaughter<\/span><a href=\"https:\/\/variety.com\/2024\/film\/news\/judge-denies-alec-baldwin-revive-trial-manslaughter-1236160153\/\"> <span style=\"font-weight: 400\">case will not be reopened<\/span><\/a><span style=\"font-weight: 400\">. Yet, this ruling is hardly the end of this tragedy as civil cases are still pending, and broader gun safety changes within Hollywood and the film industry are still actively being discussed.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">In addition to the criminal case, Hutchins\u2019 widow and son filed a wrongful death suit against Baldwin and other \u201cRust\u201d producers, which<\/span><a href=\"https:\/\/variety.com\/2024\/film\/news\/rust-halyna-hutchins-alec-baldwin-settlement-late-1235935392\/\"> <span style=\"font-weight: 400\">settled<\/span><\/a><span style=\"font-weight: 400\"> in October 2022. According to the New York Times, one of the terms of the settlement was making Hutchins\u2019 husband an executive producer of the film, allowing the family to benefit from the<\/span><a href=\"https:\/\/www.nytimes.com\/2024\/07\/14\/arts\/alec-baldwin-rust-lawsuits.html\"> <span style=\"font-weight: 400\">film\u2019s profits<\/span><\/a><span style=\"font-weight: 400\">. Other terms, including the specific monetary payment, have not been released, but \u201cRust\u201d is <\/span><a href=\"https:\/\/variety.com\/2024\/film\/news\/rust-halyna-hutchins-alec-baldwin-settlement-late-1235935392\/\"><span style=\"font-weight: 400\">behind on their scheduled settlement payments.<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400\">Beyond the wrongful death suit, Hutchins\u2019 parents, sister, and \u201cRust\u201d script supervisor<\/span><a href=\"https:\/\/www.kshb.com\/us-news\/crime\/alec-baldwin-faces-new-lawsuit-for-rust-shooting-from-victims-family\"><span style=\"font-weight: 400\"> filed a suit<\/span><\/a><span style=\"font-weight: 400\"> against Baldwin alleging infliction of emotional distress, assault, and battery, along with a negligence claim against Baldwin and others involved in the \u201cRust\u201d production. \u201cRust\u201d crew members, including the <\/span><a href=\"https:\/\/variety.com\/2021\/film\/news\/rust-alec-baldwin-serge-svetnoy-lawsuit-1235109520\/#:~:text=The%20suit%20accuses%20several%20people,to%20maintain%20a%20safe%20set.\"><span style=\"font-weight: 400\">movie\u2019s gaffer<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/apnews.com\/article\/alec-baldwin-rust-movie-medic-lawsuit-03e7ae14c908c7a4a6342d85c8d0db4e#:~:text=SANTA%20FE%2C%20N.M.%20(AP),Alec%20Baldwin%20during%20a%20rehearsal.\"><span style=\"font-weight: 400\">key medic<\/span><\/a><span style=\"font-weight: 400\">, have also filed negligence suits against the production. The key medic <\/span><a href=\"https:\/\/apnews.com\/article\/alec-baldwin-rust-movie-medic-lawsuit-03e7ae14c908c7a4a6342d85c8d0db4e#:~:text=SANTA%20FE%2C%20N.M.%20(AP),Alec%20Baldwin%20during%20a%20rehearsal.\"><span style=\"font-weight: 400\">settled<\/span><\/a><span style=\"font-weight: 400\"> for $1.5 million.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">The armorer, Hannah Gutierrez Reed, as the person responsible for firearm safety on set, has also filed her own civil suit. Reed is suing <\/span><a href=\"https:\/\/variety.com\/2022\/film\/news\/hannah-gutierrez-reed-seth-kenney-rust-ammunition-1235152905\/\"><span style=\"font-weight: 400\">the movie\u2019s ammunition supplier<\/span><\/a><span style=\"font-weight: 400\">, alleging the supplier gave both dummy rounds and live ammunition when it was only supposed to give dummy rounds. In March 2024 a jury found Reed guilty of <\/span><a href=\"https:\/\/www.nbcnews.com\/news\/us-news\/rust-armorer-hannah-gutierrez-reed-denied-release-prison-rcna172784\"><span style=\"font-weight: 400\">involuntary manslaughter<\/span><\/a><span style=\"font-weight: 400\"> and sentenced her to 18 months in prison.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Due to the shooting, the New Mexico Environmental Department\u2019s Occupational Health and Safety Bureau (NM OHSB) issued \u201cRust\u201d the<\/span><a href=\"https:\/\/www.usatoday.com\/story\/entertainment\/movies\/2022\/04\/20\/rust-movie-maximum-fine-gun-safety-failures-alec-baldwin-shooting\/7385746001\/\"> <span style=\"font-weight: 400\">maximum fine<\/span><\/a><span style=\"font-weight: 400\"> of $136,793 for gun safety failures under New Mexico law and a <\/span><a href=\"https:\/\/www.env.nm.gov\/occupational_health_safety\/wp-content\/uploads\/sites\/12\/2022\/04\/2022-04-20-COMMS-NMED-releases-OHSB-report-into-shooting-on-set-of-Rust-Final.pdf\"><span style=\"font-weight: 400\">\u201cwillful\u201d citation<\/span><\/a><span style=\"font-weight: 400\">, the highest level of citation, for violations that led to an \u201cavoidable death.\u201d A <\/span><a href=\"https:\/\/deadline.com\/wp-content\/uploads\/2022\/04\/2022-04-19-NM-OSHA-Rust-Summary-of-Investigation.pdf\"><span style=\"font-weight: 400\">report<\/span><\/a> <span style=\"font-weight: 400\">conducted by the NM OHSB noted that \u201cRust\u201d failed to give staff enough time to inspect the ammunition and ensure there were not any live rounds.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Although there had been <\/span><a href=\"https:\/\/www.usatoday.com\/story\/entertainment\/movies\/2022\/04\/20\/rust-movie-maximum-fine-gun-safety-failures-alec-baldwin-shooting\/7385746001\/\"><span style=\"font-weight: 400\">two previous gun misfires<\/span><\/a><span style=\"font-weight: 400\"> on the set, little to no action was taken in response. In addition, the team responsible for on-set weapons was <\/span><a href=\"https:\/\/www.npr.org\/2022\/04\/20\/1093773059\/rust-movie-shooting-firearms-safety-fine-alec-baldwin\"><span style=\"font-weight: 400\">small and had limited resources<\/span><\/a><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Hutchins\u2019 death has led the film industry to rethink how they use guns in their films. While current industry practice includes using real guns on set, should they consider using replicas instead? Should productions use blank fire (which is a shell casing that does not have a bullet) or special effects? At least one TV show has answered these questions. <\/span><a href=\"https:\/\/www.nytimes.com\/2023\/11\/25\/arts\/rust-killing-forces-hollywood-to-make-choices-on-guns.html\"><span style=\"font-weight: 400\">\u201cWalker\u201d has banned real guns<\/span><\/a><span style=\"font-weight: 400\"> on set in light of the \u201cRust\u201d tragedy, and decided to use special effects to replicate the sounds of gunfire instead.<\/span><\/p>\n<p><span style=\"font-weight: 400\">However, others in the industry have continued to use real guns not only because they are more realistic, but also because they believe them to be safe. <\/span><a href=\"https:\/\/www.nytimes.com\/2023\/11\/25\/arts\/rust-killing-forces-hollywood-to-make-choices-on-guns.html\"><span style=\"font-weight: 400\">Some in the industry believe<\/span><\/a><span style=\"font-weight: 400\"> the \u201cRust\u201d shooting was an outlier which could have been prevented had standard safety protocols been followed. Nevertheless, even if individuals in the industry want to continue to use real guns, there is significant pressure from stakeholders such as insurance companies, union representatives, lawmakers, and major studios to not do so. In one instance, <\/span><a href=\"https:\/\/www.nytimes.com\/2023\/11\/25\/arts\/rust-killing-forces-hollywood-to-make-choices-on-guns.html#:~:text=There%20are%20some%20indications%20that,several%20entertainment%20insurance%20brokers%20said.\"><span style=\"font-weight: 400\">insurance companies<\/span><\/a><span style=\"font-weight: 400\"> have refused to cover low-budget films that use real guns on set.<\/span><\/p>\n<p><span style=\"font-weight: 400\">There have also been conversations amongst union representatives and major studios to potentially modify the documents that govern firearm use on sets. Those documents include Safety Bulletins <\/span><a href=\"https:\/\/www.csatf.org\/01_safety_bltn_firearms\/\"><span style=\"font-weight: 400\">No. 1<\/span><\/a><span style=\"font-weight: 400\">, which lays out safety recommendations and training for using firearms, blanks, and dummy rounds on set, and <\/span><a href=\"https:\/\/www.csatf.org\/02_safety_bltn_live_ammunition\/\"><span style=\"font-weight: 400\">No. 2<\/span><\/a><span style=\"font-weight: 400\">, which prohibits live ammunition except for certain, limited situations. These Safety Bulletins are written by the Industry-Wide Labor-Management Safety Committee and had previously been revised <\/span><a href=\"https:\/\/www.nytimes.com\/2023\/11\/25\/arts\/rust-killing-forces-hollywood-to-make-choices-on-guns.html\"><span style=\"font-weight: 400\">twenty years ago<\/span><\/a><span style=\"font-weight: 400\">.\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">In July of 2023, Governor Gavin Newsom codified Safety Bulletins No. 1 and No. 2, which had previously been voluntary, now requiring all productions in California to adhere to those guidelines. Furthermore, following the shooting,<\/span> <a href=\"https:\/\/www.syracuse.com\/entertainment\/2021\/10\/ny-lawmaker-introduces-bill-banning-live-ammo-on-movie-sets-after-fatal-shooting.html\"><span style=\"font-weight: 400\">New York<\/span><\/a><span style=\"font-weight: 400\"> and <\/span><a href=\"https:\/\/www.indiewire.com\/features\/general\/ban-live-ammunition-on-sets-california-new-york-1234691784\/\"><span style=\"font-weight: 400\">California<\/span><\/a><span style=\"font-weight: 400\"> have introduced bills that would ban live ammunition on sets.<\/span><\/p>\n<p><span style=\"font-weight: 400\">There have also been legislative attempts to restrict firearms on sets. California lawmakers initially <\/span><a href=\"https:\/\/californiaglobe.com\/articles\/film-set-firearms-ban-proposal-changed-following-industry-backlash\/\"><span style=\"font-weight: 400\">proposed banning real firearms<\/span><\/a><span style=\"font-weight: 400\"> on sets. However, due to intense industry opposition, the California legislature instead <\/span><a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billTextClient.xhtml?bill_id=202320240SB132\"><span style=\"font-weight: 400\">passed a law<\/span><\/a><span style=\"font-weight: 400\"> that requires any production receiving industry tax credits to have safety advisers and firearms training.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Despite attempts to restrict firearm usage, that does not change the fact that live ammunition was not supposed to be on the \u201cRust\u201d set as<\/span><a href=\"https:\/\/www.cbsnews.com\/news\/rust-movie-shooting-trial-hannah-gutierrez-reed-seth-kenney\/\"><span style=\"font-weight: 400\"> industry and union guidelines<\/span><\/a><span style=\"font-weight: 400\"> prohibit live ammunition on movie sets. Reed said she brought<\/span><a href=\"https:\/\/www.reuters.com\/world\/us\/how-did-live-rounds-get-onto-set-alec-baldwins-rust-2023-03-27\/\"> <span style=\"font-weight: 400\">dummy rounds<\/span><\/a><span style=\"font-weight: 400\">, which look like real bullets but cannot be fired, on set. Despite this, five live rounds were found on set in addition to the live round that killed Hutchins.<\/span><\/p>\n<p><span style=\"font-weight: 400\">Moreover, <\/span><a href=\"https:\/\/www.nytimes.com\/2023\/11\/25\/arts\/rust-killing-forces-hollywood-to-make-choices-on-guns.html\"><span style=\"font-weight: 400\">armorers have also expressed<\/span><\/a><span style=\"font-weight: 400\"> that they are seeing fewer opportunities due to an increase in demand for real gun alternatives. Steven Leek, who specializes in one alternative\u2014gas-powered guns\u2014<\/span><a href=\"https:\/\/www.nytimes.com\/2023\/11\/25\/arts\/rust-killing-forces-hollywood-to-make-choices-on-guns.html\"><span style=\"font-weight: 400\">had seen an increase<\/span><\/a><span style=\"font-weight: 400\"> in demand even before the \u201cRust\u201d shooting. The action movie \u201cHypnotic\u201d had a <\/span><a href=\"https:\/\/www.nytimes.com\/2023\/11\/25\/arts\/rust-killing-forces-hollywood-to-make-choices-on-guns.html\"><span style=\"font-weight: 400\">completely computer-generated gunfire<\/span><\/a><span style=\"font-weight: 400\"> scene. After the incident, Baldwin had even gone so far to advocate for removing all ammunition on sets. He said,<\/span> <a href=\"https:\/\/www.nytimes.com\/2023\/11\/25\/arts\/rust-killing-forces-hollywood-to-make-choices-on-guns.html\"><span style=\"font-weight: 400\">\u201cNo blanks, no dummies and, of course, no live rounds.\u201d<\/span><\/a><\/p>\n<p><span style=\"font-weight: 400\">While Hutchins\u2019 death is a tragedy, it is not the first gun-related death on a movie set.<\/span> <span style=\"font-weight: 400\">In 1984, Jon-Erik Hexum <\/span><a href=\"https:\/\/www.upi.com\/Archives\/1984\/10\/20\/The-body-of-actor-Jon-Erik-Hexum-who-fatally-shot\/9056467092800\/\"><span style=\"font-weight: 400\">died after he shot himself in the head<\/span><\/a><span style=\"font-weight: 400\"> with a gun filled with blanks while on the set of a CBS series.<\/span> <span style=\"font-weight: 400\">In 1993, Brandon Lee <\/span><a href=\"https:\/\/www.nytimes.com\/1993\/09\/06\/us\/no-charges-filed-in-actor-s-death-during-filming.html\"><span style=\"font-weight: 400\">was killed<\/span><\/a><span style=\"font-weight: 400\"> after a bullet was lodged in the barrel of the gun used on the set for \u201cThe Crow.\u201d\u00a0<\/span><\/p>\n<p><span style=\"font-weight: 400\">Despite calls for legislative reform of firearm safety and protocols on sets following the shooting, so far most of the changes have happened sporadically and individually, with isolated actions often brought by individual groups, companies, or agencies. For instance, individual producers <\/span><a href=\"https:\/\/www.nytimes.com\/2023\/11\/25\/arts\/rust-killing-forces-hollywood-to-make-choices-on-guns.html\"><span style=\"font-weight: 400\">have decided to ban<\/span><\/a><span style=\"font-weight: 400\"> firearms or adjust safety protocols on their sets. But conversations with respect to legislation are still ongoing, so there remains hope that more widespread reform will come from this tragedy in the future.<\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Written by Nefertari Elshiekh.
